Doug & Jeff VanderBerq - Tabled to August 10. 2005:
Conditional Use Permit Application {as stated by the Applicant): We are requesting 12” of fill on
our lot in the corner so the water will not be trapped on our lot. We are requesting fill so
the water will flow its’ natural way through the culvert. 12” of fill will be added tapering to 0”
(195 cy). The water from the neighbor runs down and pools on the lawn because the lawn
is lower than the culvert. The lawn is lower than both neighbors. The land and culverts
were designed to drain from one neighbor, across our lawn, to the next neighbor, then to
the wetlands area. The property is described as Sunnyside 5'^ Addition Lot 10, Section 36
of Girard Township; East Battle Lake (56-138), RD.

Merlyn & Kathleen Lokken presented (read) a letter expressing concern regarding surface
water run-off onto their property. Gene Albers expressed concerns regarding drainage &
damage to the Township Road. Dan Voss expressed concerns regarding the area of
proposed fill & proposal for run-off to culverts. Bernard Voss stated that an existing culvert
is already in place, should be located & used.
Motion: A motion by Trites, second by Boyer to table, at the Applicant’s request, to
August 10, 2005 in order to allow grades & elevations to be determined and provide time to
discuss an area drainage plan with the Township. Voting: All Members in favor.
Larry Hilton - Denied:
Conditional Use Permit Application (as stated by the Applicant): Owner would like to fill low
areas from west lot east to wetland 60’ and all the way down point 12’ wide to 6’ wide, 1” in
depth. Rip rap both sides of point removing fallen trees, not stumps, and flopping roots
back down. Fill sand - 300 yds; Rip rap - 140 yds; top soil - 80 yds (to re-grow
vegetation) and blanket with fiber mat for stabilization. The property is described as
Parcels 19 & 20 in GL 4 (5 AC), Section 36 of Girard Township; East Battle Lake (56-138),
RD.

Motion: A motion by Wilson, second by Trites to deny; reasons include the probability of
undelineated wetlands, the proposed rock riprap work does not require County approval,
and that no fill should be placed within the shore impact zone. Voting: All Members in
favor.
Darrell & Margaret Nulph - Denied:
Conditional Use Permit Application (as stated by the Applicant): This project involves an
improvement to the shore area of the lot with a project size of 30' x 20’. The description of
the improvement is that we would like to create a sand area along the shore. Currently the
shore is a mixture of rock, dirt and grasses that is slowly eroding at a rate of about 2-4
inches per year. We would like to lay down some landscaping fabric, place rip rap along
the shore and then cover the entire area with about 8” of sand. This area of 30’ x 20’
would also be contained by a perimeter of 6” x 8” x 12” landscaping block topped with a 2”
cap block. The proposed improvement area would not require any excavating and would
only require that sand be placed on top the existing terrain. There also would not be any
modifications to the shore line except the removal of the existing rock to place the fabric
down. The rock would then be replaced and finally covered with sand that would extend
down to the water. The maximum depth of fill will be no greater than 12” with a total of no
more than 30 cubic yards. The property is described as Lot 23 Crystal Beach, Section 24
of Clitherall Township: Clitherall Lake (56-238), RD.

6:30 P.M. in the Commissioner's Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present: Jim Amo, Rod Boyer, Ken Erickson, Les Estes, Joe Maske, Bert Olson,
Robert Schwartz, David Trites, Rick Wilson and Leona Zimmerman.
Members Absent: None.
Michelle Eldien represented the County Attorney's Office and Tim Griep represented the
Land & Resource Management Office.
Minutes of July 20, 2005: A motion by Erickson, second by Wilson to approve as
presented. Voting: All Members in favor.

onsite: stating they have altered a natural resource and that this project would damage her
property. Merlin Lokken read (& presented for the file) a letter regarding an existing
easement (on the VanderBerg property) for the Lokken’s sewer line.
Motion (regarding a portion of the Application): A motion by Erickson, second by Boyer
to approve up to 10 yards of fill for the lakeside fill request, must stay 4” to 6” below the
existing ice ridge. Voting: All Members in favor, except Zimmerman.
Motion - Failed: A motion by Amo, second by Erickson to approve: 1. The fill in the yard
as presented, (not allowing the installation of the tile in the yard), must taper the fill. 2.
The minimum diameter of the pipe under the road must be 8”. 3. The driveway maybe
widened 5' starting at the road for 20’, then from this point the driveway must taper to 2’ for
the remainder of the distance. Voting Yes: Amo & Olson. Voting No: Boyer, Erickson,
Estes, Maske, Schwartz, Tiifes, Wilson & Zimmerman.

“Little McDonald North Shore Estates First Addition” / Mark R. & Barbara
Lenius/Dennis Haopel - Denied:
A Preliminary Plat titled "Little McDonald North Shore Estates First Addition" consisting of
14 Lots, 4 Blocks for Single Family Residential Use and a Conditional Use Permit
Application (as stated by the Applicant): Construct approximately 1490 feet of road and 2 cul-
de-sacs to county standards. Only a portion of cul-de-sac at west end of property is
located within Shoreland Management. The property is described as R NE1/4 & pt GL 2
& NE1/4 ex trs & Lots 1 & 2 ex platted ex trs. Section 3 of Edna Township; Little McDonald
Lake (56-328), GD.
Mark & Barb Lenius, Robert lllg & Dan Skinner (Moore Engineering) represented the Application.
Kathy Kratze (President, Little McDonald Lake Association) requested an Environment
Assessment Worksheet (EAW). Bruce Westman questioned the scope of the entire project
(how many additions will be proposed?). Ardell Wiegandt presented a petition requesting
an EAW & expressed concerns regarding the water mn-off, & the topography (buildability
of the lots). David Covington expressed concerns regarding congestion and traffic on Little
McDonald Lake Drive, future development, and run-off. Terry Marthaler read & presented
(for the file) a letter, questioning the long-term use. Tim Neitzke expressed concerns
regarding traffic (safety), sediment/nutrients and requested an Environmental Impact
Study. Carol Hanna expressed concerns regarding run-off and stated that the road is a 5
ton road. Fred Bauck indicated that the nutrients that are entering the lake need to be
addressed and that an EAW would be nice. Paul Grinnell expressed concerns regarding
traffic (safety) and stated that if the plan is approved, someone will get injured. Mike
Haman expressed concerns regarding the run-of and traffic.
Motion: A motion by Trites, second by Schwartz to deny due to the lack of adequate
information that addresses surface water run-off, nutrient loads, and safety issues with
traffic. Voting; All Members in favor.
Otter Tail County Highway Department - Approved With An Extension:
A Conditional Use Permit Application (as stated by the Applicant): Repair erosion damages to
CSAH No. 12 by placing granular borrow, fabric and riprap per plan and cross sections (on
file with Land & Resource Mgt.). The property is described as County State Aid Highway
(CSAH No. 12), Section 4 of St. Olaf Township; Johnson Lake (56-393), NE.
Charles Grotte represented the Application.
Motion: A motion by Boyer, second by Maske to approve as presented, may extend the
project to October 1, 2005. Voting: All Members in favor.
“Almora Shores” - Secluded Land Company. LLC - Denied:
A Preliminary Plat of "Almora Shores” consisting of 9 Lots, 1 Block for Single Family
Residential Use. The property is described as Lot 1 (24.05 AC), Section 35 of Elmo
Township; Lake Almora (56-49), GD.
Brad Nyberg (surveyor) and Mike Pfister (Secluded Land Co.) represented the Application.
Lon Saude expressed concerns regarding the size of the lake, it is too small to be
classified as a General Development Lake and recommended denial or tabling so the lake

Motion by Lee, second by Nelson, and unanimously carried approve Final Payment payable
to Shultz Torgerson Architects, in the amount of $1,669.89, for services relative to the 505 S.
Court Building Project.
Recess & Reconvene
At 10:35 a.m.. Chairman Block declared the meeting of the Otter Tail County Board of
Commissioners recessed for a short break. The meeting was reconvened at 10:42 a.m.
Ditch No. 38
Ditch Inspector, Randy Wasvick, reported that Bob Sonnenberg has property on Branch 1 of
Ditch No. 38. After the County cleaned out Ditch 38, he no longer had access to twelve acres
of his property. Mr. Sonnenberg is requesting to install a 54” culvert to gain access. Under
the County road is a 36” culvert, so the water would be flowing from smaller to larger culvert;
however, Mr. Sonnenberg’s property would be the only affected property. By installing a
larger culvert, there will be fewer problems with beaver plugging it. Mr. Wasvick also
requested an annual assessment on Ditch 38 because of the need to trap beaver. Motion by
Nelson, second by Lee, and unanimously carried to allow installation of a 54” culvert in Ditch
No. 38 on Bob Sonnenberg’s property to gain access to twelve acres of his land.
Shoreland Rules Revision Internal Committee Update
Land & Resource Director, Bill Kalar, briefed the Board on the Shoreland Rules Revision
Internal Committee meeting held on August 3, 2005. Discussion took place regarding types
of open space, conversion of existing single owner resorts to multiple owners “Exclusive Use
Resorts, and establishment of a Grandfather Date(s). The next meeting is scheduled on
Thursday, August 18, 2005.
Conditional Use Permit Extension Request
Motion by Lee, second by Mosher, and unanimously carried to approve a 30-day extension
for Conditional Use Permit #6196, Tollefson Trust, to October 1, 2005, to complete the
project.
Final Plat Filing Extension Request
Motion by Lee, second by Froemming, and unanimously carried to approve a 90-day
extension for filing the Final Plat of “The Palms of Lida” on Lake Lide (56-747) because of
issues with road construction, as requested by Meadowland Surveying, Inc.

Verlin Lokken expressed concerns regarding run-off onto their property and an existing

Planning Commission Recommendations
Conditional Use Permit - Doug & Jeff VanderBera:
Land & Resource Director, Bill Kalar, stated that this CUP request is a grade and fill project
on East Battle Lake. The Planning Commission recommended approval of the revised plan
dated October 25, 2005. The floor was opened for public comment. Neighbor Verlin Lokken
expressed concern regarding the effluent line that runs across the property to the south in
relationship to the proposed location of the house and garage. Attorney for the Applicants,
Robert Russell, stated that the applicants are aware of the effluent line and they have been
advised that if they damage the line, they would be liable. He stated that they know the
location and would avoid damage. Kathleen Lokken expressed concern regarding the
location of the sewer system. Mr. Russell stated that his clients are aware of the limitations
and the septic system would need to be filed by a licensed septic installer and would require
a permit. Discussion continued. Motion by Froemming, second by Nelson, and carried with
Lee opposed, to approve a Conditional Use Permit for the revised plan received on October
25, 2005, with conditions as recommended by the Planning Commission. The property is
described as Sunnyside 5'*^ Addition Lot 10, Section 36 of Girard Township; East Battle Lake
(56-138).
