Motion was made by Cecil Femling, second by Mark Steuart and unanimously carried, to deny the variance as requested and to support the variance as previously approved on Thursday, September 9, 1999. Williams, Clitherall, MN, requested a variance to add an 18’ by 20' living room on an existing cabin situated on a substandard size lot, within 100' of the ordinary high water level. A variance to modify/enlarge second living structure on point. The proposed addition will be approximately 42’ from the shoreline. The property is described as Parcels 17, 18, 19 and 20 of Government Lot 8, Section 3 of Nidaros Township by Stuart Lake. Philip Williams appeared along with the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by David Holmgren, second by Steve Schierer and unanimously carried, to approve the proposed 18' by 20’ addition being no closer than 50’ from the ordinary high water level and being at least 10’ from the lot line. Hardship is a substandard lot of record and having water on two side of the property. It was also noted, by the Land and Resource Department, that this is not a second dwelling and that the applicant does have two separate lots. Andy and Linda Crowe - Denied as requested/Support variance as approved on September 9, 1999. Andy and Linda Crowe, Edina, MN, requested the following: a variance was granted September 9, 1999, which allowed a 37.5’ setback from the ordinary high water level and a 15’ setback from the road right-of-way. A recent survey indicated that if the approved setbacks were met the resulting building width would be 12.5’. The applicant’s are requesting that the previously approved road right-of-way setback of 15’ be reduced to whatever necessary to accommodate a 14’ by 70’ structure (Approximately 10 to 13.5’). The property is described as Lot 37, Fair Oaks, West Battle Lake in Girard Township. The audience was polled with Duane Olson and Jim Adamietz, Girard Town Board Members, stating for the record that the township would not be responsible for any damage to the septic system and/or structures that may occur during road maintenance or snow removal. After consideration, motion was made by Cecil Femling, second by Mark Steuart and unanimously carried, to deny the variance as requested and to support the variance as previously approved on Thursday, September 9, 1999. Phyllis Shirley - Denied. Phyllis Shirley, Rothsay, MN, requested a variance of 6’ from the required side lot line setback of 10’, a variance of 16’ from the required road right-of-way setback of 20’, and a variance of 10’ from the required holding tank setback of 10’ for the placement of a combination bath/storage building 4’ from the lot line, 4’ from the road right-of-way and over the existing holding tank. Tim Rinke represented the applicant at the public hearing. The property is described as Lot 13, Forsgren’s Beach First Addition, Lake Lida in Lida Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, second by Cecil Femling and unanimously carried, to deny the variance as requested noting the following: the proposed location presents a concern for future maintenance of the holding tank, presents a health safety issue and another alternatives does exist on the south side of the lot that will not require the granting of any variances. James C. and Janet E. Kapitan - Approved with modification. James C. and Janet E. Kapitan, Fargo, ND, requested a variance of 7’ from the required lot line setback of 10', a variance of 10’ from the required mound absorption area setback of 10’ and a variance of 15’ from the required wetland setback of 50’ for the placement of a septic tank approximately 3’ from the lot line and for the placement of the mound absorption area 0’ from the lot line and 35’ from the wetland. The property is described as Sub Lot 2 of Government Lot 3, Section 13 of Elizabeth Township by Jewett Lake. Mitch Okerstrom appeared along with the applicants at the public hearing.
