Conditional Use Permit - Jacoueline Christensen: Motion by Froemming, second by Lindquist, and unanimously carried to approve a Conditional Use Permit for construction of a driveway as presented. The project is located in R of Govt. Lot 2 (1.60 AC), Section 28 & Pt N14 SW% (.24 AC), Section 27 of Girard Township; West Battle Lake (56-239), GD. Recess & Reconvene At 11:17 a.m.. Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners recessed for a short break. The meeting was reconvened at 11:23 a.m. Buffalo-Red River Watershed District Update Bruce Albright, BRRWD Administrator, submitted the Draft BRRWD Advisory Committee minutes and a document regarding funding and benefits for 20% flow reduction on the Red River at Fargo and the Redpath Project in the Bois de Sioux Watershed. Discussion took place regarding the Advisory Committee minutes and consideration for the BRRWD to join the Red River Watershed Management Board (RRWMB). Pros and cons of joining the larger Watershed (RRWMB) were discussed. Commissioners agreed that open communication is needed between BRRWD and RRWMB in order to make future decisions. Adjournment At 11;55 a.m.. Chairman Huebsch declared the meeting of the Otter Tail County Board of Commissioners adjourned for committee meetings until 8:30 a.m. on Tuesday, June 25, 2013. Dear Ms. Christensen: I havereviewed your Tequest;to .construct a driveway through .a wetland on your West Battle Lake property. '\^Tlile it may be possible to gain .approval for a project of this type, several items need to be addressed prior to moving forward with the request. The State of Minnesota requires lhat-all wetland impacts that cannot be .avoided, be minimized. I have visited this lot and noted that one way to minimize or .avoid impact is to check with adjacent property owners and see if .they would :be willing to grant an .access easement or sell/Pade property. Wetland impact that cannot be avoided will require wetland replacement. Minimum wetland replacement ratio is 2:1, Therefore ^^.our proposed 9,000 sq.ft, wetland impact will require a minimum of 18,000 sq. ft. ofreplacement. The Otter Tail County Shoreland Management Ordinance requires that wetiandimpacts in the .shorelandareas be .replaced onsite, or in the same minor watershed. It appears ithat onsitereplacement is unlikely, so finding a replacement site in the minor watershed would :be required. If you are unable to find.a replacement site in the .minor watershed, a Variance wouldiiav.eto:be appliedforand approved to replace outside of the minor watershed. Because of the amount of .earthmoving required for this request .a Conditional Use .Permit (CUP) will also need to be .applied for and approved. If you are .able to minimize or avoid the wetland impact, it is possible that the CUP .may .not be needed.
