WHEREAS: as a part of the reconstruction of County State Aid Highway 83, Otter Tail County
acquired property adjacent to both the public access on Elbow Lake and the new alignment of County
State Aid Highway 83 with the intent of transferring the property to the State of Minnesota for the
expansion of the public access while retaining necessary right of way interest; and
WHEREAS: the property is identified as 0.70 acres by survey in the form of a 100' wide strip adjacent
to the northerly line and a variable width strip adjacent to the southerly line of the existing public
access; and
WHEREAS: upon transfer to the State of Minnesota, the property is intended to be permanently
attached to the existing public access property identified as OTC PIN# 25000290182001; and
WHEREAS: Otter Tail County will retain only the right of way interest in that part of OTC
PIN# 25000290182001 shown as Parcel 16 on OTTER TAIL COUNTY HIGHWAY RIGHT OF WAY

Motion by Erickson, second by Huebsch, and unanimously carried to approve the Final Plat known as
“Hidden Shores Addition" consisting of eight (8) residential lake lots located in Section 31, Twp 137,
R. 43, Scambler Township; Grove Lake (56-952).NOW, THEREFORE, BE IT RESOLVED, that the ownership of the above described strips of property

City of Fergus Falls South Demolition Landfill Permit Request
Solid Waste Director, Mike Hanan, provided information to the Board regarding a License Application
received by the County from the City of Fergus Falls to construct and operate a demolition landfill
south of the existing landfill. Motion by Rogness, second by Huebsch, and unanimously carried to
establish a Public Hearing for the licensing of the City of Fergus Falls proposed South Demolition
Landfill at 11:30 a.m. on October 13, 2009 at the Otter Tail County Government Services Center in
Fergus Falls.

After Request for Proposals were completed, Mr. Hanan, recommended purchase of a 50,000 lb.
Hook Truck for the Fergus Falls Transfer Station at a purchase price of $104,850.00. Mr. Hanan
reported a budgeted amount for the Hook Truck of $133,000.00.

CSAH No. 67 In New York Mills
Motion by Rogness, second by Froemming, and unanimously carried to authorize the appropriate
County Officials’ signatures to execute an “Agreement for Repair and Replacement of County State
Aid Highway No. 67", S.A.P. 56-667-32, to repair and replace street, sidewalks and utilities from the
south limits of New York Mills to CSAH #84 (0.84 miles).
Staffing at Transfer Stations
Motion by Lindquist, second by Rogness, and unanimously carried to authorize hiring two 24-hour per
week employees and one 8-hour per week employee to replace a full time resignation at the Henning
Transfer Station. Commissioner Rogness suggested that the hours of operation at the landfills on
Saturday afternoons could be reduced.Lake Olaf Drawdown Project Update
Highway Engineer, Rick West, briefed the Board on the Lake Olaf Drawdown Project - HEI Project
No. 5197-003.Closed to the Public
At 12:05 p.m.. Chairman Erickson declared the meeting of the Otter Tail County Board of
Commissioners closed to the public to discuss pending litigation regarding the Ethanol Plant
foreclosure proceedings. The closed session is authorized by attorney-client privilege. Chapter
13D.05 Subd, 3b. Present were all five seated Commissioners, County Attorney, County Coordinator,
and Board Seoretary.
' Planning Commission Recommendations
Conditional Use Permit - Thomas & Georgette Weoscheid:
Land & Resource Director, Bill Kalar, stated that the County Board tabled this request at their July 14,
2009 meeting and requested further discussion regarding wind towers in shoreland areas. The
Planning Commission discussed criteria that could be used when considering wind towers within the
shoreland area in addition to the 16 items in the SMO as follows: 1) wind towers should be limited to
residential use, 2) setback from lotlines, shore impaot zone and right of ways should be height of
tower plus 10’, and 3) request should include a Decommissioning Plan. County Board members
discussed the location of the proposed wind tower on the Wegscheid property and noted that the
■ farmer located to the north has no objection to the tower.

At 12:08 p.m.. Chairman Erickson declared the meeting of the Otter Tail County Board of
Commissioners recessed for lunch break. The meeting was reconvened at 1:00 p.m. with
Commissioners Erickson, Froemming, Lindquist and Huebsch present. Commissioner Rogness was
present at 1:10 p.m.

On July 14, 2009, County Board of Commissioners passed a motion to table your request
until October 1, 2009, with agreement from the Applicants to waive the 60 day notice rule.
Tabling will allow time to provide direction on how to apply the guidelines. The Conditional
Use Permit request will be scheduled for reconsideration at the County Board meeting on
September 29, 2009.

Motion - June 10. 2009: A motion by Wilson, second by Schwartz to table the Application
to the July 8, 2009 Meeting to allow the Commission to view the wind turbine at Residential
Wind Power in New York Mills as requested by the Applicant
Tom & Georgette Wegscheid, and William Boedigheimer represented the Application.
Diana Wilson (Project Resources Corporation) indicated that there are model wind
ordinances.
Motion Failed: A motion by Gill, second by Schwartz to approve as presented. Voting
Yes: Gill, Olson, and Schwartz. Voting No: Boyer, Erickson, Kinzier, Maske, Trites,
Wilson, and Zimmerman.
Break: At 8:48 P.M, the Commission took a 10 minute break.
Hagen’s Point Resort/Allen Chase - Approved With Conditions:
A Conditional Use Permit Application (as stated by the Applicant): In continuing the Hagen’s
Point Resort tradition, I would like to reorganize. Currently the resort is licensed for 23
campers (RV), 4 manufactured homes and 3 cabins which is a total of 30 units. I am
requesting a total of 26 units, including 2 cabins, 21 RV sites and 3 mobile homes sites.
The RV sites that are located on the southwest point and within 50 feet of the water will be
moved to the southwest edge of the property meeting the current setback requirements. A
variance has been approved to allow 11 of the RV sites to remain in locations which are
less than the required 100 feet. Three cabins would be removed and replaced with one
cabin that meets the setback requirements. A new shower /laundry building and a new
maintenance building will be constructed. As part of this project, existing roads will be
graveled and sewer and water infrastructures will be brought up to current standards. I
would like to have 3 years to complete this project. The property is described as Pt of
Government Lots 8 & 9, (63.40 AC), Section 6 of Sverdrup Township: Pleasant Lake (56-
449), RD.
Allen Chase and David Anderson (Anderson Land Surveying) represented the Application.
Aden Johnson expressed concerns regarding the proposed number of units and the
proposed lake setbacks. Allen Sundby expressed concerns regarding lake size, lake
traffic, and safety. Harry Krog expressed concerns regarding future development on
Pleasant Lake, lake depth, waterfowl, and the future of the Lake. Norma Jensen
expressed concerns regarding structure setbacks, watercrafts, and the size.
Motion: A motion by Erickson, second by Wilson to approve with the following conditions:
1. The buildings and structures that have been indicated to be removed, must be removed
prior to starting any new construction . 2. The existing road must be relocated to the
easterly side of the proposed 7 westerly RV sites: Land & Resource must approve the road
relocation / construction plan. 3. To allow 3 years to complete the project provided Land &
Resource receives a detailed plan outlining project phasing. Voting: All members in favor,
except Kinzier.

Motion by Erickson, second by Lindquist, to deny a Conditional Use Permit to erect a 70' wind tower
and turbine for electrical generation at the Daniel & Betty Strang property as presented. Chairman
Erickson called for a roll call vote. The motion failed with Lindquist and Erickson in favor, Huebsch
and Froemming opposed and Rogness abstaining.
In consideration of the 80' wind tower request at the Wegscheid property, discussion took place
regarding tabling the request. Motion by Huebsch, second by Froemming, and carried with Erickson
opposed, to table the Conditional Use Permit requests of Daniel & Betty Strang and Thomas S
Georgette Wegscheid until October 1, 2009, with agreement from the applicants to waive the 60-day
notice rule. Tabling will allow time to provide direction on how to apply the guidelines. The CUP
requests will be scheduled for reconsideration at the County Board meeting on September 29, 2009.

The Planning Commission recommended denial of both requests. He conveyed the message from
the Planning Commission that the 16 considerations in the Shoreland Management Ordinance when
determining approval of a Conditional Use Permit may not be adequate or speciflc enough for the
consideration of putting up wind towers. 'They suggested that the County Board develop guidelines
for consideration of wind lowers in the shoreland area and place a moratorium on towers until the
guidelines can be developed. _ Commissioner Lindquist spoke in favor of a moratorium.
Commissioner Rogness was opposed to a 6 month moratorium. Commissioner Huebsch spoke in
opposition of a moratorium because wind towers are being supported at the federal and state levels
and Otter Tail County needs to be a part of the economic development. Commissioner Froemming
offered his observations of a local farmer's wind tower and noted that there was no noise. County
Attorney, David Hauser, stated that this can be studied without a moratorium and that people who
have applied for a CUP must be considered based on the rule at the time of application.
Commissioner ^uebsch visited the Daniel and Betty Strang site and attended the local Lake
Improvement District annual meeting and no one was opposed to their request for a wind tower. He felt it should not ^e denied simply based on the fact that it is near a lake. Applicant Daniel Strang
urged the County Board to approve the request and responded to the reasons for denial identified by
the Plarining Commission and noted that timing is important because of State funding.

structure to be placed onsite. 4. The potential for adverse impact on a sensitive area. 5.
The noise creating a disturbance, potentially 24 hours a day. 6. The hours of proposed
