I am requesting a couple of variances to construct my new home since it will also be partially in the bluff impact zone. The current home sits 65’ from the ordinary high water level. I would like a variance of 30’ that will allow me to move the new house back 10’ to 75’ from the ordinary high water level and east 32’ into an existing altered bluff from 1951. A majority of the new construction will actually be 80’ from the ordinary high water except the area containing the porch. This southwest corner of the house will be even with the string test and the south east corner will be 5’ behind the string test. We also need a variance to replace the west side retaining wall and to construct a new east side retaining wall. The west wall will extend from the southwest corner of the house 26’ west, south 20’ and west again 9’. This wall will be 3’ tall and is 60’ from the ordinary high water level. The east wall will extend from the southeast corner of the house and extend 27’ south. This wall will be 8’ tall on the north end and go down to zero to match the slope of the bluff and is 60’ from the ordinary high water level. We are looking to build an addition to our existing cabin to add a garage and some additional living space. We are not looking to build something that would take us to the maximum impervious surface allowed. The impervious surface ratio on our lot with the proposed building, including the requested variances, is 16.4%, well below the 25% maximum. Because the lot is a peninsula, the 75 foot water setback is on both sides of the lot, causing a hardship to build due to the very limited and oddly shaped building footprint. Our plans have stayed within the allowable footprint in all but a few spots, where the shape of the buildable area makes that especially challenging. One requested variance is a fairly small, triangle shaped section of the garage that falls within the 20 foot setback from the roadway. Since the roadway ends at our driveway, the likelihood of road expansion into the easement would seem very remote. Another variance request is a small triangle shaped section of an entry porch. The variance would be within the 10 foot side setback. We spoke to our neighbor on that side and he has no objections. A signed note from him is attached. Our final variance request is a very small corner of a room that extends slightly into the 75 foot water setback. This room already has a significant angular shape to conform to the water setback. This small variance would allow us to make the angle a bit less severe, making the room far more usable. Our lot is a very special property. We have worked hard to work within the buildable footprint and found we face a real hardship due to the unique character of our lot. It is our hope that you will agree we are working within the spirit of the existing regulations and that the variances we seek are modest in scope, still protect the lake and do not infringe on our neighbors. Property Address-22836 Ferncliff Lane. 1 Re: Hearing on Nov 3^** in regards to Douglas and Karen Brewer Lot 8 South Point West ^ Battle Lake OffOttertail County Board of Adjustments Dear Mr Stein, I am opposed to the variances that are being suggested for the property located at Lot 8 South Point West Battle Lake owned by the Brewers for the following reasons: 1. The garage variance of 6’ impacts the road right of way for any future improvements and or utilities needed for the area. It also sets the way for others to request a variance for additions to their properties closer to the road and thereby makes the 20’ existing setback rule meaningless. What kind of driveway are they proposing for the new garage structure and will this impact the Impervious coverage issues if they intend to drive or park and compact the soil on the driveway surface??? 2. Porch Steps into the side set back: Again, just the same as above, 1 do not feel that a building structure should be allowed into any setbacks. The setbacks parameters are designated to allow adequate space between the properties (10’ for each property) and should not be impacted by building structures being built into the setback area, regardless if it is only a porch step. The fact that it is a porch step implies that it is a part of the building and therefore is permanent and not just a step!! 3. Building into the ordinary high water level area: These high water levels have been determined over time based on actual results of water levels, and if the variance is allowed that would imply that there is flexibility in this ruling (or any ruling) that exists today in terms of how far forward towards the water a structure can exist as well as the concept that the high water line is not relevant to building structures. I appreciate your efforts to date to maintain a consistent standard for all to follow and do not agree that it is time to relax those rules and regulations especially when the water quality and cleanliness of our natural resources for runoff etc is at risk as a natural resource. As a side question, I am wondering if the proposed additions, if granted, impact the 25% Impervious surface regulations as well?? This was not mentioned in the Variance Notice we received. Both Marcy and I regret that we will not be at that meeting, and wish to convey our thoughts in this missive. The Brewers are requesting a variance on the roadway easement, a variance on the lot line, and a small variance on the ordinary high water setback. We find absolutely no problem with any of these actions, for the road is a dead end, and none of the actions requested would hamper access or egress to our home.
