MN Dear Mr. Stein: We are writing this letter as a follow-up to our phone conversations on August 21st and 22nd. As you are aware I called the office for clarification of the lot line variance. I wanted to clarify that the new lot line must be 10 feet from each dwelling. I wanted to clarify this point as the line is being surveyed. I do understand that the new lot line to the rear must begin 10 feet from the properties. When I called to clarify this information I discovered I left the meeting on August 13th with a different understanding of my variance approval than what appears to be stated. I left with the understanding that I could build onto the existing structure as long as I build no closer to the lot line than the structure presently is and as long as I am in compliance with the required setback from the lake and meet the land usage requirement. The addition to our bedroom would not be any closer to the lot line than the present structure. We simply want to “fill in” this section. When we met with the commission you may recall a member had a question about the 3 foot variance which I had asked for on the west side of the property. I understood they did not allow the three foot variance, but twice confirmed I could extend the structure as long as it did not extend any closer to the lot line than the present structure. I even drew a line on the diagram which extended the structure. All we received was the verbal affirmative and understood we could proceed. The distance between the two structures will remain the same. We simply want to close off the corner of the house. We understood we could do this. As I pointed out in our phone conversation it was my understanding we could proceed as long as we did not come any closer to the lot line and stay within the required setback. The day following the hearing I obtained a building permit and also purchased brick, windows and set a starting date with my contractor for September 8th. As a point of clarification, please tell me we are correct. We plan to make this our home and wish to improve the properties livable and aesthetic value. This is the reason why the applicant has requested a 2‘ variance from the side lot line. In addition, Mr. Spittal has a holding tank on his property. The shoreland ordinance requires that holding tanks be located at least 10' away from any structure on the property. After the addition the garage will be 5' from the applicant's holding tank. The Board of Adjustment at their June 4th meeting approved both of Mr. Spittal's requests. The side lot line variance of 2' was approved due to the fact that the addition to the existing garage will be no closer than the existing structure presently is to the side lot line. The variance of 5' from the required 1 O' holding tank setback was approved because the applicant has adequate room to service the holding tank on his property without encroaching on the neighbor's property and the location of the holding tank 5' from the garage does not present a health problem.
