Board of Adjustment 2 -October 7, 1982
ymouth, MN, tabled from September 2nd, requested permission to
construct dwelling on a 110 foot lot on part of Lot 7, 2nd Add'n to Sunnyside, Girard
Township. Motion was made by Tom Stringer to deny for lack of information. The mo
tion was seconded by Craig Anderson and carried. After Mr. Peyerl appeared later
in the course of the meeting, motion was made by Craig Anderson, seconded by Tom
Stringer and carried, to reconsider. After listening to various interested parties,
either in person or by letter, motion was made by Craig Anderson, seconded by Tom
Stringer and carried, to grant permission to build on lot, as considerable hardship
if not able to build as requested, should be able to enjoy the rights and privileges
as others in the area; however must meet all other set-back, sanitary, etc., require
ments. John Everts voted "no".
New business:
Leland Latham, Wetmore, KS, requests permission to place holding tank 50* from lake,
5‘ 1 roin lot line, 3* from house, on East 1/2 of Lot 5, Block 3, Crystal Lida Beaches,
Lida Township. After consideration, motion was made by Tom Stringer to deny for
failure to show adequate hardship, with an alternative of moving well and holding
tank to other locations. The motion was seconded by Frank Lachowitzer and carried.
M.if'i'ircl C. Johnson, Pelican Rapids, MN, requests permission to place drainfield 95
lo'-t. from a shallow well, or as an alternative to place drainfield eight feet into
lida Street, on Lot 20, Block 1, Cr^ystal Lida Beaches, Lida Township. Ms. Johnson
was representated by attorney Steve Rufer. Attorney Charles Krekelberg appeared re
presenting opposition to said variance. Because Tom Stringer is affiliated with the
same firm as Krekelberg, Stringer requested to "sit out" the Johnson case. After
considerable discussion, motion was made by John Everts to deny for the following
iCMbons: 1) No authority to approve a sewer system under a dedicated street; 2)
Iha minimum distance of 10* cannot be met on the property line, 3) Most importantly,
v.c- have not, and cannot, second guess the State Health Department by compromising the
sanitary codes placing drain fields too close Lo wells or a lake, 4) It is apparent

s'.illing a holding tank to comply with the ordinance as the neighbors have done,
llif motion was seconded by Craig Anderson and upon roll call vote, John Everts and
Craig Anderson voted "yes", George Walter and Frank Lachowitzer voted "no". Motion
failed with Tom Stringer abstaining. Attorney Rufer requested withdrawal of request
of the 95' from a shallow well.

Board of Adjustment - 3 -September 2, 1982
Henry J. & Delores f. Smith, Wahpeton, NL), request permission to construct 14' x
22' boathouse approximately 8' from ordinary high water mark, on Lots 7 & 8, Trade-
wells Woodlands, Sverdrup Township. After discussion, motion was made by John
Everts to deny approval as no adequate hardship shown, granting would establish a
precedence for boathouses Oii this lake. The motion was seconded by Frank Lacho-
witzer and carried,
Uonald Graham, Battle Lake, MN, requests permission to build a 20' x 32' addition

to Corner Store, Section 32, Amor Township. After discussion, motion was made by
John Everts to approve variance, contingent upon wishes of Amor Township Board,
provided the construction would be no further east than the existing building.
Ronald M. Davies, Battle Lake, MN, requests permission to construct new home on
site of old structure, 100 feet from nearest lakeshore point, on a parcel in G.L.
3, Section 35, Maine Township, AFter discussion, motion was made by Craig Anderson,
to approve variance, hardship being best use of property, new construction would
enliance entire area, no precedence being set as a structure is already in said
location. The motion was seconded by John Everts and carried with Frank Lacho-
wil/er abstaining.
Gerald W. Peyerl , PlymoutI), MN, requests permission to construct dwelling 100 feet
from lake rather than the required 150', on Lot 7, ex. 21', 2nd Add'n to Sunnyside,
Girard Township. After listening to various interested parties, motion was made by
Craig Anderson to tabie, The motion was seconded by Tom Stringer and carried.
Donald G. Devitt, Frazee, MN, requests permission to construct 30'x 40' house
sixty feet from high water mark, on Lot 1, Block 3, Lenius Beach, Edna Township.
Alter polling the audience, motion was made by Tom Stringer to table for lack
of information. The motion was seconded by Craig Anderson and carried.
Don Yeager, Lilydale, MN, requests permission to split a 1.75 acre parcel into
two lots, in G.L. 5, Section 22, Saint Olaf Township, being tabled from a previous
meeting. AFter discussion, motion was made by Craig Anderson to grant approval

feet, as shown on the surveyor's drawing. The motion was seconded by John Everts
and carried.

I Cannot be present at the above hearing. Please record my
•bjection to Otter Tail County allowing the above land to be sold
or transferred to Gerald Wayne Peyerl and a dwelling constructed
in vielation of the existing Shoreland Management Ordinance.
It seems to me that much thought and effort must have gone
into creating the ordinance and to indiscriminately allow a gross
vielatlon would defeat the whole purpose of the law. I understand
the lot is just 89 feet wide and has np egress to the i^ad.
