It was noted that the granting of the variance request will not establish a precedent for the area, will allow the applicants to use the most reasonable location for the construction of the dwelling and will require no additional variances for the placement of the dwelling at this location. Our adjoining neighbor to the North, Arthur Mohn - Lot 13, has no dwelling. Building "in-line" would allow us to be at the same approximate setback as many other North Point Beach neighbors further to the North and South. Views of the lake would be seriously impeded by having most of Clifford's home in front of our proposed dwelling. Our lot is approximately 15,000+ sq. ft. which does not allow for much flexibility in construction if we are required to use the designated setback. We would be required to move the septic tank and remove at least one mature tree in order to build a house. Following the designated setback would likely eliminate the future addition of a drain field in connection with the septic tank as there would not be room between the house and road right-of-way. Movement of the garage/cabin might also be necessary as it would block views to the North from the proposed house. Lastly, if you have visited Lot 14, and looked at the various lots and homes on either side, you will see that we are not asking for any more in fairness than our neighbors have received throughout the years. Lot 15 existing home, and a string test from the Osman home on Lot 12 to the Clifford home on Lot 15. Other setbacks are also noted. Attachment 2 of 4. 1990 drawing submitted to Land and Resource Management by Richard Osman showing Lots 12 -15 and sight line test used and approved for his building permit. Our proposed 17 feet variance would actually still be behind this line. Our garage/cabin is incorrectly placed on this drawing and the approximate location of our proposed home and present garage/cabin have been added with dotted lines. Attachment 3 of 4. Approved application for 1972 building permit for James Clifford on Lot 15. On reverse side of application is notation by an official of Shoreland Management that the proposed dwelling is 73-75 feet from high water mark. 17 feet is a great discrepancy between 1972 and 1995.
