Motion

Motion was made by Mark Steuart, second by Steve Schierer and unanimously carried, to approve a variance of 5’
from the required septic tank setback of 10’ for the placement of a garage 5’ from an existing septic tank and to deny
the applicants’ request to cover more than 25% of their total lot area with impervious surface. It was noted that the
variance as approved should provide the applicants with a reasonable use of their property.

OTTER TAIL COUNTY BOARD OF ADJUSTMENT
May 4, 2000
The Otter Tail County Board of Adjustment met Thursday, May 4, 2000, with the following persons in
attendance:

Call to Order - Randall Mann, Chairman, called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved -
Hearing no corrections or additions the minutes of the April 13, 2000, meeting was approved as mailed.
The following variance requests were heard:
Wiiliam & Julie Brodeur - Approved Septic Tank Setback/Denied Impervious Surface Coverage.
William and Julie Brodeur, Fargo, ND, requested a variance of 5’ from the required septic tank setback
of 10’ for the placement of a garage 5’ from an existing septic tank and a variance of 5.8% from the
maximum allowable impervious surface coverage of 25% for total impervious surface coverage of
30.8% after the addition of the proposed garage. The property is described as Lot 8, Palubicki Beach
and part of Lot 1, Seibels Beach, Little Pine Lake in Gorman Township. The audience was polled with
no one speaking for or against the request. The applicant noted that the garage would be 24’ by 24’.
After consideration, motion was made by Mark Steuart, second by Steve Schierer and unanimously
carried, to approve a variance of 5’ from the required septic tank setback of 10’ for the placement of a
garage 5’ from an existing septic tank and to deny the applicants’ request to cover more than 25% of
their total lot area with impervious surface. It was noted that the variance as approved should provide
the applicants with a reasonable use of their property.
James Drechsel - Denied as requested.
James Drechsel, Fergus Falls, MN, requested a variance to subdivide, by metes and bounds
description, a parcel of less than 5 acres from an existing 29.97 acre parcel. The parcel would be
approximately 100’ by 105’ and if the proposed subdivision is approved the parcel would be
permanently attached to Lot 3, Jewett Lake South Side Shores. The proposed tract would only be used
for a storage structure. The property is described as part of Government Lot 5, Section 23 of Elizabeth
Township by Jewett Lake. Todd Green, the proposed purchaser, represented the applicant at the public
hearing. The audience was polled with no one speaking for or against the request. After consideration,
motion was made by Cecil Femling, second by David Holmgren and unanimously carried, to deny the
variance as requested as no adequate hardship had been shown that would allow for the granting of a
variance from the requirements of platting. It should be noted that the Board supported the applicant’s
concept, but were of the opinion that the proposed subdivision should be accomplish through platting
rather than by a metes and bounds subdivision.

Dear Sir or Madam:
We are requesting a variance to the dwelling density and septic tank setback regulations
in order to construct a garage behind our lake home on Little Pine Lake. The legal
description of our property, also known as LP#19, is attached. Currently there is no
outside storage or garage on the property.
The only garage placement options available that meet all the setback and density
requirements, involve placing the garage closer to the road in the back of the property.
These options are not possible because of the following reasons. It would be close to or
on top of the drain field or septic line to the drain field. Because of the shared property
access road it is not possible to enter the garage without building a new road. The
building of a new access road and or placement of the garage further back on the lot
would seriously hinder our neighbors use of their property. I would also like to make the
point that the placement of the garage as we are requesting provides for a much better
natural appearance from the road because all the buildings would be towards the front of
the property and would allow for a buffer of trees and grass.
We feel we meet the criteria for a variance because the irregular lot shape causes
hardship unique to our property. We have explored every garage placement option
possible on this property and have concluded that this is the only real option available on
this property. It allows us the right as a property owner to have a greatly needed storage
area and car shelter without having a detrimental impact on our neighbors or the natural
appearance of the property.

from the required side lot line setback of 10’ for an 18’ by 38’ addition to an existing dwelling 9’ 8” from the side lot line.
It should be noted that the proposed addition would be 65’ 8” from the existing water line at the closest point and 68’
10” at the farthest point. Hardship is a substandard lot of record and the unique shape of the applicant’s property. It
should also be noted that only a small portion of the proposed addition would be less than 10’ from the lot line.

existing cabin. The proposed addition will be 65’ 8” from the existing water line at the closest point and
68’ 10” at the farthest point. The proposed addition will be 9’ 8" from the side property line at the back
of the addition and 12’ 6” from the side property line at the front of the addition.” The required ordinary
high water level setback is 75’ and the required side lot line setback is 10’. The property is described'
as part of Lot 1, Siebel’s Beach and Lot 8, Palubicki Beach, Little Pine Lake in Gorman Township. The
audience was polled with no one speaking for or against the request. A letter from Gerald and
Elizabeth Moriarity in favor of the applicant’s request was read for the record. After consideration,
motion was made by John Everts, seconded by George Walter and unanimously carried, to approve a
variance of 4" from the required side lot line setback of 10’ for an 18’ by 38’ addition to an existing
dwelling 9’ 8” from the side lot line. It should be noted that the proposed addition would be 65’ 8” from

Township. Julian Wold represented the applicant at the public hearing. The audience was polled with
no one speaking for or against the request. After consideration, motion was made by Craig Anderson,
seconded by Cecil Femling and unanimously carried, to approve a variance of 39’ from the required
ordinary high water level setback of 150’ for the placement of two holding tanks 11T from the ordinary
high water level.
Bonita K. Ronning - Approved
Bonita K. Ronning, Auburn, WA, requested a variance to exceed the string line by approximately 18’.
The structure would be approximately 56’ back from the lake and in line with other existing structures.
The property is described as Lot 7, Meyer’s Addition, West McDonald Lake in Dora Township. The
audience was polled with no one speaking for or against the request. After consideration, motion was
made by Randall Mann, seconded by Robert Schwartz and unanimously carried to approve the
variance as requested in the application and as depicted in the applicant’s drawings. It was noted that
placing the new dwelling in this location will place the dwelling further back from the ordinary high water
level than the existing dwelling and will be in line with other structures in the immediate area.

However, during a lake visit late last fall I found the trailer
had been moved from alongside the Bierman cottage to a point almost
mid-way back on the lot, but directly opposite the main entrance
to our home and where our view from our main part of the residence
was obscured by the trailer. I protested immediately to Bierman,
saying that if I wanted to live in a trailer city I certainly would not have paid such a high price (with high taxes) for my
home.
Several points are worthy of official reconsideration.
First, the hearing notice was almost fraudulently worded because
the trailer originally was located on Siebel's Beach, not
Palubicki's Beach, according to a survey and plat made by Carl J.
Nedberge, Minnesota registered land surveyor.
Second, the hearing was to consider allowing a 2nd dwelling on
a single lot on Palubicki's Beach. There was no first dwelling
so how could permission for a 2nd dwelling be granted? The first
dwelling was the lakeshore cottage of Bierman on Siebel's Beach
and the trailer was a second dwelling, also on Siebel's Beach.
Because our view to the public road on the north shore was
blocked, Bierman did move the trailer a bit closer toward his
cottage. It is not now connected to a drainage field so it
could be moved again, preferably off the shore completely.
Some of the property owners along the shore were alarmed about
the trailer's position and voiced displeasure even before we saw
it.

If, as it appears, both the Bierman home and the trailer still
are on Siebel's Beach, there was no justification for moving
the trailer from its previous location. All it does is
depreciate the value of our property!
When I saw my brother-in-law, Judge Donald A. Gray, in
Stillwater during the Riordan trial the other day, I explained
I was upset about the board of adjustment's decision and would
seek both clarification of the hearing action and reconsideration.
If that is unsatisfactory, more than likely I would initiate
legal action.
Secondly, I plan an appeal for a decrease in property taxes
because of the obscene relocation of the trailer.
So I ask the board of adjustment to reconsider its action in
regard to a 2nd dwelling on Lot 8, Palubick's Beach when
obviously such is not the case.
I also have a series of color photographs showing how the
trailer spoils our view and my disposition.

Your letter of February 5, 1986 vias presented to the Board of Adjustment at their meeting
of March 6th, with no action taken. Mr. Bierman's request was to allow the travel trailer
to remain as a second dwelling on the lot owned by Mr. Bientan, viiich is in direct viola
tion of our shoreland management ordinance. Bierman was grcinted 90 days to remove the
trailer in question.
If Mr. Bierman movedthis trailer to another lot, cind it is placed within the guidelines
of our shoreland management ordinance, we have no recourse but to allow it to remain.
I am referring your letter to the Land & Resource Department vho will check to see if
placement of the trailer is in violation of our ordinance.

This is official notification that I am protesting the tax assessment on
our residence on the north shore of L:‘ttle Pine Lake, R.l, Parham, Minn.
We purchased the home last year on parts of Siebel's Beach and Palubicki’s

My chief objection is that a governmental agency has permitted a mobile home to
be located in such a oosltlon so as to greatly depreciate the value of our
property. The mobile home was ordered moved from a loca'^ion neit to the
residence of mv neighbor, Herb Blarman, to another spot on his lot which
blocks our vision from one of the main areas of the home. This condition
did not exist when I purchased the home because, if it did, I would not have
bought ihe property to be my permanent retirement home.
With this protest I am including two enclosures:
1. Two winter and two summer color photographs taken of the relocated
mobile -trailer home. I took all four pictures from the viewing area just
adjacent to the main entrance of our home.
2. A copy of a letter written to the county auditor, which details more
reasons for my displeasure.
Significant is the statement: "I protested immediately to Bierman, saying
that if I wanted to live in a trailer city I certainly would not have paid
such a high price (with high taxes3 for my homei That is part of the fourth
paragraph of my latter to Sylvia Bergerud, county auditor.
I appeal for tax relief or assistance in seeing the mobile home-trailer is
returned to its original location or else moved from the property completely.
