Gary Miller-Approved as modified and conditioned.
Gary Miller, Breckenridge, MN, requested a variance of 15’ from the required road right-of-way setback
of 20’ for the placement of a dwelling 5’ from the road right-of-way. The property is described as Lot
40, Fair Oaks, West Battle Lake in Girard Township. The audience was polled with no one speaking for
or against the request. After consideration motion was made by Cecil Femling, second by David
Holmgren and unanimously carried, to approve a variance of 5’ from the required road right-of-way
setback of 20’ for the placement of a structure 15’ from the road right-of-way and no closer to the
ordinary high water level then what would be allowed when applying the string line with the condition
that impervious surface coverage cannot exceed 25% of the total lot area. Hardship is a substandard
lot of record and it was noted that the granting of this variance would provide the applicant with a
reasonable use of his property.
Kenneth Lyden - Denied
Kenneth Lyden, Pelican Rapids, MN, requested a variance of 48’ from the required ordinary high water
level setback of 200’ for the present location of a 12’ by 20’ structure and a variance for a 20’ by 25’
addition to this structure. The current structure is setback 152’ from the ordinary high water level. The
property is descried as the Northwest Quarter of the Northeast Quarter, the Northeast Quarter of the
Northwest Quarter and the South Half of the Northeast Quarter, Section 18 of Hobart Township by an
unnamed lake. The audience was polled with no one speaking for or against the request. After
consideration motion was made by Randall Mann, second by Mark Steuart and unanimously carried, to
deny the variance as requested as no adequate hardship had been shown unique to the property that
would allow for the granting of the requested variance and to allow the applicant until June 1,2000 for
the placement of the structure in a location meeting the setback requirements of the ordinance. It was
noted that the applicant has a large amount of acreage that should provide other reasonable sites for .
his proposed development, which will not require a variance from the standard setback requirements:.
C. Marquardt - Denied
Glen C. Marquardt, Henning, MN, requested a variance to remove deteriorated decking and aluminum
awing and to replace the flooring, to replace the awning with a roof and to enclose this area to make a
three-season porch. The applicant’s proposed project will be setback 30’ from the lakeshbre. The
required ordinary high water level setback is 100’. The property is described as Lots 29 and 30,
Rainbow Lodge, East Battle Lake in Girard Township. The audience was polled with no one speaking
for or against the request. After consideration motion was made by Randall Mann, second by Cecil
Femling, and carried with John Everts abstaining, to deny the variance as requested:as no adequate
hardship had been shown and noting that the denial of this variance request will keep additional
development from occurring within the shore impact zone.
