The applicant is proposing the expansion of her existing structure with the closest addition located approximately 2' from the side lot line. The property is described as the West One-Half of Lot 8, Segar Beach, Otter Tail Lake in Everts Township. The audience was polled with Merle Burshiem and Richard Less speaking against the applicant’s variance request and with Jennifer (Fire Number 838) speaking in favor of the applicant’s variance request. After consideration and discussion, motion was made by Cecil Femling, seconded by Craig Anderson and unanimously carried to approve building within 4’ of the lot line, once the lot line is determined, and to permit a second story addition being no closer to the ordinary high water level than the existing structure with the condition that no more than 25% of the total lot area will be covered with impervious surfaces/materials. It was noted that this is a very substandard lot and that the granting of this variance will provide the applicant with reasonable use of her property by allowing for a single car garage. Ronald and Sally Tobkin • Approved Ronald and Sally Tobkin, Perham, MN, requested a variance of approximately 50’ from the required ordinary high water level setback of 100’ for the placement of a dwelling approximately 50’ from the ordinary high water level. The property is described as part of Government Lot 2, Section 14 of Edna Township by Paul Lake. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by George Walter, seconded by Randall Mann and unanimously carried, to approve a variance of 35’ from the required ordinary high water level setback of 100’ for the placement of a dwelling 65’ from the ordinary high water level. It was noted that the granting of this variance would not obstruct the vision of either neighbor. Hardship is the pre-existing building line. Dale Andrew Berger - Denied Dale Andrew Berger, Battle Lake, MN, requested a variance of approximately 6’ from the required road right-of-way setback of 20’ for a 12’ by 12’ addition to an existing utility/storage shed located approximately 14’ from the road right-of-way. The properly is described as Lot 17, North Point Beach, West Battle Lake in Girard Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Randall Mann, seconded by Cecil Femling and carried with John Everts abstaining, to deny the variance as requested as no adequate hardship had been shown and the granting of the variance would establish a precedence. Timothy Lang - Approved/Denied Timothy Lang. Ham Lake, MN, requested a variance of approximately 55’ from the required ordinary high water level setback of 75’ for an existing deck, which was repaired and replaced, for an addition to the cabin over the deck and for a second story addition to the cabin located approximately 20’ from the ordinary high water level. The property is described as Lot 1, Fair Oaks, West Battle Lake in Girard Township. The audience was polled with Paul Krister, a neighbor from across the lake, speaking in favor of the applicant’s request. After discussion and consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve the location of the deck as previously repaired and replaced noting public safety as the reason for granting the variance for the deck.
