UIMH.^ ^ K- £ MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT May 2nd, 1996 The Otter Tail County Board of Adjustment met Thursday, May 2nd, 1996, with the following persons in attendance; Craig Anderson John Everts Cecil Femling Randall Mann Robert Schwartz George Walter Pat Eckert, Land and Resource Management Wally Senyk, County Attorney Call to Order - The meeting was called to order at 6:00 p.m. by Chairman George Walter. Minutes Approved - March 28th, 1996 and April 4th, 1996 Hearing no corrections or additions the minutes of the March 28th, 1996, meeting and the minutes of the April 4th, 1996, meeting were approved as mailed. The following variance requests were heard: Wayne and Janice Ward - Tabled Wayne and Janice Ward, Mooreton, ND, requested a variance of 63’ from the required side lot line setback of 65’, a variance of 29’ from the required side lot line setback of 65’ and a variance of 18’ from the required ordinary high water level setback of 20’ for the repair of a water - oriented accessory structure located 2’ from the west lot line, 36’ from the east lot line and 2’ from the ordinary high water level. The property is described as Lot 24 and a triangular tract 15’ on the north and 0’ on the south of Lot 25, Deer Lake Beach in Everts Township. The audience was polled with no one speaking for or against the request. A letter from Robert and Eileen Tolbert in favor of the applicants’ variance request was read for the record. After consideration and upon a written request from the applicants, motion was made by Randall Mann, seconded by Craig Anderson and unanimously carried, to table this variance request until the June 6th, 1996, meeting for a determination by the Land and Resource Management Department as to whether the proposed project is a remodeling project or a replacement of an existing structure. Tim T. Schmitz - Approved Tim T. Schmitz, Perham, MN, requested a variance of T 10” from the required side lot line setback of 10’ for the construction of a 51’ by 24’ addition to an existing dwelling 8’ 2” from the side lot line. The property is described as Lot 7, Brooklyn Addition to Belka Beach, Little Pine Lake in Gorman Township. The audience was polled with no one speaking for or against the request. Mr George Hausske, Inspector, The Following statements are my evaluations on the "hell Situation".' V' Water from the, Vvell in question, is used to water grass only, and not for drinking. 1. Cannot put well between houses because it would abstruct with the passage way between houses, docks, boats, and wood for fuel is brought through this area. 2. This area is much to low to put electrical wire in between houses on E. side, water collects here every time it rains, causing pot­ ential electrical hazards. 3. Well is needed in back yard to water the lawn which is on very sandy soil and needs water to grow. Can't use house well because pump is not made for continuous running. 4. Costs prohibit me from putting a well in front yard because of electrical cost^nd also pump is not needed in this area. Front yard gets water from neighbors irrigation system. 5. 6. We do not need water from this well for household use as we have a deep well for family use. 7. Well is positioned so that is out of the way not right in the middle of the yard. Also LeRoy Kresein's would not like it between our houses because that is where they have to move boats to and from lake. It would really cause a passage problem. 8. Small trees along property would also be destroyed.9. ID.The out house next to my house has a approved sealed container and is only used maybe 5 or 6 times a summer. I will agree to any water tests available, if the water is contaminated I would immeditaly remove the well. 11. (1) I find it impossible to re-locate the well in the back yard because I would be within 50 Feet of any source of contamination. 12. I did answer your first letter;:::: I don't know what happened to it.13. In conclusion I feel that well is needed for grass watering. I feel that well could not be placed any where on n^y property without dis­ obeying shore line code restrictions. I need this well for watering the grass and thats all I need it for.
