(8:45 p.m.) Motion was made by Steve Schierer, second by Randall Mann and unanimously carried, to approve a variance of 5’ from the required side lot line setback of 10’ for the construction of a roof over an existing deck located 5’ from the side lot line. It was noted that the proposed roof is away from the lakeside of the dwelling and is an extension of the applicants’ house. (7:30 p.m.) Glenn and Doris Jaakola, Lot 10 Block 1, Little Pine Estates, Little Pine Lake in Perham Township, requested a variance to have Lot 10 Block 1, Little Pine Estates declared a buildable lot for the purpose of constructing a detached garage which will meet all setback and height requirements of the Shoreland Management Ordinance. Chairman Mann polled the audience with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierer made a motion, seconded by Michael Conlon and unanimously carried, to declare Lot 10 Block 1, Little Pine Estates as a buildable lot. The Board noted that the variance as approved does not grant directly or indirectly any other variances and is consistent with past actions of the Board. Steve and Jan Nelson - Approved the proposed development with conditions. (7:32 p.m.) f Steve and Jan Nelson, Lots 3 and F Inglewood, Blanche Lake in Girard Township, requested a variance to cover more than 25% of the total lot area with impervious surfaces and a variance of 10’ from the required side lot line setback of 10’ for the replacement of a portion of an existing structure and for the addition of a Si* second story 0’ from the side lot line. Chairman Mann polled the audience with no one speaking for or g against the variance as requested. After discussion and consideration, Cecil Femling made a motion, f seconded by Paul Larson and unanimously carried, to approve the development as proposed with the condition that no part of the proposed development can be any closer to the ordinary high water level than / the existing structure and with the condition that the average impervious surface coverage between the two / lots, that share the driveway, cannot exceed more than 25%. The two properties together cannot exceed I 50% impervious surface coverage. The Board noted that the variance as approved does grant the side lot I line variance as requested due to the placement of the existing structure. Donald B Meyer Et Al -Tabled. (7:50 p.m.) Donald B Meyer, Et Al, Lots 1, 2 and 3 Block 1, Big Pine Haven, Big Pine Lake in Pine Lake Township, requested the following: to allow the total square foot area of first tier on Lots 1, 2 and 3 of Big Pine Haven to be used for purpose of calculating boat slips for a proposed 8 units planned development verse total square footage less bluff area. (Proposed; Common Interest Community Number 37 - Big Pine Villas) Rick Heinie, property owner and Chris Hyer, Surveyor with Meadowland Surveying, appeared with the applicant at the public hearing. Chairman Mann polled the audience with no one speaking for or against the variance as requested. An email from Mike Harder and a letter from Sam Weatherhead opposing the granting of the variance as requested were read for the record. After discussion and consideration, Cecil Femling made a motion, seconded by Joe Maske to deny the variance as requested. After additional discussion and consideration, this motion was withdrawn and Randall Mann made a motion, seconded by Steve Schierer and unanimously carried with the applicants' verbal approval, to table this variance hearing until the County Board of Commissioners lifts the moratorium for the creation of cluster developments. The Board expressed concerns with how appropriate it might be for the Board to take action on cluster developments during the moratorium and with the possibility of creating a precedence that might not be in harmony with the rules for cluster developments once the moratorium is lifted. Karl C and Darlane Miller - Denied. (8:22 p.m.) Karl C and Darlane Miller, East Half of the Southeast Quarter, Section 8 of Eagle Lake Township by Torgerson Lake, requested the following: we are asking the Board of Adjustment to accept the submitted scale drawing instead of a preliminary plat drawing prepared by a Minnesota Registered Land Surveyor, Civil Engineer or an Architect. We are not planning to make the cluster development into a public campground. We are only allowing our family and a few family friends into the cluster. We inherited the land and want to enjoy its beauty, not make money from it. Chairman Mann polled the audience with Mark Murphy expressing concerns with the proposed development. After discussion and consideration, Steve Schierer made a motion, seconded by Cecil Femling and unanimously camied, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. The Board noted that the drawing is needed by the Planning Commission to adequately review and plan for the proposed cluster development.
