If it involves the discharge of any dredged or fill material, even temporarily, into any water or wetland areas, it will require a Corps permit under Section 404 of the Clean Water Act. Please note that, under Federal law, the Corps regulates many wetland areas that are not regulated by the Minnesota Department of Natural Resources (MDNR). Therefore, you may need a Corps permit for your project even though you do not need a MDNR permit. Enclosed is further information about the Corps regulatory program, which you should read carefully. So that we can determine if your proposal requires a Corps permit, we request that you send us a map or drawing showing the project site, including the legal description (Section, Township, and Range) if possible. Also, you should send a drawing or plan that shows your proposal, including any proposed fill areas and where any excavated material will be put. Photos of the project site will also help, if you can include them. Aerial photos, and copies of SCS, uses, or national wetlands inventory maps (available from the U.S. Fish and Wildlife Service) are especially helpful. Please also indicate whether or not your project requires a permit from the MDNR. Your project may need state, county, and/or city permits, agricultural drainage or land, you should also contact your local U.S. Soil Conservation Service office to determine if doing the planned work would affect your eligibility to participate in any Federal agricultural programs. You should contact these agencies as soon as possible, if you have not already done so.
