Planning Commission Recommendations
Conditional Use Permit - Wee Villa LTD Partnership:
Motion by Erickson, second by Mosher, and unanimously carried to approve a Conditional Use Permit
for modifications to various mobile homes at the resort as presented. The property is described as
Lot 4 ex trs (36.15 AC), Section 14 of Elizabeth Township; Long Lake (56-784), RD.
Conditional Use Permit - James & Victoria Trites:
Motion by Froemming, second by Mosher, and unanimously carried to approve a Conditional Use
Permit for earthmoving with conditions as recommended by the Planning Commission. The property
is described as Lot 6 Kimber Shores, Section 21 of Girard Township: West Battle Lake (56-239), GD.
Conditional Use Permit - Sunset Beach Resort/Scott & Cathy Olson:
Motion by Froemming, second by Block, and unanimously carried to approve a Conditional Use
Permit to convert the existing owners’ home to a rental unit and remove some camping units as
presented. The property is described as Sunset Heights Lots 1 - 6 & Lot 8 and pt SL A of GL 1,
(13.14 AC), Section 28 of Girard Township; West Battle Lake (56-239), GD.
Conditional Use Permit - Rodney & Linda Schmidt:
Motion by Erickson, second by Froemming, and unanimously carried to approve a Conditional Use
Permit for a driveway relocation with conditions as recommended by the Planning Commission. The
property is described as Pt of GL1 lying S of Hwy 22 & W of Hwy 43, ex SLY 405’, Section 15 of
Friberg Township; Heilberger Lake (56-695), RD.
Conditional Use Permit - Dead Lake Township:
Motion by Nelson, second by Mosher, and unanimously carried to approve a Conditional Use Permit
to reconstruct 385'*^ St. beginning at its intersection with County Rd 44 and extending East with
conditions as recommended by the Planning Commission. The project is located on 385^^ St. & Lot
4, Pt GL 5 lying SELY of Hwy 44, NE1/4 SW1/4 and SE1/4 NW1/4, Section 10 of Dead Lake
Township: Tamarack Lake (56-320), NE.
Conditional Use Permit - Hagen’s Point/Allen Chase:
Motion by Mosher, second by Erickson, and unanimously carried to deny a Conditional Use Permit to
expand the resort for the reasons cited in the October 8, 2008 Planning Commission minutes. The
property is described as All that pt of GL’s 8 & 9, Section 6 of Sverdrup Township: Pleasant Lake
(56-449), RD.
County Wide Zoning Discussion
Land & Resource Director, Bill Kalar, opened discussion regarding County Wide Zoning. Eagle Lake
Township Officer, David Broud, discussed the challenges of Eagle Lake’s enactment of an Interim
Ordinance. Mr. Kalar talked about the wide variety of regulatory agencies relative to water quality and
the variety of land uses. Mr. Kalar stated that the first thing the County needs to do is to map out the
current land uses in the County. The GIS Department could assist in the mapping. Commissioners
requested that Mr. Kalar proceed with mapping the current uses in Eagle Lake Township and around
Dead Lake to use them as samples of what can be done throughout the County. Mr. Broud will ask
townships, over the winter, to document what they want relative to zoning. Mr. Kalar provided a
document from the Minnesota DNR entitled “Shoreland Rules Update Project”.

Victoria & James Trites and John Christensen represented the Application.
Terry Eikren reiterated that this is precedent setting and their request was denied several
years ago. Ken Kappes expressed concerns regarding drainage and the Township Road.
Motion: A motion by Schwartz, second by Gill, to approve as presented, provided: 1. The
maximum depth of cut be 2.5’ at the easterly end. 2. Land & Resource Management
approves the stabilization plan prior to starting the project. 3, The project must not be
started until spring 2009. Reason being the drainage should go towards the road. Voting
Yes: Erickson, Gill, Olson, Schwartz, & Wilson. Voting No: Boyer, Maske, & Zimmerman.
Sunset Beach Resort / Scott & Cathy Olson - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant): Convert existing owners
home to a rental unit. Currently 59 rental units & 1 residence, propose 60 rental units total.
The property is described as Sunset Heights Lots 1 - 6 & Lot 8 and pt SL A of GL 1, (13.14
AC), Section 28 of Girard Township; West Battle Lake (56-239), GD.
Scott & Cathy Olson represented the Application.
Motion: A motion by Wilson, second by Schwartz, to approve as presented. Reason
being it is an improvement, by moving structures away from the lake. Voting: All members
in favor.
Break: At 7:50 P.M., the Commission took an 8 minute break.
Rodney & Linda Schmidt - Approved With Conditions:
A Conditional Use Permit Application (as staled by the Applicant): To change the access for an
easement for ingress and egress purposes that is shared by the Schmidts and Elaine
Solee so that it comes off of County Hwy 22 instead of County Hwy 43. By doing so the
prospective buyers of the Schmidt property (Robert & Julie Budke) can eliminate the
existing portion of the easement that crosses the parcel in a north/south direction. Otter
Tail Co. Hwy. Dept, has approved approach request. The property is described as Pt of
GL1 lying S of Hwy 22 & W of Hwy 43, ex SLY 405', Section 15 of Friberg Township;
Heilberger Lake (56-695), RD.
Robert Budke represented the Application.
Motion: A motion by Wilson, second by Erickson, to approve provided; 1. Appropriate
permits are received from the County Highway Department. 2. Land & Resource
approves the erosion control plan prior to starting the project. 3. The project must not be
started until spring 2009. Voting: All members in favor.
Dead Lake Township - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant): Reconstruct 385"' St.
beginning at its intersection with Co Rd 44 and extending East. Intersection geometry will
be improved to address sight distance and drainage concerns. An approach permit will be
obtained from the Otter Tail County Highway Department. Temporary and permanent
erosion and sediment control measures will be utilized and included in an MPCA
Stormwater Permit. Up to 2,000 cy of excavation will take place within 1,000 feet of
Tamarack Lake. The project is located on 385"' St. & Lot 4, Pt GL 5 lying SELY of Hwy 44,
NE1/4 SW1/4 and SE1/4 NW1/4, Section 10 of Dead Lake Township; Tamarack Lake (56-
320), NE.

Meeting of the Otter Tail County Planning Commission was held on October 8, 2008 at
6;30 P.M. in the Commissioner's Room, Government Services Center, Fergus Falls, Minnesota.
Roll Call:
Members Present: Rod Boyer, Ken Erickson, Marion Gill, Joe Maske, Bert Olson, Robert
Schwartz, David Trites, Rick Wilson, and Leona Zimmerman.
Member Absent: Les Estes and David Trites.
David Hauser represented the County Attorney's Office and Bill Kalar represented the Land
& Resource Management Office.
Minutes of September 17, 2008: A motion by Wilson, second by Gill to approve as
presented. Voting: All members in favor.
Wee Villa LTD Partnership - Approved As Presented:
A Conditional Use Permit Application (as stated by the Applicant): #51 - Install 12 x 56 roof,
5/12 roof pitch w/1 foot overhang. #54 - Install 12 x 65 roof, 5/12 roof pitch w/1 foot
overhang. # 8 - Replace existing 11 x 31 trailer with 14 x 48. #78 - Install 12 x 46 roof,
5/12 roof pitch with 1 foot overhang. The property is described as Lot 4 ex trs (36.15 AC),
Section 14 of Elizabeth Township; Long Lake (56-784), RD.

James & Victoria Trites - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): Request to excavate bank to
allow partial exposure of basement and windows. The area to be cut is 29’ x 33’ with a
depth of 2.5 feet on the east side of the cut and tapers to 0 feet on the west side (88.6
yards of earthmoving). South basement windows will be partially welled. East side of bank
cut will be retained with a block wall. Would like to do the work this fall (Fall 2008). The
