Re: Attached Application for Conditional Use Permit.
V, O
My intention is to cut down the hump on the lake side
of the old road and pull it back to fill the eroded
road area to create a more level lawn area between our
house and the lake without chanqinq the water run off
routes. Some steps and terracinq will be done on the
west side of the project, qrass will be planted, and
at least si;-: maple trees will be planted between the
house and the lake.
Last winter I spoke with Bill Kahler at the buildinq site about a
variance brinqinq the house near the crest of the hill overlookinq
the lake.

from the lake with the intention of leveling the front yard bv
pulling the bank back into the road as I explained earlier.

Over the vears, grading of the road has pushed earth up on the bank
overlooking the lake and water coming down the sandy road has eroded
the hill running parallel to the lake. Leveling this area to a point
where terracing occures on the west end will slow the water until it can
fall over the terracing in a controlled manner thus reducing erosion.
Several vears ago, permission was given by your committee to fill in a
gullev between the road and lake at the bottom of the road's hill I just
mentioned.
My current plan vji 11 smooth the appearance of that cut bv reducing the
height of the hill.
In doing so, the bank was cut guite steeply to provide fill.
Before pulling the bank back on the road, a half do2:en or so trees will
be removed.
e;;ami nati on of these scrub oak. trees reveals declininq trees that must
be removed to make room for younger trees anyway.
levelinq of the hill and transplanting new trees is by far the better
choice of action.

Without a reason for denial. I was left onlv to surmize that issues
brouqht up at the meetinq mav have contributed to vour decision.
You heard from Rose Greenwood. Hotherinlaw to both Nikkei son and
Wal1schlaqer, that onlv one foot was oranted to Nikkei son for a cut to
the bank when indeed permission was given to cut 2 to 3 fet^-t plus an
additional foot removed from the old roadbed far a total of FOUF? feet
maKimum cut provided a 6 inch slope away from the lake was msiintained.
Issues raised reqardinq removal of trees, heiaht of mv house, and others
having no bearinq or referrence to vour authoritv I trust had no
influence on vour decision.
The onlv reasonable factor I can ouess which mav have disswaved yoii
from actinq favorablv on my request is the litE^ral i nte>rprf?tat i on
