DATED: July 9, 2020 Board of Adjustment Chair The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must bear a rough proportionality to the impact created by the variance. (Mitigating impervious surface with storm water management, deep rooted vegetative buffers, rain gardens, etc.) It is the Board of Adjustment's job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an infrequent remedy where an ordinance imposes a unique and substantial burden. Thomas & Sandra Pearce - Variance Application Approved (7:48 p.m.) Thomas & Sandra Pearce, Lot 46 of Broadwater Beach, Pelican Lake (56-786), Dunn Township request the following: We are requesting a variance to add to our existing deck the new addition to deck will be 5’ from property line and no closer to the lake than existing. This w ill allow us to utilize deck better creating safer access and better traffic flow. With this request we are proposing to remove another portion of the deck and a portion of our existing sidewalk this will bring our impervious surface which is currently at 40.25% down to 38.71%. Thomas & Sandra Pearce, property owners represented the variance application. The audience was polled with no one speaking for or against the variance application. After consideration and discussion, Terr>' Marthaler made a motion, seconded by Michael Donoho and carried by roll call vote to approve the variance as requested to do a 30” addition to the existing deck being 5’ from the NE lotline and to approve the impervious surface reduction to 38.71% w ith the removal of a portion of the deck and sidewalk.
