Motion was made by Cecil Femling, second by Steve Schierer and unanimously carried, to approve the repair of the foundation with the following conditions; 1.) the repaired structure must occupy the same footprint as the existing structure, and 2.) the existing deck cannot be altered and the existing deck must remain in the exact same location after the foundation has been repaired. The granting of the variance will allow the applicant the ability to repair and protect his existing structure without altering the essential character of the applicant’s property. Battle Lake MN 56515 To: Otter Tail County Board of Adjustment Land and Resource Management Otter Tail County Court House Fergus Falls MN Regarding: Proposal to repair foundation Lake No. 56-239 (West Battle Lake) Parcel No. 29-000-31-0210-006 Shady Acre Beach, lot 5 Gentlemen of the Board: History of problem When we built our cabin in 1970 we staked out the proposed location of the cabin on the lot but failed to consider the fact that there was a difference in elevation of approximately two feet between two opposite comers of the cabin (see points A and B on the Site Plan, attached). There was a natural slope toward the lake and to the north of all of the land above the bluff and extending back to the road. Our builder (Cliff West of Clitherall) proceeded to constmct a foundation for the cabin in the proposed location and chose an elevation that was somewhat of an average between these two elevations. Hence the elevation of the finished main floor of the cabin came to be several inches below the elevation of the land at point A and the top of the foundation is about one foot below the elevation of the land at point A. The foundation located well below grade has caused surface water - which naturally flows toward the cabin on that side - to collect under the cabin. In addition, soil builds up against the cabin, onto the siding on the walls adjoining point A. For the last several years we have experienced a problem with a musty smell in the rooms along this side of the house (away from the lake) mainly in the spring, and have often needed to air out the cabin. ^ Krenz - foimdalion repair (July 2001) I This spring we had this same musty smell and we entered the crawl spdce under this side (away from the lake) of the cabin to investigate. We learned that the ground under . this side of the cabin was very wet, and in fact water had at some time, or at many times, been entering through a (6" by 6") vent hole which is located about midway along this side of the cabin, and through a large crack in the foundation about midway between the vent hole and the comer at point A. Sufficient erosion has taken place so that the foundation has been significantly undermined about a foot below the foundation and 2-3 feet wide at both of these points. The foundation has also badly cracked at the point of this vent hole both below and above the vent hole. Some settling has occurred in the foundation along that side of the| building but there appears to have been no significant damage to the cabin as yet. Wp would like to repair the foundation before any further settling and damage to the cabin loccurs We had thought this spring that water likely enters the vent hole each year just at the time of the spring run-off while the ground is still frozen. But twice in June, 2001, on the 11*^ and the 13*^, we had heavy rains at the cabin and water began to flow through, this vent hole. Hence we had to plug the vent hole to stop the water from flowing under the cabin. Also, efforts were made at that time to provide some other alternate routes for the runoff water to carry it away from the cabin. However, sUch a diversion is difficult because of the low elevation of the cabin relative to the [elevation of the surrounding yard. For instance, the elevation of the finished floor of the garage is about 8 3/4 inches higher than the elevation of the finished main floor of the cabin and the bottom of this vent hole is about 23 inches below the garage floor level and the surrounding land. This causes surface water in most of the area between the cabin and the road to run off toward the cabin. 1.5 Proposed repair We propose, and ask for your approval, of a plan to raise the cabinjto allow the repair :, and raising of the foundation by 3 feet. By raising the foundation this amount we will " then be able to landscape the ground along the road side of the cabin to create a slight slope away from the cabin to prevent future mnoff toward the cabin. Our plan would not involve any new constmction outside the existing foundation. We have developed this proposal in consultation with an architect, LeS jBj6re,.of Battle Lake, and he has added his comments and the repair specifications ibelow! We hope this request can be considered at your next meeting so that we can proceed with these repairs before the next winter. If you have any questions regarding this request, please contact us. Architect's comments: Les Bjore The Krenz’s contacted me to help them with their foundation problems. Upon my investigation I noticed that the top of the foundation wall along the southeast side of the house was actually below the adjacent grade. This has caused the following violations of the ’97 Uniform Building Code. ‘i- ;• V Krenz - foundation repair (July 2001) • Section 2306.8 - Wood must be 6” above adjacent grade unless it is pressure treated • Section 2306,3 - Wood floor joists must have a 18” clearance from the ground of the crawl space. There currently is less than 6”. Other violations of the Building Code include: • Section 2306.7 - Crawl space ventilation. There currently are not enough vents as required by the code. • Section 1806.5.5 - Requires a minimum of 2% slope of the grade away from the foundation wall. Currently the grade slopes towards the foundation wall. • Section 1806.1 - Requires footings to be below the frost line. Currently the foundation is approx. 14” below grade and it should be 4’-0”. In my professional opinion the only way to correct the violations of the building code is to have the house jacked up and moved off the foundation , and to repair the foundation by extending it below the frost line and by raising the top of the foundation wall 3’ above it’s present height. This repair will allow the clearances required and will provide the Krenz’s with an opportunity to slope the grade away from their house. All of the grading will take place on the side of the cabin that faces away from the lake. When complete the impact of construction vvnll not be noticed as the house will return to the same location and the upper portion of the foundation will be covered by the landscaping.
