July 5, 2007 Page # 4 Jim Himes - Denied. (8:22 p.m.) Jim Himes, part of Government Lot 5 Section 27 of Lida Township by Lake Lida, requested a variance to place a 1000 gallon concrete septic tank 4’ from an existing structure. The required setback is 10’. Steve Egge and Kevin Solberg appear with the applicant at the public hearing. The audience was polled with Kenneth Brown addressing the requested variance. After discussion and consideration. Rod Boyer made a motion, second by Michael Harris and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. It was noted that the hardship is a self imposed hardship. Lavel Larsen - Denied. (8:42 p.m.) Lavel Larsen, Lot 18 Martee Beach, Blanche Lake in Everts Township, requested a variance to exceed the 25% impervious cover rule in order to add a 26’ by 45’ addition. The proposed impervious would be 31.9%. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration, Steve Schierermade a motion, second by Paul Larson and unanimously carried, to deny the variance as requested as no adequate hardship unique to the property had been shown that would allow for the granting of the variance as requested. It was noted that the applicant has a reasonable use of his property and/or can obtain a reasonable use without the granting of the variance as requested. The granting of the variance as requested would establish precedence that the Board of Adjustment does not wish to establish. Timothy True - Approved the variance as requested with a condition. (8:50 p.m.) Timothy True, part of Sub Lot B of Government Lot 4 Section 33 of Girard Township by West Battle Lake, requested the following: We would like to rebuild and add on to the front porch of our lake home because of some rotting due to moisture problems caused by the leaking flat roof. We would like to add 2.5’ onto the porch towards the east, and put on a gable roof. We also would like to put a deck off the front walk out the rest of the width of the house. In doing this, we would not be encroaching on the high water line or property line. We feel that not only would the change give us more space, but also make our home more visually pleasing from the lakeside. We have Dan Ness lined up to put in our new mound system. Existing dwelling is approximately 36’ from waters edge, seeking variance of 39’. We would like to have this declared a buildable lot for residential use. The audience was not polled as there was no one in attendance at the time of this hearing. After discussion and consideration, Steve Schierer made a motion, second by Paul Larson and unanimously carried, to declare Parcel 29-000-3-0223-005 as a buildable lot for residential use. After additional discussion and consideration, Michael Harris made a motion, second by Steve Schierer and unanimously carried, to approve the variance as described in the variance application and as depicted on the drawing submitted with the variance application with the condition that the proposed development must be at least 37.5’ from the ordinary high water level.
