Motion by Mosher, second by Lee, and unanimously carried to approve a Conditional Use
Permit to replace and expand a cabin as presented. The property is described as Pt of GL 3,
Septfon 2 of Everts Township; Otter Tail Lake (56-242), GD.
Conditional Use Permit - Melva Jean Nvbera Trust:
Motion by Froemming, second by Lee, and unanimously carried to deny a Conditional Use
Permit, as recommended by the Planning Commission, to construct a driveway. The reasons
for the denial are as documented in the September 20, 2006, Planning Commission minutes.
The property is described as Lots 4 & 5 Block 1 Sunnyside 5"’Addition, Section 36 of Girard
Township: East Battle Lake (56-138), RD.
Conditional Use Permit - Hobart Township:
Motion by Nelson, second by Lee, and unanimously carried to approve a Conditional Use
Permit to regrade and widen existing Hobart Township Road with a condition as
recommended by the Planning Commission. The property is described as Scalp Trail
between Dusty Trail and East Lake Seven Road, Section 7 of Hobart Township: Scalp Lake
(56-358), RD.
Conditional Use Permit - “Treasured Bay Resort’/Lester & Kristine Kellogg and James
Development Inc:
Mr. Kalar stated that the Planning Commission is recommending approval with conditions for
this resort to a Common Interest Community conversion. He stated that since the Planning
Commission meeting, a letter was received from Douglas Grouws, property owner on the
east boundary, and he read the letter for the record. Mr. Kalar stated that the requests in
Mr. Grouws’ letter will be met. Motion by Nelson, second by Lee, and unaninnously carried to

Woodland Beach Resort Assoc. LLC - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant): Replace Cabin #6 in its same
. location, size of existing Cabin #6 was 18’ W x 20’ D. Also requesting an addition of 10’ x
20’ which was previously requested by Conditional Use Permit #6151; finished structure
will be 28’ x 20’. The property is described as Pt of GL 3, Section 2 of Everts Township;
Otter Tail Lake (56-242), GD.
Brett Hopponen and Myron & Casey Schockert represented the Application.
Motion: A motion by Estes, second by Maske to approve as presented. Voting: All
Members in favor.
elva Jean Nvberq Trust - Denied:
A Conditional Use Permit Application (as stated by the Applicant): Construct approx. 500 linear
ft. of driveway from Chippewa Road to the west ending at a point approx. 140 ft. from the
shoreline. This project will impact 3700 s.f. of wetlands which will be replaced at a 2:1
ratio. Proposed Wetland Replacement will be over 1000 ft. from shoreline. Total driveway
fill approx. 555 cu. yds.. The property is described as Lots 4 & 5 Biock 1 Sunnyside 5‘^
Addition, Section 36 of Girard Township; East Battle Lake (56-138), RD.
Milt Paulson, Melva Jean Nyberg and John Christensen represented the Application.
Marvin Anderson expressed concerns regarding drainage (flooding) onto his property, and
the fish the area. Gene Albers (East Battle Lake Watershed Association) expressed
concerns regarding watershed, a road that was proposed at the time of the development of
the lots, and he stated that they are opposed to the request.
Motion: A motion by Estes, second by Schwartz, to deny, reasons being: 1. Compatibility

evaluations based on soils, topography and vegetation. 3. Suitability of the area for the
proposed use. Voting: All Members in favor, except Zimmerman abstained.
Hobart Township - Approved With A Condition:
A Conditional Use Permit Application (as stated by the Applicant): Regrade and widen existing
Hobart Township Road “Scalp Trail” from Dusty Trail to East Lake Seven Road within
existing platted dedicated public road corridor (see proposed plan & profile on file with
Land & Resource Management Office). The project will involve approximately 5000 cu.
yds of excavation. Work to be completed this fall. The property is described as Scalp
Trail between Dusty Trail and East Lake Seven Road, Section 7 of Hobart Township; Scalp
Lake (56-358), RD.

Dear Sirs,
Recently I have received a notice of an application by the Melva Jean Nyberg Trust. I
have some concerns regarding the construction of a driveway in an established wetland
that she is requesting. They are as follows:
1. Why do they need, or want a driveway established that would involve filling of a
wetland to provide better access to marginal land? The accessed high ground is a
very narrow strip of land between the lake shore and the open water of the
wetland in question. Certainly this frontage could not be sold to anyone for a
build able lot.
2. This wetland area is one of very few still in existence on East Battle Lake. It acts
as a natural filter for all the run off water that drains into the lake from the
surrounding acreages. It is a haven for wildlife, including loon, bald eagles,
beavers, many varieties of birds and other small animals. When is enough,
enough?? Nearly every lineal foot of lakeshore on East Battle has been plotted,
filled or built on. All of Chippewa Island has been plotted and sold over the years
by the same people requesting this permit. Many of the lots were granted
variances that allowed buildings in questionable locations.
3. If other acres of wetland were established elsewhere, they would not offer the
same protection to the lake as the present wetland does.
4. Drainage! Several lots on both sides of the property in question are quite low in
elevation. Any change in elevation of this middle property would certainly cause
problems for neighboring owners by forcing water to be diverted or backed up
onto their properties.
5. If you look at this property now, don’t be fooled by the water levels and amount
of high groxmd you see. Since June of this year I believe the lake level is down
14”. I’m sure this wetland area reflects the drought as well.
6. Please do the math; look at some past aerial photos, see how marginal this site is
and recognize the value of this and all wetlands. Make the right decision by
denying this permit.

We are really concerned on this application, and Me wondering if the commission has
completely studied this request. The driveway is just the beginning of what is going to
happen, and more permits are going to be needed when it comes to building.
You have a perfect spot as it is. The wetlands are a necessity for the lay of the land, and
if you choose to fill it in, this is going to affect all of the property owners for drainage. I
don’t know how much you have studied this, but I think you should revisit the whole
problem.
We are against the approval of this conditional use permit for many reasons. One it’s not
going to stop here, as you are going to be asked to make further commitments down the
line. Two, I don’t think you have looked at the wetlands in regards to how fill this in will
effect other property owners for drainage. Three, if other acres of wetlands were
established elsewhere, they would not offer the same protection to the lake as the present
wetland does. Four, if look at this property now don’t be fooled by the water levels and
amount of high ground you see, the lake is down this year quite abit.
As you can see we are hoping you make the right decision and deny this permit.

Dear Sir,
The proposed construction of approximately 500 linear feet of driveway is innocent
enough at first glance. However, the Planning Commission should want to discover the
dominant, motivating &ctor to do so.
The driveway as proposed does not address a useful purpose. The lots that the
driveway would service should probably be studied in detail thru an Environmental
impact statement, including soil borings for potential fiiture development. Natural
drainage fi'om a large surrounding area is cleansed by these wetlands and drain thru these
lots into East Battle Lake.
We are against the approval of this conditional use permit as we are concerned that it
will allow fiiture pressure on the Planning Commission to consider the sale of the
properties as buildable lots. The Shore land Management has many rules to consido' in
the potential land use that approval of the conditional use permit, as applied for, will
allow. The driveway serves little purpose unless the larger picture is consido'ed and
many variances will have to be appli^ for.

1.0 Introduction
WCEC was contracted on June 23, 2005, to delineate and flag wetland boundaries and
generate a wetland delineation report for the Nyberg property located in T133N, R39W,
Sec 36. The property comprises two lots within the southeast quarter of the section
mentioned above as shown in Figure 1.
2.0 Wetland Determination/Delineation Methodology
Wetlands present within the above referenced area were identified and delineated using
the procedures described in the Army Corps of Engineers (ACOE) Manual for
Identifying and Delineating Wetlands, 1987 edition. This is the preferred method of
wetland delineation stated in the Minnesota Wetland Conservation Act which applies to
all wetlands, except those identified on the DNR Protected Waters and Wetlands
Inventory. This method utilizes the standard multi-parameter approach (vegetation,
hydrology and soils) for wetland identification as outlined in the Corps of Engineers Data
Forms. In general, an area is considered a wetland if the Hydrophytic Vegetation,
Wetland Hydrology and Hydric Soils are present. The definition and methodology for
each of the three parameters are outlined below:
Hydrophytic Vegetation
Definition: The prevalence (>50%) of dominant plant species that are adapted
to life in saturated soil conditions.
Method:

To determine whether vegetation was hydrophytic, the dominant
plant species were identified in each data form where WCEC has
cited the common name and wetland indicator status. Dominance
refers strictly to the spatial extent of a species that is directly

discernible in the field. The most abundant plant species that
immediately exceeds 50 percent of the total dominance for a given
stratum, plus any additional species comprising 20 percent or more
of the total, are considered dominant species for that stratum. In
cases where 50% or more of all dominant species were
hydrophytic, this wetland parameter was satisfied.
Wetland Hydrology,
Definition: Inundated or saturated to the surface for a minimum of 5% (in
consecutive days) of the growing season.
Method; Wetland hydrology was determined by observing the presence
and/or absence of primary or secondary hydrology indicators in
each sampling location. If any one of the primary indicators or
two of the secondary indicators were identified, the wetland
hydrology parameter was met. Please note that the hydrology
indicators are listed in descending order of reliability.
Hydric Soils
Definition: Soils that are saturated long enough during the growing season to
develop anaerobic conditions in the upper part (!')•
Method; Soils from each sample location were characterized with the
Munsell Soil Color Charts used to determine soil chroma, mottle
color and gleying color (when present) to determine reducing
conditions indicative of hydric soils. WCEC also compared soil
taxonomy with the Minnesota Hydric Soils List as well as
examined the soils for any of the Hydric Soil Indicators listed in
the data forms. If one or more of the hydric indicators on the data
forms were identified, the soil was considered hydric. Please note
the hydric soil indicators are listed on the data forms in descending
order of reliability.
Resources referenced in identifying and delineating wetland boundaries included the
USGS 7.5 minute topographic base maps. Farm Service Administration aerial
photographs, USDA soil surveys, ,U.S. Fish and Wildlife Service National Wetland
Inventory (NWI), and the DNR Protected Waters and Wetlands map (Appendix B).
WCEC’s wetland delineation followed the ACOE procedure for identifying wetland
boundaries by completing the appropriate number of transects, investigating the required
wetland criteria, and identifying the boundary between the wetland and upland. A soil
sampling auger was used to check the soils and hydrology at periodic intervals
throughout the delineated boundary to confirm accuracy and/or adjust the boundary
accordingly. The boundary was flagged with fluorescent wetland delineation tape or wire
flags at close intervals to accommodate efficient inspection by the Local Governing Unit
(LGU) and land survey crew.

To confirm delineation accuracy, WCEC completed one transect consisting of at least
two sampling points (Figure 2). Information collected for each transect was placed on
the Army Corps of Engineers (ACOE) Data Forms for Routine Determination (Appendix
A).
WCEC attempts to coordinate delineation plans with the Otter Tail County LGU
responsible for Wetland Conservation Act enforcement. The Otter Tail County Land and
Resource Management staff was unable to meet WCEC staff on-site on June 28, 2005 to
discuss wetland boundaries in the field and give preliminary approval of the delineated
wetland boundaries due to time constraints. Otter Tail County Land and Resource
Management staff will inspect the flagged wetland boundaries as time allows.
3.0 Wetland Assessment Results/Conclusions
The subject property comprises two lots of the southeast quarter of the section mentioned
above. The property land use/land Cover is primarily wetlands in the topographic lows
with forested lakeshore (Figure 2). In WCEC’s professional opinion, one area was
identified that meets the wetland criteria defined in the Army Corps of Engineers
(ACOE) 1987 Manual. The wetland area identified covers a majority of the land area of
the two lots. This wetland is part of a large wetland system which drains to this property
through a culvert under the road on the east property boundary. The subject wetland is a
Type 3 (Inland shallow fresh marsh) basin and is classified on the National Wetlands
Inventory Map as: Palustrine Emergent Seasonally Flooded/Palustrine Forested Broad-
Leaved Deciduous Seasonally Hooded (PEMC/PFOIC, see NWI map in appendix B,
Figure 6). The wetland becomes cha:nnelized on the west end of the property and flows
into East Battle Lake. The wetland area was extended along the lake shore to the north
and south (Figure 2). The southwest section of the property appears to be fill which has
subsided over time and has become saturated. Portions of this wetland area may exist
within the Ordinary High Water Mark (OHW) of East Battle Lake. The OHW data for
East Battle Lake was not known at the time of delineation. The OHW will most likely be
determined during the land survey of the property. East Battle Lake is identified on the
DNR Protected Wasters and Wetlands Inventory (See DNR map in Appendix B, Figure
7)-
One transect was completed and confirmed accuracy as reflected on data forms
(Appendix A). The soil pits for transect L, plots 1 and 2 were completed in what was
observed to be Palustrine Emergent wetland. The soil pit for transect 1, plot 3 was
completed approximately 10 feet upland of transect plot 2 and was observed to lack
wetland characteristics (Appendix A). The wetland boundary was observed between
transect plots 2 and 3 using a mud auger and flagged accordingly (Figure 2).
Runoff and drainage of upland areas and lake littoral zone influence appears to be the
primary source of hydrology for the wetland areas. Boundaries of all wetland areas were
marked accordingly with flagging at close intervals to accommodate field inspection by

the Otter Tail County Land and Resource Management staff and the subsequent
surveying crew. A copy of this report will be submitted to Otter Tail County LGU, Kyle
Westergard, for final approval.

west and 1,300 feet north of the southeast corner of
sec. 13, T. 133 N., R. 42 W.
Ap—0 to 7 inches; very dark gray (10YR 3/1) loam,
dark grayish brown (10YR 4/2) dry; weak meidium
subangular blocky structure; friable; common fine
roots; about 2 percent gravel; neutral; abrupt
smooth boundary.
Bt—7 to 16 inches; brown (10YR 4/3) sandy clay loarr
weak medium prismatic structure parting to weak
fine subangular blocky; friable; common fine roots;
common faint very dark grayish brown (1OYR 3/2)
clay films on faces of peds; many distinct light
brownish gray (10YR 6/2) sand and silt coatings
on faces of peds in the upper part; about 2 percer
gravel; slightly acid; gradual wavy boundary.
Btk—16 to 19 inches; brown (10YR 5/3) sandy loam;
weak medium prismatic structure parting to weak
fine subangular blocky; friable; few fine roots;
common distinct very dark grayish brown (10YR
3/2) clay films on faces of peds; common light gra
(1 OYR 7/2) carbonate coatings on ped interiors;
about 3 percent gravel; strongly effervescent;
moderately alkaline; clear wavy boundary.
Bk—19 to 27 inches; light yellowish brown (1 OYR 6/4)
sandy loam; weak medium platy structure; friabie;
few fine roots; common fine light gray (10YR 7/2)
carbonate coatinigs on feces of peds and in pores:
about 5 percent gravel; strongly effervescent;
moderately alkaline; gradual wavy boundary. ■
C—27 to 60 inches; yellowish brown (1 OYR 5/4) sand
loam; weak medium platy soil fragments; friable;
few fine distinct yellowish brown (1 OYR 5/6) relict
Fe concentrations; about 4 percent gravel; slightly
effervescent; slightly alkaline.
