It was also noted that the variances are from a detached garage and not an occupied dwelling. The motion failed with Cecil Femling, Richard Sha and Mark Steuart voting no. Steven M. Haglin, requested a variance of 7’ from the required ordinary high water level setback of 75’ for a 20’ by 44’ addition 68’ from the ordinary high water level. It should be noted that the placement of the addition at this location would allow the front wall and the roofline of the addition to be even with the existing cabin, thereby making it no closer to the lake than the current structure. The property is described as Lot 6, G. Anderson Survey Lots of Government Lot 1, Section 30 of Otto Township by Rush Lake. The audience was polled with Warren Larson speaking in favor of the request. After consideration, motion was made by Mark Steuart, second by Randall Mann and unanimously carried, to deny the variance as requested and to support the action taken by the Board of Adjustment on July 8, 1999. Leaf Lake Township and Mark Rortvedt - Approved Leaf Lake Township and Mark Rortvedt, Henning, MN, requested a variance to install a drain field T from the property line and under a 4’ township footpath. A utility easement will be filed with the township. The property is described as Lot 7, Block 7, Lot 2, Block 6 and 50’ adjacent to Lot 2, Block 6 of Reserve Block D, Leaf Lake Pleasure Grounds, West Leaf Lake in Leaf Lake Township. The audience was polled with William Goepferd, the adjacent neighbor, speaking in favor of the request. After consideration, motion was made by Cecil Femling, second by David Holmgren and unanimously carried, to approve a variance to install a drain field T from the property line and under a 4’ township foot path noting that it is the best location for the installation of the proposed drain field as determined by a licensed installer. Brain ' Brogard appeared along with Mrs. Steven Hammer at this hearing. A letter from Terrence R. Lejcher, Area Hydrologist, addressing soil compaction and the percolation test, which was run before and after the i parking of a vehicle on the site, was read for the record. The property is described as Lot 15, Broadwater Beach Second Addition, Pelican Lake in Dunn Township. The applicant was not in attendance at the public hearing. After discussion, motion was made by Cecil Femling, second by Mark Steuart and unanimously carried, to table the applicant’s request until the September 9, 1999 meeting. The property is described as part of Government Lot 1, Section 34 of Pine Lake Township by Haberman Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Cecil Femling, second by John Everts and unanimously carried, to approve a variance of 42’ from the required ordinary high water level setback of 200’ for an 8’ by 26’ addition to an existing dwelling 158’ from the ordinary high water level. It should be noted that the proposed addition will be no closer to the ordinary high water level than the existing structure and the proposed addition is on the backside of the cabin away from the lake. Fred and Ruth Suppes - Denied Fred and Ruth Suppes, Detroit Lakes, MN, requested a variance for an enclosed area between the house and garage. This area is now covered with a wooden deck. I will not be adding any more square footage of building to the lot. Building, deck and pavement currently cover 30% of the total lot area. Variance requested is a variance to cover more than 25% of the total lot area with impervious surface. The property is described as Lots 7 and 8, Midland Beach, Pelican Lake in Dunn Township. Letters from Flarland and JoAnne Geiger and Bill and Mary Pat Collins in favor of the applicant’s request were read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Randall Mann, second by Mark Steuart and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and more than 25% of the total lot area is already covered with impervious surfaces. A letter from the Girard Town Board granting permission to extend the existing drain field five feet into the township road right-of-way was read for the record. My information is that the board turned this application down because they were concerned about compaction on the site. If my information is correct, a percolation test was run before and after a vehicle parked on the site, with a rate of .66 and .62 inches per minute. It is my opinion that in this sandy soil, this difference is within the range of error on this test and there is no actual difference do to this one time event, especially on this sandy soil.
