Luhning, Battle Lake, MN, requested a variance to subdivide a parcel of less than 2.5 acres. The parcel would have approximately 40,200 square feet of area and approximately 160' of water frontage, approximately 150' of lot width, approximately 320' of depth on the west side of the lot, approximately 370' of depth on the east side of the lot and 68' of width at the rear of the lot. The property is described as part of Government Lot 2 and part of the SW 1/4 NE 1/4 of Section 5 in Girard Township on Ethel Lake. Due to a possible conflict of interest Craig Anderson removed himself from this variance hearing. The audience was polled with no one speaking for or against the requested. After consideration, motion was made by Carl Johnson to deny the variance as request as no adequate hardship had been shown, additional land is available for development and that the proper course of action would be to plat the property. No action was taken on this motion and after additional discussion the applicant decided to withdraw his variance request. Terry A. Hauger - Approved Terry A. Hauger, Rothsay, MN, requested a variance of approximately 28' from the required ordinary high water level setback of 100' for the construction of a dwelling 72' from the ordinary high water level. The property is described as Lot 1, Block 1, Mabuhay, East Spirit Lake in Dora Township. A letter from Jean Fruehauf opposing the granting of the variance request was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to permit the applicant to apply a string line from the old cottage to the west of the appliant's lot to a point 100' back from the ordinary high water level and 10' in on Lot 2, Block 1, Mabuhay, with the front center of the proposed structure on the string line at the center of the lot and at the center of the string line and to permit the applicant to square up the structure with the lake. Allowing the applicant to square up the structure with the lake means that the east side of the structure will exceed the string line by a few feet and the west side of the structure will be behind the string line by a few feet. Charles Cavanagh - Approved Charles Cavanagh, Perham, MN, requested a variance to purchase a parcel of land approximately 16' by 2' 6* from the adjacent property owner (Phillip Petterson); a variance to construct a garage 6' towards the road and a variance of 9' from the required side lot line setback 10'. The applicant will be complying with the terms of the variance previously approved on September 2nd, 1993. The property is described as part of Government Lot 1, Section 26 of Gorman Township on Little Pine Lake. The audience was polled with no one speaking for or against the request. After consideration, motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to approve the amended request as presented by Mr. Cavanagh and to grant a 1' 6* variance from the required side lot line setback of 10'. Erv. J. Wegscheid - Denied Erv. J. Wegscheid, Perham, MN, requested a variance of 49' from the required ordinary high water level setback of 100' for the enclosure of an existing deck with a screened in porch 51' from the ordinary high water level. The screened porch would be a second story. The property is described as Lot 6, Gulliver's Travels, Paul Lake in Edna Township. Steve Detwiller represented the applicant at the hearing. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Cecil Femling and unanimously carried, to deny the variance as requested as no adequate hardship had been shown and other alternatives exist for the ■annlinan+. October 13th, 1994 Page 3 Robert Diederich - Approved Robert Diederich, Ottertail, MN, requested a variance of 6' from the required side lot line setback of 10' for the construction of a 24' by 24' garage 4' from the lot line. It should be noted that the overhang will be 2' from the side lot line. The property is described as part of Government Lots 5 and 6, Section 22 of Rush Lake Township on Round Lake (AKA Lot I, Round Lake Acres).The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to approve a 3' variance from the required side lot line setback of 10' for the construction of a 24' by 24' garage 7' from the side lot line with the condition that the garage will be at least 5' from the drain field. Hardship being the terrain and topography of the applicant's property. Sonia C. McRanus - Approved Sonia C. McManus, Fargo, ND, requested a variance of 52' from the required ordinary high water level setback of 100' and a variance of 2' from the required shore impact zone setback of 50' for the replacement of an existing dwelling with a new structure. The property is described as the South 15' of Lot 1, Sundberg's 2nd Addn. and Lot S, Sundberg's Point Addn., Pickeral Lake in Maine Township. Patricia Lies in favor of the variance request was read for the record. The audience was polled with no one speaking for or against the request. After consideration, motion was made by John Everts, seconded by Randall Mann and unanimously carried, to approve building up to the string line with the provision that the house and the garage will be tied together with a breezeway as indicated on the applicant's drawing. A letter from Steven and Robert and Julie Pochardt - Approved Robert and Julie Pochardt, St. Cloud, MN, requested a variance of 84' from the required ordinary high water level setback of 100' (Creek) for the construction of a garage and for a future addition to the cabin 16' from the ordinary high water level of the creek and a variance of 3' from the required ordinary high water level setback of 75' for an addition to an existing structure 72' from the ordinary high water level. The property is described as the SELY 25' of Lot 8, all Lot 9 and vacated road adjacent. Inlet Beach, Lake Lida in Lida Township. After consideration, motion was made by George Walter, seconded by Craig Anderson and unanimously carried, to approve a variance of 84' from the required ordinary high water level setback of 100' for the construction of a garage and for a future addition to the cabin 16' from the ordinary high water level of the creek and a variance of 3' from the required ordinary high water level setback of 75' for an addition to an existing structure 72' from the ordinary high water level. The granting of this variance request will not create any maintenance problems for the septic system.
