This request had been tabled at the April 2nd, 1992 meeting. The applicant has amended his request as follows: requesting a variance to construct a water-oriented structure with a height of 13' instead of the allowable height for a water- oriented structure of 1 O'. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, seconded by Dan Oehler and failed to carry with Craig Anderson, John Everts, Bert Olson and George Walter voting no, to approve the amended request of 13' In height for the water-oriented structure. No adequate hardship was shown for the granting of this variance. This request is no different then the request granted in 1986 and it is outside of the shore impact zone area. Junius Fergus Falls, MN 56537 March 24th, 1992 Marion Bucholz 144 5th St. NW Perham, MN 56573 Dear Marion, At the present time there is an existing 12' by 18' structure located on the \>?est property line. The request of Mr. Boedigheimer is to replace this existing structure with a 16' by 24' structure. The new structure would be located 2' from the west property line. Our files do not indicate when the existing structure was constructed. If it was constructed prior to the ordinance then no violation would have occured, if not, it would have nedded to meet all of the setback requirements that would have been in effect at the time of construction. If the requirements could not be complied with then a variance would have been necessary. Since we do not have information in our files as to when the existing structure was constructed it is not possible for me^o make a judgment regarding any violation that may exist due to the construction of the existing structure. I will bring this to the attention of the Shoreland Managaneht staff and they may wish to research when the existing structure was constructed. At the April 2nd, 1992 meeting a discussion will take place as to the granting of a variance for the replacement of the existing 12' by 18' structure with a 16' by 24' structure. Members of the Board of Adjustment will view this property prior to the meeting and after hearing the applicant and any other concerned parties they will make their decision. If Mr. Boedigheimer has already had the new structure constructed, then he has done so without obtaining the necessary variance or site permit and this would be a violation of the ordinance. If the structure is alrejidy there that fact will mostly likely be discussed at the hearing. I will mention to the Shoreland Management staff that perhaps the new structure is already in place and they will stop by the property to view the situation and take whatever action is necessary.$ It does happen from time to time that an individual does start and sometimes even completes a project liefore they either realize or are informed that they need a variance and/or a site permit. lliere is no indication in Mr. Boedigheimer file that the project has been started.
