MortensonFrom: Subject: Douglas Treadwater Variance Application I discussed the above application for a variance from the $500 after-the-fact permit fee with Wally Senyk. Mr. Senyk indicated that the variance request was not properly before the Board of Adjustment for several reasons. -* Firstly, the $500 after-the-fact permit fee was the result of a Resolution passed by the Otter Tail County Commissioners. Minnesota Chapter Section 394.23 provides that the County Board shall have the power and authority to prepare and adopt a comprehensive plan. In this case, the plan includes an after- the-fact permit fee in the sum of $500. The amount of the fee is an issue outside of the scope of the Board of Adjustment's authority. Secondly, the amount of the after-the-fact permit fee is not an issue that relates to a hardship or an exceptional circumstance that involves the use of the property. Economic considerations alone shall not constitute a hardship if a reasonable use of the property exists under the terms of the ordinance. Absent a basis under the ordinance to grant a variance from the fee schedule established by the County Board, the Board of Adjustment is without authority to rule on this issue.
