Assessor and the MN DNR bk 072011-001 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday November 3, 2011 The Otter Tail County Board of Adjustment met Thursday, November 3, 2011, with the following persons in attendance; Thomas Lee Robert Schwartz Paul Larson Steve Schierer Mark Ronning, Land and Resource Management David Hauser, County Attorney Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the October 6, 2011 meeting as mailed. The Board of Adjustment considered the following applications for variance; Donlan T. Hillman - Application approved as requested. (6:31 p.m.) Donlan T. Hillman, Lot 5 Block 1 North Turtle Lake Shores, North Turtle Lake in Everts Township, requested a variance of 50’ from the required ordinary high water level setback of 200’ for a structure setback from the ordinary high water level of 150’. The audience was polled with no one speaking for or against the variance as requested. After consideration and discussiori, Steve Schierer made a motion, seconded by Thomas Lee and; unanimously. carried, to approve a variance of 50’ from the required ordinary high water level setback of 200’ for a proposed structure location 150’ from the ordinary high water level. The practical difficulty is the terrain features of the applicant’s property. It was noted that considerable fill would be needed at the required 200’ setback and there is a wetland area impacting the property directly behind the 200’ setback area. Eugene and Ruth Shol - Application approved as modified. (6:36 p.m.) Eugene and Ruth Shol, part of Government Lots 2 and 3, Section 24 of Elizabeth Township by Jewett Lake, requested the following: We would like to extend our existing porch by 5 to 10 feet.' The existing porch is now setback 55’ from the ordinary high water level. That would make the new addition 45 to 50’ from the ordinary high water level. After consideration and discussion, Paul Larson made a motion, seconded by Michael Harris and unanimously carried, to approve a variance of 25’ from the required ordinary high water level setback of 75’ for a five foot extension of an existing porch being no closer to the,ordinary high water level than 50’.. The variance as approved will keep the proposed development out of the shore impact zone and will not obstruct the view from the adjacent properties. j^William G. Jedlicka and Arladean C. Brown, Lot 33 Girard Beach. West Battle Lake in Girard Township, requested the following: We were going to remodel present cabin, but proved to be too expensive. We want to remove present cabin and rebuild or move in a house. Our space is limited on 50’lot. We are currently 22’from the bluff (grandfathered in) and would like to keep that distance. We are requesting an 8’ variance from the required.30’ bluff setback. An email from Deanna and Eldean Ratzlaff in support of the variance as requested was read for the record. The audience was polled with Lynda Glick and Dale Werner speaking in support of the variance as requested.
