The property is described as Lot 12, Nirvana Resort, Stuart Lake in Nidaros Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Robert Schwartz and unanimously carried, to deny the variance as requested as other reasonable alternatives exist for the placement of a 10’ by 12' storage shed on the applicant’s property that will not require a variance. Scott V. and Judy K. Zenner - Approved Scott V. and Judy K. Zenner, Fergus Falls, MN, requested a variance of 75’ from the required ordinary high water level setback of 200’ on the West side and a variance of 60’ from the required ordinary high water level setback of 200’ on the South side for the construction of an addition to an existing dwelling 125’ from the ordinary high water level on the West side and 140’ from the ordinary high water level on the South Side. It was noted that this is the best location for an addition to the existing dwelling. The garage will be 40’ 6" from the center of the road. The property is described as the West 75’ of the East 150’ of the West 550’ of Government Lot 4 South of Road, Section 25 of Gorman Township by Little Pine Lake. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Craig Anderson, seconded by George Walter and unanimously carried, to approve a variance of 3’ 6” from the required lot line setback of 10’ and a variance of 12’ 6" from the required road right-of-way setback of 20’ for the placement of a 22’ by 36’ garage 6’ 6” from the side lot line and 7’ 6” from the road right-of-way as depicted on the applicant’s revised drawing. It was noted that the proposed garage will be 6’ 6” from the lot line at the lakeside of the lot and 10’ from the lot line at the roadside of the lot. Hardship is the biased lot lines. Letters from Pat and Sherri Denne and Don Hopper in favor of the applicant’s request were read for the record. A letter from the Elizabeth Town Board granting permission to place a sewer line under the township road and for a lift station partially in the township road right-of-way was read for the record. After discussion and consideration, motion was made by George Walter seconded by John Everts and unanimously carried, to approve the construction of a dwelling 47’ from the ordinary high water level on the east corner and 39’ from the ordinary high water level on the west corner with the following conditions: 1) the dwelling must be at least 20’ from the road right-of-way, 2) the dwelling must be at least 10’ from the side lot lines and 3) no more than 25% of Lot 7, Stenstrom Beach First Addition can be covered with impervious surfaces. It was noted that the granting of this variance would place the new dwelling no closer to the ordinary high water level than the existing structure. After additional consideration, motion was made by Cecil Femling, seconded by George Walter and unanimously carried to deny the subdivision of a 9,563 square foot parcel from an existing 51.13-acre parcel. It was noted that approving the subdivision would have created a parcel requiring variance for the applicant’s proposed plans. Hardship is a substandard lot of record and the granting of the above variance will provide the applicant with a reasonable use of his property. Alan Juds - Approved Alan Juds, St. Paul, MN, requested a variance to install new septic systems 75’ from the lake. The required setback is 150’ from the ordinary high water level. The property is described as Sub Lot 3 of Government Lots 2 and 3, Section 34 of Star Lake Township by Dead Lake. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by John Everts, seconded by Cecil Femling and unanimously carried, to approve a variance to install new septic systems 75’ from the lake. It was noted that the installer indicated that the proposed locations are the best locations available and that he will install the systems as far back as possible and no closer than 75’ to the ordinary high water level. Chad W. Lindholm, ET. AL. - Approved Chad W. Lindholm, Et. Al., Battle Lake, MN, requested a variance “to deed southwest corner of Lot #27 to adjacent parcel located to the south. They in turn, will deed seventy five (75’) feet of shoreline to Lot #27 thereby achieving a more uniform lot line.” A detailed preliminary land survey is available for pubic inspection at the County Auditor’s office. The property is described as Lot 27, Madison Beach and part of Government Lot 1, Section 10 and 15 of Clitherall Township by Clitherall Lake. The applicants were unable to attend the public hearing, but prior to the public hearing had spoken with John Everts who explained the applicant’s request to the other members of the Board. After consideration and discussion, motion was made by Craig Anderson, seconded by George Walter and unanimously carried, to approved the variance as requested noting that the request is a reasonable request and that the granting of the variance will enhance the lake frontage of Lot 27, Madison Beach without negatively affecting the other larger property. The granting of the variance will also square up the lot lines of both lots. j.on Sapp - Tabled Don Sapp, Perham, MN, requested a variance of 5’ 6” from the required lot line setback of 10’ and a variance of 12’ 6” from the required road right-of-way setback of 20’ for the placement of a 24’ by 36’ garage 4’ 6" from the lot line and 7’ 6” from the road right-of-way. The garage will be 40’ 6” from the center of the road. If more than 25% of the total lot area will be covered with impervious surfaces the applicant should consider other alternatives. Gordon Rockswold - Approved Gordon Rockswold, Wayzata, MN, requested a variance of 6’ from the required lot line setback of 10’ for a second story addition and for a 12’ by 14’ addition (sun porch) to an existing cabin 4’ from the lot line. The property is described as Lot 6, Comstock Beach and vacated road adjacent. East Battle Lake in Girard Township. The audience was polled with no one speaking for or against the request. A letter from Ted and Lois Rotenberger in favor of the applicant’s request was read for the record. After consideration and discussion, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve a variance of 6’ from the required lot line setback of 10’ for a second story addition and for a 12’ by 14’ addition (sun porch) to an existing cabin 4’ from the lot line noting that the 12’ by 14’ addition is towards the rear of the cabin away from the lake and noting that the applicant will be removing 6’ of the original structure on the right hand side bringing that side of the structure into compliance with the 10’ setback requirement. Hardship is a narrow lot. Roberta L. Lovell - Approved Roberta L. Lovell, Fargo, ND, requested a variance of 3’ from the required lot line setback of 10’ for an addition to an existing dwelling 7’ from the lot line. The property is described as Lot 23, First Addition to Bowrey Beach, Pelican Lake in Dunn Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by John Everts, seconded by George Walter and unanimously carried, to approve a variance of 3’ from the required lot line setback of 10’ for an addition to an existing dwelling 7’ from the lot line noting that the proposed addition will be no closer to either the lot line or the ordinary high water level than the existing structure and noting that the proposed addition is to the rear of the existing structure. David and Beverly Skyberg - Denied David and Beverly Skyberg, Wahpeton, ND, requested a variance to cover more than 25% of the total lot area with impervious surfaces and a variance of 5’ from the required drainfield setback of 10’ for the location of an existing drainfield 5’ from an existing building/garage. After additional consideration and discussion, motion was made by Cecil Femling, seconded by John Everts and unanimously carried, to deny the applicant’s request to cover more than 25% of his total lot area with impervious surfaces.
