(7:36 p.m.) Solveig Halbakken Living Tmst, Lot 6 Camp Nidaros, Otter Tail Lake in Amor Township, requested the following: We are asking for a variance to the lot line setback from 40’ to 25’ for a water oriented accessory structure. With this variance the proposed gazebo will be less visible from the lake as well as Otter Tail County Highway 1. Placing the gazebo as proposed will place it in such a way that vegetation will screen it on the north and east side throughout the late spring tlirough late fall. Additionally, the neighboring property to the north-east has a garage with a side wall approximately 40’ from the lot line screening the living quarters from view. The proposed gazebo’s placement will not interfere with the neighbor’s view or access to| the lake. There is an existing water oriented accessory structure, it will-be removed, it was damaged by ice,. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Darren Newville made a motion, seconded by Loren Bailey and unanimously carried, to approve the variance as described in the variance application dated August 6, 2017 and as depicted on the drawing submitted with the application. It was noted that the proposed development isjan improvement to the property as the proposed structure will be further from the lot line and from the ordinary high-water level. Exterior wall and roof to be in line with existing wall and roof structure of cunent house. Per phone conversation with Gathy the proposed enclosure will be 22’ from top of bluff. Asking for an 8’ variance. The audience was polled with no one speaking for oi' against the variance as requested. After discussion and consideration, Thomas Lee made a motion, seconded by Paul Larson and unanimously carried, to approve an 8’ variance from the required bluff setback of 30’ for the enclosure of the existing 8’ by 13’ outdoor walkway into indoor living space located 22’ from the bluff as described in the variance application dated August 8, 2017 and as depicted on the drawing submitted with the variance application. It was noted that the enclosed area will be no closer to the bluff than the front of the existing house. It was also noted that three of the four walls needed to enclose this area already exists. It was strongly encouraged that the applicant consider the placement of gutters to direct the water away from the bluff. The variance as approved does not directly or indirectly grant any other variances for the proposed development or for any future development. The remaining parcel will be approximately 20 acres in size and buildable. Upon approval, a surveyor’s drawing will be obtained for recording purposes. The audience was polled with Don Matz indicating landownership issues. After discussion and consideration, Paul Larson made a motion, seconded by Thomas Lee and unanimously carried, to approve the proposed subdivisions as described in the variance application dated August 16, 2017 with the following conditions: 1.) each of the proposed lots must have at least 20,000 square feet of area, 2) a registered surveyor’s drawing must be provided at the time of conveyance and 3.) the ownership issues must be resolved. It was noted that the Board |Of Adjustment does not resolve boundary or land title issues. Those issues must be resolved between the property owners and if [left unresolved could create title issues for cunent and future owners. The Board of Adjustment considered the following applications for variance: Diane M. McLeod and Paul Jeffers - Approved the variance as requested. (6:32 p.m.) Diane M. McLeod and Paul Jeffers, Sub Lot 1 and part of Sub Lot 2 of Government Lot 3, Section 27 of Rush Lake Township by Round Lake, requested a variance of 10’ from the required ordinary high water level setback of 75’ for the purpose of enclosing an existing carport located 65' from the ordinary high water level. Terry Lee, Contractor, represented the applicant’s at the public hearing. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Michael Harris and unanimously carried, to approve a variance of 10’ from the required ordinary high water level setback of 75’ for the purpose of enclosing an existing carport located 65’ from the ordinary high water level.
