Fergus Falls, MN • 1-800-346-4070 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, August 8, 2002 The Otter Tail County Board of Adjustment met Thursday, August 8, 2002, with the following persons in attendance: Cecil Femling Paul Larson Steve Schierer Pat Eckert, Land and Resource Management Frank Lachowitzer Randall Mann Mark Steuart Call to Order - Randall Mann, Chair, called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - Hearing no corrections or additions the minutes of the August 1, 2002 meeting was approved as mailed. The following variance requests were heard: Wayne M Pieske - Denied. (6:30 p.m.) Wayne M. Pieske, Ottertail, MN, requested a variance of 6" from the required 20' maximum allowable height of a non-dwelling structure for a 40’ by 64’ structure having an overall height of 20’ 6”. The property is described as Lot 4, Block 1, Spanswick Addition, Hanson Lake in Girard Township. Emails from Tom and Patti Baker and from Rita Kettgen in support of the applicant’s request were read for the record. A letter from Dennis J. Poppenhagen in support of the applicant’s request was also read for the record. The audience was polled with Richard Spanswick and Marcella Buirge speaking in support of the variance as requested. After consideration, motion was made by Frank Lachowitzer, second by Paul Larson to approve the variance as requested. The vote on the motion was a tied voted with Randall Mann. Steve Schierer, and Mark Steuart voting no, therefore, the motion to approve failed to pass. (6:45 p.m.) James and Linda Matter, Fergus Falls, MN, requested the following: “We have always wanted to have a 4- season sunroom and have designed one to fit in with the architecture of our house. The sunroom would replace the deck off our main floor family room and the shady, nonfunctional area beneath it. The proposed size of the sunroom is 16’ wide and 14’ 2" deep. The proposed structure would consist of 2 stories, a ground floor basement level and a main floor level. The depth of the existing deck, including the railing, is 12’ 8", but the square footage of the proposed sunroom is significantly less than the existing deck. Our second, much less desirable option would be to build the sunroom with one level supported by stilts like the present deck structure. The distance from the sunroom to the adjacent slope would be 26’ instead of the required 30’, therefore requiring a variance. Even with the addition, our house is set further back than our adjacent neighbors.” The property is described as Lot 8 and the West 80’ of Lot 9, Block 1, Birchwood Riyer Estates, Otter Tail River in Aurdal Township. The Complainant states that the following facts establish PROBABLE CAUSE: Complainant, Tim Griep, is a duly acting and appointed Assistant Administrator for the Department of Land and Resource Management for the County of Otter Tail, Minnesota, who received information regarding the below-described offense. On April 12, 2002, WAYNE PIESKE, hereinafter referred to as the defendant, was issued a Site Permit #19199 to build a 40' x 64' storage structure on his property located at 42834 County Highway #1 in Ottertail, Otter Tail County, Minnesota, and more particularly described as Lot 4, Block 1, Spanswick Addition, Girard Township, within the shoreland management area of Hanson Lake, a natural environment lake. On June 5, 2002, defendant called and stated he had over 20 cubic yards of fill for a driveway and the storage structure. The Site Permit stated that the fill would be within the footprints of the storage structure and that no Grade and Fill Permit or Conditional Use Permit would be needed. On June 14, 2002, defendant submitted a Grade and Fill Permit application for placing 60 cubic yards of fill on the driveway area and around the new structure. On June 20, 2002, defendant viewed the After-the-Fact Grade and Fill Permit application and determined that the amount of fill and areas of fill that were placed would not create any erosion problems, and that the fill request would be added to his Site Permit #19199. At that time, complainant measured the storage structure and determined the building height at 20'6". The maximum height allowed for a structure under the ordinance for a natural environment lake for a non-dwelling is 20 feet. On June 21, 2002, complainant spoke with defendant and explained the height violation. Defendant requested a variance application to appear before the Otter Tail County Board of Adjustment to request a variance from the 20 foot requirement. On August 8, 2002, defendant appeared before the Otter Tail County Board of Adjustment and his variance request was denied. On August 28, 2002, complainant sent a letter to defendant advising that they must bring the structure into compliance by December 1, 2002. As of March 3, 2003, defendant was on-site and observed that the structure was still not in compliance. Site Permit states fill would be within footprint of storage structure and no Grade & Fill Permit or Condition Use Permit would be needed. 06-14-02 - Mr. Pieske submitted a Grade & Fill Permit Application for placing 60 cu. yds. of fill on driveway area and around the new structure. 06-20-02 -1 viewed his After-the-Fact Grade & Fill Permit Application and determined that the amount of fill and areas fill was placed would not create any erosion problems and that we would add the fill to his Site Permit #19199. At that same time, I measured out the storage structure and determined that the building was 20’ 6” in height; maximum height allowed is 20’. 06-21-02 - I spoke with Mr. Pieske and explained to him what I had found regarding the building height. At that time I sent Mr. Pieske a Variance Application along with an Otter Tail County Board of Adjustment Meeting and Application Deadline List. 07-10-02 - Mr. Pieske filed for a Variance with the Board of Adjustment for the August 8, 2002 meeting. 08-8-02 - Mr. Pieske met with the Board of Adjustment and the Variance request was denied. No adequate hardship shown (see application enclosed). 08-09-02 - Copy of Variance Application with motion from hearing on August 8, 2002 mailed to Mr. Pieske. 08-28-02 - I sent a letter to Mr. Pieske giving him until December 1, 2002 to bring the structure into compliance. 03-03-03 - As of this date, Mr. Pieske had not contacted our office. I went onsite to his property and found the structure has not been brought into compliance. If you have any questions, please call our office. I am writing in regard to the request for a variance for Wayne Peiske for a building on his property in the Spanswick Addn to be considered on Thursday, August 8, 2002. As the owner of the property two lots away from Mr. Peiske/Es I strongly support granting the variance to Mr. Peiske. It is my understanding that Mr. Peiske/Es structure is slightly (6 inches) above the zoned limit. However, the structure is substantially back from the lake and does not in any way block the view from my or other nearby property. In addition the building is attractive and compliments the look of the area. Again, I support granting Mr. Peiske/Es variance. My wife Patti and I had hoped to attend, however, I have contacted pneumonia and I am under Doctors orders not to travel yet. My family and I have been property owners in Otter Tail County for 52 years and understand that rules are set to protect our enviorment and neighbors construction activities. My wife and I do not believe that Mr. Pieske had any intention of breaking regulations set forth by your board. I have viewed the building and we are the immediate and adjacent property owners. The building appears to be at least an additional 100 feet set back from the lake as required and would not cause us any inconvience or concern now or in the future. Pieske Adjustment Board Members: As a property owner just 3 lots away from Mr. Pieskes’ building in question, I wish to state that the structure is an attractive addition to the area. It is nestled into the trees well below the tree line, of earth tones in color and has a pleasing aesthetic presence. He has cut the entire lot exposing the new tree plantings and giving the entire area a most pleasing appearance. If in fact the building is 6” too high, only a technician would be able to recognize it and then only with the use of some rather sophisticated electronic measuring devise, certainly it can not be viewed as an excessive height by my simple eye. I would urge this Board to grant a variance immediately and to congratulate Mr. Pieske on the fine new structure and land improvements he has done so far to our new budding neighborhood and to the Otter Tail County tax base.
