Linda Crowe - Approved
Motion was made by John Everts, second by David Holmgren and carried with Randall Mann voting no, to approve a
variance of 19’ from the required ordinary high water level setback of 75’ for the placement of a structure 56’ from the
ordinary high water level, which would place the proposed structure in line with the closest point of the structure on the
lot to the west as shown on the applicant’s drawing. Hardship is a substandard lot of record. The approval of this
request will provide the applicant with the ability to enjoy the same rights and privileges as other in his immediate area.
It was also noted that no precedence would be established by the granting of this variance request and that all other
setback requirements are being met. The applicant’s representative was also informed that this variance in and of it
self does not guarantee that the lot will be buildable because of water, fill and drainage issues that will need to be
addressed before a site permit would be issued. It was noted that these issues might require that the applicant or the
applicant representative obtain other permits in addition to the site permit.

Linda Crowe - Approved
Linda Crowe, Edina, MN, requested a variance of 19’ from the required ordinary high water level
setback of 75' for an ordinary high water level structure setback of 56’. The property is described as
Lot 23, Fair Oaks, West Battle Lake in Girard Township. Paul Orndorff represented the applicant at the
public hearing. A letter from Marvin L Rapp expressing concerns with the applicant’s request was read
for the record. The audience was polled with Dennis Christenson and Tim Matz expressing concerns
with how the lot will be developed given the terrain and topography features of the property. After
consideration, motion was made by John Everts, second by David Holmgren and carried with Randall
Mann voting no, to approve a variance of 19’ from the required ordinary high water level setback of 75’
for the placement of a structure 56’ from the ordinary high water level, which would place the proposed

Timothy M. and Jeannie A. Teiken - Denied
Timothy M. and Jeannine A. Teiken, Frazee, MN, requested a variance to enclose an existing 8’ by 24’
deck. The existing deck contains an existing 4’ by 8’ by 8’ water accessory structure, which is built on
top of the existing 8’ by 24’ deck. The property is described as Lot 1, Sky Blue Water Beach, Lake Six
in Hobart Township. A letter from Rollie Canhan in favor of the applicant’s request was read for the
record. The audience was polled with no one speaking for or against the request. After consideration,
motion was made by Randall Mann, second by John Everts and unanimously carried, to deny the
variance as requested as no adequate hardship had been shown unique to the property that would
allow for the granting of the requested variance.
Sheldon Hein - Denied
Sheldon Hein, Battle Lake, MN, requested a variance of 2’ from the 18’ maximum height of a non
dwelling structure for the construction of a utility building having an overall height of 20’. The property
is described as the East 295.5’ of the West 345.15’ of the North 295.5’ of the South 320.15’ of
Government Lot 1, Section 29 of Amor Township by Otter Tail Lake. The audience was polled with Hub
Hovland speaking against the applicant’s variance request. Letters from Amy Ebersviller, Glen and
Pam Davis and Debra L. Dickinson opposing the requested variance were read for the record. The
general condition of the applicant’s property and the intended use were the main concerns expressed in
the verbal and written communications received by the board. After consideration, motion was made
by Cecil Femling, second by David Holmgren and unanimously carried, to deny the variance as
requested as no adequate hardship unique to the property had been shown that would allow the
granting of the variance as requested. It should be noted that the applicant indicated that the intended
purpose of the proposed structure was for the expansion of his business. Since the purpose of the
proposed structure is for the expansion of an existing business, within the shoreland area, the
applicant’s proposed building project may also fall within the authority of the conditional use application
process.
