Verle Marsh, Rosholt, SD and Nadene Lenx, Wahpeton, ND, requested a variance of approximately 50 to 56’ from the required 100’ structure setback from the ordinary high water level for the replacement of an existing single story 30’ 6” by 26' 3” structure, with a 1 V2 story 32’ by 60’ structure with an elevation of approximately 28’ and being approximately 44 to 50’ from the east shoreline, a variance of approximately 6’ from the requiredIO’ setback from the road right-of-way to install a septic tank/lift station 4’ from the road right-of-way and a variance of approximately 12% from the required 25% of a lot to be covered by impervious material to construct the proposed structure that covers approximately 37% of Lot 12. The property is described as Lot 12, Cedar Park Club, Swan Lake in Dane Prairie Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, second by Robert Schwartz and unanimously carried, to approve the following as it relates to Lot 12, Cedar Park Club: 1. side lot line setbacks of 10’ will be maintained, 2. the ordinary high water level setback will be either at the string line or 50’, whichever is the most restrictive, 3. the septic tank/lift station can be place 4’ from the road right-of-way, 4. the existing shed must be placed 6’ from the side lot line and 12’ from the west (back) lot line before any permits can be issued, and 5. no more than 25% of the total lot area can be covered with impervious surfaces. Hardship is a substandard lot of record. It was noted that the variances as granted will improve an existing substandard situation and will provide the applicants with a reasonable use of their property. Upon returning to the office and reviewing your file, I could not locate a Site Permit for this structure. Could you send us your Site Permit number so we can resolve this matter? Also, it appears that your deck, on your dwelling, may be too close to your property line. Please contact our office on or before January 31, 2003 regarding these issues.
