Gerald D. and Anita J. Galloway, Dickinson, ND, requested a variance of 130' from the
required ordinary high water level setback of 200' and a variance of 30' from the required
shore impact zone setback of 100' for the construction of a 24' by 30' structure 70' from
the ordinary high water level. The property is described as Lot 9 and East 172 of Lot 10,
North Shore, Dead Lake in Star Lake Township. The audience was polled with no one
speaking for or against the request. After consideration, motion was made by John Everts,
seconded by Randall Mann and unanimously carried, to allow construction of either a 24' by
3&' structure or a 24' by 30' structure by applying the string line from the original
structure on the Edwin Anderson property to the nearest point of the trailer located on
the Kurt Anderson property,

allow the applicants a reasonable use of their property and they will be no closer to the
ordinary high water level than the neighbors on either side.

3' from the drain field. The property is described as Lot 13 and West 10' of Lot 14,
Sanda's Beach, East Battle Lake in Girard Township. Roger Beals represented the applicant
at the hearing. The audience was polled with no one speaking for or against the request.
Letters from Paul and Patty Winkler, Rosella Marquardt and Barbara Dockweiler in favor of
the variance request were read for the record. After consideration, motion was made by
Craig Anderson, seconded by John Everts and unanimously carried, to approve a variance of
3.5' from the required side lot line setback of 10' and a variance of 7' from the required
drain field setback of 10' for the placement of a 24' by 38' garage 6.5' from the side lot
line, 3' from the drain field and 5' closer to the lake than the existing structure . It
was noted that the new structure will be setback farther from the road right-of-way than

Scott Baumler - Approved
Scott Baumler, C/0 Angelique Rae Rausch, Burnsville, MN, requested a variance of
approximately 55' from the required ordinary high water level setback of 75' and a
variance of approximately 17.5' from the required shore impact zone setback of 37.5' for
the construction of a 24' by 32' addition to an existing cottage approximately 20' from
the ordinary high water level. The property is described as part of Government Lots 1, 2,
and 3, Section 1 of Edna Township on Devils Lake (Also known as Lots 84 and 85, Nedberg -
Nye Surv. Lots). Ray Baumler represented the applicant at the hearing. The audience was
polled with no one speaking for or against the request. After consideration, motion was
made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve a
variance of approximately 55' from the required ordinary high water level setback of 75'
and a variance of approximately 17.5' from the required shore impact zone setback of 37.5'
for the construction of a 24' by 32' addition to an existing cottage approximately 20'
from the ordinary high water level with the condition that the existing storage sheds must
be placed in locations that comply significantly more with the requirements of the
ordinance. Hardship being a substandard lot of record.
