comer of Lot 1, at the only entrance
to Sanda’s Addition. We are told that
it is the required distance (20 feet) from the dead-end road which ser
vices the 41 occupied lake lots on
Sanda’s Beach, and that it is the re
quired distance from the lot line
wliich borders on the public access road to East Battle Lake. The lame
building obstructs the view of me
lake from the recreational lots
across the beach road. It also blocks die public access road from view
wlien one drives out of the beach
when, at the end of July, before the
controversial building was com-
ileted, a large sim advertising Mr.

in place. Commissioner (Hub) Nor-
dgren referred the matter to the
county attorney — the building was
again declared “legal,” but Mr. Toore was notified that he must im
mediately aroly for an “after the
fact” conditional use permit.

the Sept. 2 meeting of the planning
commission and planned to attend.The majority of the owners on
Sanda’s beach are summer people
' from outside this area, who leave bythe end of August, ^ore leavin|.

this size, with its key location, war
ranted consultation with the proper- ^ owners before the permit was
i^ued. Complaints were registered
with officials, but placement on the
lot was considered “legal” and the
permit had already been issued.
Property owners on both sides of
the public access were incensed
and on the advice of the Land Use of
fice, fiiese residents prepared a peti
tion (44 signatures) and wrote let
ters expressing their opposition to a business at this location. As one of
the few year-round residents, I was
asked to represent the absent pro
perty owners, and reluctantly
agreed to present the petition and at
tend the planning commission meeting. It seemed logical that the
“after the fact” application would
be denied, but it was approved with
mese modifications; no advertising
signs, the building is to be used to
house his vehicles, no electrical
^uipment in the yard and reviewal
in two years. It was referred to the
commissioners for approval.
At the commissioners’ meeting on
Sept. 10, Commissioner Nordgren
r^uested that the planning commission’s recommendations he referred
to the Girard Town Board for con
sideration. The town board, at its

recreational, residential, resort
area. Our concern is that a business

cerned taxpayers, and more
cooperation between town and coun-

these meetings, I represents, at the
very least, 50 disgruntled absent tax

the entrance, but every time we
leave or enter our addition, we will
be confronted by that objectionable
building — a constant reminder of
our frustration since the permit was

RESOLVED by the Board of County Commissioners of Otter Tail County
Minnesota, that
WHEREAS, Section IV. 2.d. of the Shoreland Management Ordinance of
Otter Tail restricts grade and fill construction projects to a period
from April 15th through September 1st annually; and
WHEREAS, the April 15th to September 1st construction period restric
tion was established to minimize erosion, and
WHEREAS, the April 15th to September 1st construction period is too
restrictive and not applicable to all grade and fill projects, and
WHEREAS, little or no erosion will occur in grades of less than 20%
critical slope.

against County Ditch #68 in Elmo Township, belonging to the U.S.A.,
under lease to the Minnesota Department of Natural Resources in the Land Utilization Program, for a total forgiveness of
$2,217.60.

unanimously carried, to support the action of the Steam's County
Board of Commissioners in objecting to exorbitant salary increases
that are ordered by the Judges for the Court Services personnel
and Court Reporters, requesting the County Auditor send copy of
the Board action to the Court Services Director, to the District
Supervisor of State Parole and Probation Services, tothe District
Court Administrator, to the District Court Judges serving the 7th
Judicial District and to the counties in the 7th Judicial District.
At 10:40 a.m.. Chairman Hovland recessed the meeting for the purpose
of meeting with representatives of the City of Fergus Falls relative
to solid waste disposal, to reconvene at 2:30 p.m..
Malcolm Lee, Land & Resource Management, appeared before the Board
and reported on the Superfund Amendments and Reauthorization Act
(SARA), with the Emergency Planning and Community Right-to-Know
Act and its possible impact on state and local governments, stating
one of the requirements placed on local governments is to submit to
Local Emergency Planning Committees by October 17, 1988, plans which
incorporate the Title III (emergency planning) requirements. Lee was
instructed to attend additional seminars offered.

Dennis Berend, County Engineer, appeared before the Board and re
quested authorization to purchase a fork-lift attachment for tractor
for use by the Highway Department, Motion was made by Hub Nordgren,
seconded by Andy Lindquist and unanimously carried, authorizing
Berend to obtain quotations and accept low quote.
Berend also requested authorization to purchase surveying equipment
for geodemeter use and was requested to wait with purchase until

Lloyd Wooldridge, representing the Minnesota Counties Insurance Trust,
reported on the proposed self-funding hospitalization program. Mr.
Wooldridge was instructed to meet with the Blue Cross-Blue Shield
representative and the personnel committee, the employees committee
and department heads for a full explanation on how the self-funding
pi an works.
Joe Egge, representing the tourism department in the State of Minnesota,
alppeared before the Board supporting Minnesota Heartland urging the
county to appropriate the sum of 5(t per capita, or $2,748.50 for
Heartland promotional activities. Motion was made by Andy Lindquist,
seconded by Mel 0. Olson and unanimously carried, to appropriate the
sum of $1,000 for Minnesota Heartland for the year 1988, requesting
the association make their request prior to the setting of the budget
for the next year of 1989.
The application of Terry Bennett for conditional use permit, tabled
from the October 15th meeting was again brought before the Board.

with Bert Hovland voting "no", to uphold the decision of the Planning

Larry Dorn of Dorn & Co., Inc., appeared before the Board and gave
a detailed report on the county's investments of the State Aid'Hiigh-
way bond funds.
Paul Hoff of Park Region Telephone Company and Joe Peloquin from the
Sheriff's Department appeared before the Board and reported the
Emergency System 911 is in place except for one small exchange in
Otter Tail County. As soon as that exchange has completed the necessary
switching operation, the 911 System will be operative. Motion was
made by Hub Nordgren, seconded by Andy Lindquist and unanimously car
ried, to continue the monthly rate for the Public Safety Answering
Equipment with Park Region Mutual Telephone Company at $350.00 per
month. Chairman Hovland instructed Larry Krohn to meet with Joe
Peloquin for the purpose of indentification and instruction.

On October 15/ 1987 the Girard Township Boa'fd^h'BTd'a Hearing
for Special Use Permit regarding the above matter. There were
15 people in attendance from the Sanda Beach area expressing
their views.
AT this meeting there was a motion by one supervisor to approve
the Special Use Permit/ but no second. There was a motion from
one supervisor to deny the Special Use Permit/ no second. Then
there was a motion to refer this problem back to the Board of
County Commissioners for their action since the application
began with the Planning Commission. This motion was seconded
and carried.
I am enclosing a copy of the letter from the Planning Commission
and the Notice of Hearing for Special Use Permit.

WHEREAS application has been made by Ben Ackerson for a confinement
swine operation in Section 33-138-42 (Lake Eunice Township in Becker
County), and
WHEREAS, such operation would adversely affect the residents and
lake property owners in Dunn Township in Otter Tail, both air pollu
tion and reduction of valuation,
NOW, THEREFORE, BE IT RESOLVED, the County Board of Otter Tail County
does hereby go on record opposing such operation on behalf of all
the residents on Pelican Lake, to grant such would not be in the best
public interest.

I ovm a lake cabin on East Battle Lake, Girard Township in Otter-
Tail CoTinty. My cabin in near the area that Kevin C. Moore has req
uested a conditional use permit to operate a commercial electrical
wiring business.
I wish to go on record as opposed to granting ^5r. Moore this
Conditional *^se Permit. This area is a,t present strictly residential
cabins. A commercial business in this area would be unsightly and also
cause a traffic problem, being very near the public access to lake.
Also, I object to the huge 'double gara.ge* he has constructed on
his property, very near the lake and the public access. Did Mr. Moore
get a permit to haul fill on his lot? Did he get a permit to construct
and erect the commercial bill board sign already advertising his business?
The sign is definately commercial and unsightly in a residential area.
I think this sign should be removed. If Mr. Moore did not get a permit
to fill his lot, some action should be taken against him.

As property owners along the beach we would like to strongly urge
the rejection of Mr. Moore's application. The area is entirely
conposed of lake homes and cabins. There are no ccsnmercial
businesses present other than one resort. It is entirely out of
context with the area to allow a commercial business such as this
to be established. It also sets a precedent which could completely
change the area if other residents are allowed to start similiar
commercial ventures on their property.
In addition, it would sean that Mr. Moore has little regard for
this application process as he has already erected a sign
advertising his business. To do this before a pemit is granted
seems to be an outright rejection of the zoning laws of our
county and the rights of the neighboring residents.
Vfe feel that Mr. Moore should be instructed to remove the sign
and and denied the permit to conduct his business from this location.

My wife and I are the owners of Lot 17, Sanda's Beach. I have
received notice of a hearing to be held September 2 , 1987 in
Fergus Falls, Minnesota on the application to establish an
electrical contracting business on Lot 1 of Sanda's Beach. Since
I live 450 miles from Fergus Falls, it will not be possible for
me to attend that hearing.
I would like to express my opposition to this application for
conditional use permit. Sanda's Beach was established as a
strictly residential area and our cabin has been existing in that
area since 1934. We would like very much to see the area remain
strictly residential as it was intended to be.

Because business couimitments prevent us from attending the September
2nd conditional use hearing regarding the Kevin Hoore property, we would
like to file this written protest to the zoning change from residential
to commercial use*
Our family is presently improving our Sandas Beach home on East Battle
Lake for eventual retirement living, ke certainly do not want a commercial
venture established in what we always thought would be a well-established
residential zone. In fact, that is a key reason why we purchased property
in that area four years ago.
It is rather ironic we have recently been told by Ottertail Authorities, all lakeshore residents must upgrade sewer and water systems (already we have
invested ’$5,000) now we find we may be making these additional investments
in what could become a hodge-podge of businesses and their related congestion.
The proposed commercial endeavor by Mr. Moore is at the entry and only
access to approximately 25 shoreline permanent and summer homes on Sandas
Beach. We are concerned about the possible congestion that could result
from equipment, supplies, vehicles on the property and usual business
traffic that would alter the present residential pattern, and eventually
create safety problems for children and grandchildren.
During the construction period of what residents then believed was a
large garage on the Moore property, we already witnessed the congestion
that took place on the property and near the roadway. We are sure those
patterns will not improve once a business is established in that present
residential zone.
We cannot see how a lake location could be beneficial to an electrical
business other than as a tax write-off for Mr. Moore.
It seems only logical with the number of vacant commercial establish
ments along your county highways and in the communities of Henning,
Battle Lake and Clitheral, there should be ample in higher business
traffic areas in already commercial zones that could house an electrical
business.
It is totally illogical to alter the present residential property
and jeopardize the present growing residential taxbase on the shores
of Ea^t Battle Lake when other sites exist.

It Is unfair to force a business upon the many long-time residential
owners of Sandas Beach who live there........invested there (three new
homes in just a few years). They now must question if they have a
sound long term commitment in your county.
We are for progress in Ottertail County and realize new business
and growth is important to cover necessary government expenditures.
However, Mr. Moor's proposal could set a precedent. Whimsically putting
businesses in lakeshore residential areas could serve as a determent
rather than a stimulant to the continuing residential Improvements, not
only on East Battle Lake, but on all the lakeshores of our county.
