Motion was made by Randall Mann, second by David Holmgren and unanimously carried, to approve the variances as requested, both the proposed subdivision and the remaining 4.5 acre parcel as a separate buildable lot, with the following conditions: 1. a registered surveyor’s drawing must be provided, 2. the 1.5 acre parcel must be permanently attached to Lots 24 and 25, Beauty Shore Summer Resort, 3. the area within this parcel cannot be considered when the impervious surface coverage is calculated for front lot development, and 4. no residential dwelling structures can be placed on this parcel. Minnesota < Variance Request of Keith and Elizabeth Keller It is requested that a variance be granted to permit the sale of a portion of the approximately six- v: * acre parcel of real estate adjacent to Beauty Shore Summer Resort subdivision to Leonard R. and Diane A. Krolak. The property to be transferred is highlighted in yellow on the attached segment of a recent survey. They will complete the purchase of lots 24 and 25 of Beauty Shore Summer Resort on September 10,1999. It is their intent to construct a home for year round occupancy. They have offered to purchase approximately 1.5 acres of our property across the 20 foot dedicated road adjacent to and bordering their lake lots on the North side. Their intended use of the property is to prevent lot congestion by purchasing the storage garage located on the property and/or new construction for storage and providing space for gardens and orchards. They also want to have the ability to construct a driveway to the township road should use of the currently used privately maintained road become impractical to use during the winter months. They also desire additional space in the event a septic system cannot be conveniently located on their lot. Since it is our desire to prevent any second tier residences, the prospective buyers have indicated that they would be willing to permanently attach the property to their lake front lots to preclude construction of a dwelling unit on the back parcel. They would also stipulate that the added property would not be used to calculate a new base for the lake front lots for the purposes of exceeding the current 25% impervious area restriction. The remaining parcel of approximately 4.5 acres, which continues to be owned by the Kellers, will remain a separate parcel not attached to any other property and remain a buildable lot.
