It should be noted that the west front corner of the garage will be 12’ from the road right-of-way and the east front corner of the garage will be 3’ from the road right of way. The|property is described as Lot 33, Fair Oaks, West Battle Lake in Girard Township. Michael Smith and the applicant’s contractor appeared along with the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Mark Steuart, second by Ste^e Schierer and unanimously carried, to deny the variance as requested as no adequate hardship had been sho^n and expressing concerns for the safety of the applicant and the public should the variance be granted as proposed. The property is described as Lot 1, Pulford Beach Addition, Walker Lake in Amor Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by David Holmgren, second by Steve Schierer and unanimously carried, to approve a variance of 76’ from the required ordinary high water level setback of 100’ for a 12’ by 18’ addition to the main level of an existing home and for an 18’ by 24’ second story addition 24’ from the ordinary high water level. It was noted that the proposed development would be no closer to the ordinary high water level than the existing structure. Hardship is a substandard lot or record. Donald and Ellen Nelson, Pelican Rapids, MN, requested a variance of 27’ from the required ordinary high water level setback of 75’ for the construction of a 6’ by 6’ addition to an existing dwelling being approximately 48’ from the ordinary high water level. After discussion and consideration, motion was made by Steve Schierer, second by David Holmgren and unanimously carried, to approve a variance of 27’ from the required ordinary high water level setback of 75’ for the construction of a 6’ by 6’ addition to an existing dwelling 48’ from the ordinary high water level with the condition that no more than 25% of the total lot area can be covered with imperious surface after the completion of the applicants’ proposed development. It was noted that the proposed development is to the rear of the structure, is hidden from the lake and will not obstruct the view from the adjacent properties. Jon Lundby - Denied Jon Lundby, Dent, MN, requested a variance of approximately 20 to 25’ from the required ordinary high water level setback of 100’ for the construction of a 28’ by 36’ garage 75 to 80’ from the ordinary high water level. The property is described as Lots 7 and 8, Block 1, Walida Heights, Big McDonald Lake in Edna Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by Mark Steuart and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested and a reasonable use of the applicant’s property can be obtained without the granting of a variance. It was also noted that an alternative site does exist which would not require a variance for the proposed development.
