Margaret and John Wall - Approved the variance application as requested with conditions. (6:45 p.m.)
After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve a
variance of 22’ from the required ordinary high water level setback of 75’ for the placement of a dwelling 53’ from the ordinary high
water level with the condition that no more than 25% of the total eligible lot area can be covered with impervious surfaces and with
the condition that the proposed floating deck can be no closer to the ordinary high water level than the existing deck. It was also
noted that the proposed development is within the string line.

OTTER TAIL COUNTY BOARD OF ADJUSTMENT
Thursday, November 5, 2009
The Otter Tail County Board of Adjustment met Thursday, November 5, 2009, with the following persons in
attendance:

Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the October 1, 2009 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Dennis and Connie Loecken - Approved the variance application as requested with a condition. (6:32 p.m.)
Dennis and Connie Loecken, part of Government Lot 2, Section 34 of Star Lake Township by Dead Lake, requested a
variance of 34’ from the required ordinary high water level setback of 200’ for the placement of dwelling with a walkout
basement 166’ from the ordinary high water level. The audience was polled with no one speaking for or against the
variance as requested. After consideration and discussion, Steve Schierer made a motion, second by Michael Harris
and unanimously carried, to approve a variance of 34’ from the required ordinary high water level setback of 200’ for
the placement of a dwelling with a walkout basement 166’ from the ordinary high water level as depicted on the
drawing dated August 22, 2009 and with the condition that before a site permit can be issued for the proposed
development the structures marked on the drawing to be removed must be removed and the structure labeled “Fish
Cleaning House’’ must be either removed or placed in a location meeting the setback requirements of the ordinance.
Hardship/practical difficulty is the terrain of the applicants’ property. The Board noted that the proposed location is
perhaps the best location for the proposed development.
Rogne Family Lake Property LLLP - Approved the variance application as requested. (6:40 p.m.)
Rogne Family Lake Property LLLP, Lot 5 Meyer Addition, West McDonald Lake in Dora Township, requested a
variance of 12’ from the required ordinary high water level setback of 100’ for the placement of an addition to the back
side of the existing dwelling 88’ from the ordinary high water level. Robert Bigwood, Attorney appeared with and
represented the applicants at the public hearing. The audience was polled with no one speaking for or against the
variance as requested. After consideration and discussion, Paul Larson made a motion, second by Thomas Lee and
unanimously carried, to approve a variance of 12' from the required ordinary high water level setback of 100’ for the
placement of a 16’ by 26’ addition to the back side of the existing dwelling 88’ from the ordinary high water level. It
was noted that the proposed development is to the rear of the existing structure, is no closer to the ordinary high
water level than other structures in this immediate area and the Board’s approval of the variance request is consistent
with past actions of the board. It was also noted that this is an after the fact variance request which apparently
resulted from the applicants receiving misinformation from the file.

Margaret and John Wall, Lot 6 Mrugala’s Beach, West Battle Lake in Girard Township, requested a variance of 22’
from the required ordinary high water level setback of 75’ for the placement of a dwelling 53’ from the ordinary high
water level. The audience was polled with no one speaking for or against the variance as requested. Letters from
Johanna Love and Don and Diana Magnuson in support of the variance as requested were read for the record. A
petition signed by 18 individuals in support of the variance as requested was read for the record. After consideration
and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve a
variance of 22’ from the required ordinary high water level setback of 75’ for the placement of a dwelling 53' from the
ordinary high water level with the condition that no more than 25% of the total eligible lot area can be covered with

level than the existing deck. It was also noted that the proposed development is within the string line.
