Residoits- would have been notified and would have attended the meeting. .The building is positioned on the comer of Lot 1, at the only entrance to Sanda’s Addition. We are told that it is the required distance (20 feet) from the dead-end road which ser­ vices the 41 occupied lake lots on Sanda’s Beach, and that it is the re­ quired distance from the lot line wliich borders on the public access road to East Battle Lake. The lame building obstructs the view of me lake from the recreational lots across the beach road. It also blocks die public access road from view wlien one drives out of the beach when, at the end of July, before the controversial building was com- ileted, a large sim advertising Mr. "oore’s electricm business was put in place. Commissioner (Hub) Nor- dgren referred the matter to the county attorney — the building was again declared “legal,” but Mr. Toore was notified that he must im­ mediately aroly for an “after the fact” conditional use permit. Residents received notification of the Sept. 2 meeting of the planning commission and planned to attend.The majority of the owners on Sanda’s beach are summer people ' from outside this area, who leave bythe end of August, ^ore leavin|. area.Residents felt that a building of this size, with its key location, war­ ranted consultation with the proper- ^ owners before the permit was i^ued. Complaints were registered with officials, but placement on the lot was considered “legal” and the permit had already been issued. Property owners on both sides of the public access were incensed and on the advice of the Land Use of fice, fiiese residents prepared a peti­ tion (44 signatures) and wrote let­ ters expressing their opposition to a business at this location. As one of the few year-round residents, I was asked to represent the absent pro­ perty owners, and reluctantly agreed to present the petition and at­ tend the planning commission meeting. It seemed logical that the “after the fact” application would be denied, but it was approved with mese modifications; no advertising signs, the building is to be used to house his vehicles, no electrical ^uipment in the yard and reviewal in two years. It was referred to the commissioners for approval. At the commissioners’ meeting on Sept. 10, Commissioner Nordgren r^uested that the planning commis­sion’s recommendations he referred to the Girard Town Board for con­ sideration. The town board, at its problem and approved the planning tions withcommission recommendations the following modifications: no retail sales at the location, and reviewal in one year. Our thanks to Commissioner Nordgren for his sup­ port and his vote against approval of a business at this location. This lake area has always been a recreational, residential, resort area. Our concern is that a business established here could set a prece­ dent for others to follow. Lakes and tourism are important parts of Otter Tail County's resources and economy, and should be protected. Malcolm Lee, Land & Resource Management, appeared before the Board and reported on the Superfund Amendments and Reauthorization Act (SARA), with the Emergency Planning and Community Right-to-Know Act and its possible impact on state and local governments, stating one of the requirements placed on local governments is to submit to Local Emergency Planning Committees by October 17, 1988, plans which incorporate the Title III (emergency planning) requirements. Lee was instructed to attend additional seminars offered. Joe Egge, representing the tourism department in the State of Minnesota, alppeared before the Board supporting Minnesota Heartland urging the county to appropriate the sum of 5(t per capita, or $2,748.50 for Heartland promotional activities. Olson and unanimously carried, to appropriate the sum of $1,000 for Minnesota Heartland for the year 1988, requesting the association make their request prior to the setting of the budget for the next year of 1989. As soon as that exchange has completed the necessary switching operation, the 911 System will be operative. There were 15 people in attendance from the Sanda Beach area expressing their views. AT this meeting there was a motion by one supervisor to approve the Special Use Permit/ but no second. There was a motion from one supervisor to deny the Special Use Permit/ no second. Then there was a motion to refer this problem back to the Board of County Commissioners for their action since the application began with the Planning Commission. This motion was seconded and carried. I am enclosing a copy of the letter from the Planning Commission and the Notice of Hearing for Special Use Permit. The area is entirely conposed of lake homes and cabins. There are no ccsnmercial businesses present other than one resort. It is entirely out of context with the area to allow a commercial business such as this to be established. It also sets a precedent which could completely change the area if other residents are allowed to start similiar commercial ventures on their property. In addition, it would sean that Mr. Moore has little regard for this application process as he has already erected a sign advertising his business. To do this before a pemit is granted seems to be an outright rejection of the zoning laws of our county and the rights of the neighboring residents. In fact, that is a key reason why we purchased property in that area four years ago. It is rather ironic we have recently been told by Ottertail Authorities, all lakeshore residents must upgrade sewer and water systems (already we have invested ’$5,000) now we find we may be making these additional investments in what could become a hodge-podge of businesses and their related congestion. The proposed commercial endeavor by Mr. Moore is at the entry and only access to approximately 25 shoreline permanent and summer homes on Sandas Beach. We are concerned about the possible congestion that could result from equipment, supplies, vehicles on the property and usual business traffic that would alter the present residential pattern, and eventually create safety problems for children and grandchildren. During the construction period of what residents then believed was a large garage on the Moore property, we already witnessed the congestion that took place on the property and near the roadway. We are sure those patterns will not improve once a business is established in that present residential zone. We cannot see how a lake location could be beneficial to an electrical business other than as a tax write-off for Mr. Moore. It seems only logical with the number of vacant commercial establish­ ments along your county highways and in the communities of Henning, Battle Lake and Clitheral, there should be ample in higher business traffic areas in already commercial zones that could house an electrical business.
