The member voting no expressed concern with the establishment of a single family residential backlot noting that many other backlots in this immediate area are used for secondary storage buildings and additional area for future septic systems. Assessor and the MN DNR L R Official/Date bk 072011-001 MINUTES OF THE MEETING OF THE OTTER TAIL COUNTY BOARD OF ADJUSTMENT Thursday, December 11, 2014 The Otter Tail County Board of Adjustment met Thursday, December 11, 2014, with the following persons in attendance: Thomas Lee Rick Wiison Michael Harris Steve Schierer Scott Ellingson, Land and Resource Management David Hauser, County Attorney Paul Larson Ward Uggerud Called to Order - Steve Schierer, Chair called the meeting of the Board of Adjustment to order at 6:30 p.m. Minutes Approved - The Board of Adjustment approved the minutes of the November 13, 2014 meeting as mailed. The Board of Adjustment considered the following applications for variance: E. and Janice T. Hallberg - Variance application approved as requested with a condition. (6:32 p.m.) James E. and Janice T. Hallberg, Lots 8 and 9, Girard Beach and part of Government Lot 1, Section 30 of Girard Township by West Battle Lake, requested a variance from the 5 acre minimum metes and bounds described parcel requirement within 1000’ of a lake. A one-time split into approximately 1 acre backlot and an approximately 1 acre lake lot. Both lots to be considered single family residential buildable lots. The audience was polled with no one speaking for or against the variance as requested. After discussion and consideration. (6:40 p.m.) Rob and Sharon Snorek Tst, part of Government Lot 3, Section 24 of Buse Township by Swan Lake and an unnamed lake, requested a variance of 60’ from the required ordinary high water level setback of 100’ and a variance of 88’ from the required ordinary high water level setback of 200’ for the placement of a new dwelling with attached garage and storm shelter 40' from the ordinary high water level of Swan Lake and 112’ from the ordinary high water level of an unnamed lake. Jaymey Dornbusch, Contractor, represented the applicants at the public hearing. The audience was polled with on one speaking for or against the variance as requested. After discussion and consideration, Paul Larson made a motion, second by Rick Wilson and unanimously carried, to approve a variance of 60’ from the required ordinary high water level setback of 100’ and a variance of 88’ from the required ordinary high water level setback of 200’ for the placement of a new dwelling with attached garage and storm shelter 40’ from the ordinary high water level of Swan Lake and 112’ from the ordinary high water level of an unnamed lake as depicted on the drawing dated October 20, 2014, which was filed with the variance application. The variance as approved will provide the property owners with a reasonable use of their property. The variance as approved does not directly or indirectly grant any other variances for the proposed or future development. (6:45 p.m.) Patricia Piekarski Leitch, Lot 7 Blue Heron Beach, Otter Tail Lake in Otter Tail Township, requested the following: There is approximately 15’ 8” of property between my home (Piekarski/Leitch) and Douglas and Dallas Loffs house. Loffs house is just inches away from the property line. Their roof line actually hangs over on my property. I would like to give 5’ of property to Loffs. This would provide them with more area to maintain their property without trespassing. This would still leave 10’ of property on the west side of my home. Douglas Loff appeared with the applicant at the public hearing. An unsigned letter expressing concerns with Patricia Piekarski Leitch’s property ownership was read for the record.
