Denise A. Harbison, ET AL, Columbia Heights, MN, requested a variance of 100’ from the required
ordinary high water level setback of 200’ for the placement of an outhouse 100’ from the ordinary high
water level. The property is described as part of Government Lot 2, Section 17 of Dead Lake Township
by Dead Lake. Diane Bonine represented the applicant at the public hearing. The audience was polled
with no one speaking for or against the request. After consideration, motion was made by Craig
Anderson, seconded by Robert Schwartz and unanimously carried, to approve the placement of an
outhouse having an ordinary high water level setback of more than 8T but less than 100’ with the
condition that the outhouse must have a sealed tank. It was noted that the existing outhouse is setback
approximately 8T from the ordinary high water level and that the placement of an outhouse with a seal
tank should address any concerns that might exist thereby minimizing the need to require a setback of
200’.

against the request. After consideration, motion was made by Craig Anderson, seconded by John
Everts and unanimously carried, to approve a variance of T from the required lot line setback of 10’ for
the construction of a 24’ by 34’ 2-story addition to an existing cabin 9’ from the lot line. Hardship is a

from the required 18’ maximum height of a non-dwelling structure for the construction of a 54’ by
72’ pole building with 12’ side walls, a 4/12 pitch and an overall height of 21’. The property is
described as part of Government Lot 2, Section 10 of Friberg Township by Heilberger Lake.
The audience was polled with no one speaking for or against the request. Letters of support
form the following individuals were read for the record: Clifton Allen, Geraldine Bakken and
Harold Collins. After discussion and consideration, motion was made by Randall Mann,
seconded by George Walter and unanimously carried, to approve a variance of 3’ from the
required 18’ maximum height of a non-dwelling structure for the construction of a 54’ by 72’ pole
building with 12’ side walls, a 4/12 pitch and an overall height of 2T. It was noted that the
structure will be approximately 700’ from the ordinary high water level and that the structure
does not obstruct the view of the adjacent properties.
Melvin Smith - Approved
Melvin Smith, Motley, MN, requested a variance of approximately 25’ from the required ordinary
high water level setback of 100’ for the construction of a 30’ by 50’ dwelling located
approximately 75’ from the ordinary high water level. The property is described as part of
Government Lot 4, Section 23 of Leaf Lake Township by East Leaf Lake. The audience was
polled with no one speaking for or against the request. John Macal, Realtor, and Tracy and
Chris Mitchell appeared along with the applicant at the pubic hearing. After discussion and
consideration, motion was made by Randall Mann, seconded by John Everts and unanimously
carried to approve a variance of 25’ from the required ordinary high water level setback of 100’
for the construction of a 30’ by 50’ dwelling located 75’ from the ordinary high water level. It was
noted that the granting of this variance will not establish a precedence for this immediate area
and that there are properties to the west of the applicant’s property that have structures closer
to the ordinary high water level than what is being proposed by the applicant. It was also noted
that placing the structure in this location would not obstruct the vision of the adjacent properties.
Hardship is a very substandard lot of record with a very limited amount of depth.
Stephanie Kaminski represented the next four applicants at this public hearing.

rather than the required 100'.

After discussion, motion was made by Tom Stringer,
Elizabeth Auqhenbaugh, Battle Lake, MN, requesting permission to place a privacy
fence 6' high on Lot 10, Inglewood, Everts Township, requested postponement of
hearing. A letter from Phyllis M,' Davis expressed approval, Leonard Hackstein, present,
speaking in opposition. No action taken.
Gerald R. Schulte, Dalton, MN, requested permission to construct garage 54' front
center line of township road, 5' from property line, on Lot 114, Sater-Humphrey Ranch
Camp, Tumuli-Township. After discussion, motion was made by Craig Anderson to deny
application as presented, but approve a 19' variance with garage doors to be set at
right angles from road, hardship being substandard lot. The motion was seconded by
Frank Lachowitzer and carried.
D. H. Richter, Wadena, MN, requested permission to split a small acreage of less
than 2\ acres, wi.thout platting and without a registered land survey, from the E^s
SW^a of Section ll.CCompton Township. After discussion; motion was made by George
Walter, seconded by Frank Lachowitzer, to approve, but failed with Frank Lachowitzer,
John Everts, Tom Stringer and Craig Anderson voting "no". Motion was made by Tom
Stringer, seconded by John Everts and carried, to deny for failure to show adequate
hardship.
Elmer A. Boedigheimer, Minneapolis, MN, requested permission to construct garage 3'
from east property line on tract between lot and lake and Lot 2, Belka Beach, Sec
tion 26, Gorman Township,Motion was made by Craig Anderson, seconded by Frank
Lachowitzer and carried, to grant approval , harcHiip being a substandard lot.
Henry Bjorqo, Underwood, MN, requested permission to place a 12' x 50' mobile home
50' from ordinary high water mark, on S.L. 3 of G.L. 5, Section 35, Maine Township.
After consideration and after listening to interested parties, motion was made by
John Everts to grant approval , because of a unique situation with other variances
having been granted and the fact that the county road cut off a portion of said
property leaving no otherplace on lot for home, subject to structure being placaion
same grade as driveway, with a variance approval of 140'.
