A variance is requested to have said Lot 13, a substandard back lot by current ordinance,
declared a buildable lot. The lot met (and exceeded) the minimum requirement of the
ordinance in effect when the plat was developed in 1972, but due to a 1992 ordinance
change, the lot is now considered a non-buildable substandard back lot. A special
assessment has recently been attached to the lot for "street improvement"—a blacktop road.
I UNDERSTAND THAT I HAVE APPLIED FOR A VARIANCE FROM THE REQUIREMENTS OF THE SHORELAND
MANAGEMENT ORDINANCE/SUBDIVISION CONTROLS ORDINANCE OF OTTER TAIL COUNTY.
I ALSO UNDERSTAND THAT OTHER PERMITS MAY BE REQUIRED, IT IS MY RESPONSIBILITY TO CONTACT LAND &
RESOURCE MANAGEMENT REGARDING THIS MATTER.

Ray E and Darlene C Guggisberg - Approved the variance as requested. (8:13 p.m.)
After consideration and discussion, Steve Schierer made a motion, seconded by Michael Conlon and unanimously
carried, to declare Lot 13 Block 2, Juniper Hills as a buildable lot. The variance as approved provides the applicants
with an ability to enjoy the same rights and privileges as other in this immediate area and is consistent with previous
Board decisions.

' Ed and Helen Lenius - Denied. (7:50 p.m.)
Ed and Helen Lenius, Lots 2 and 3 Block 3, Lenius Beach and part of Government Lot 3 and 4, Section 2
of Edna Township by Little McDonald Lake, requested a variance to split Lot 3, Block 3 Lenius Beach;
attach approximately (5,990 square foot) to Lot 2, Block 3 to make that lot meet minimum size
requirement and permanently attach remainder of Lot 3 (7,508 square feet) to back lot. The remainder of
Lot 3 would never be built on. Matt Lenius appeared along with the applicants at the public hearing.
Randall Mann, Chair, polled the audience with David and Joan Covington and Ron Anderson expressing
concerns with the variance as requested and seeking information as to the planned use of the back lot
property. A letter from David R and Joan L Covington was noted for the record, and letters form Roger A
Neitzke, Clayton M Hokanson and Irene Schultz in opposition to the variance as requested were read for
the record. After consideration and discussion, Steve Schierer made a motion, second by Cecil Femling
and unanimously carried to deny the variance as requested as no adequate hardship unique to the
property had been shown by the applicant that would allow for the granting of the variance as requested
and the granting of the variance as requested would establish precedence that the Board does not wish to
establish by creating a substandard lake lot and by providing lake access to a back lot.
David D Oeifke - Approved the variance as requested with the exception of the side lot line
variance for the storage shed. (8:05p.m.)
David D Oeifke, Lot 3 Pebble Bay, West Leaf Lake in Leaf Lake Township, requested a variance of 25’
from the required ordinary high water level setback of 100’ and a variance of 5’ from the required side lot
line setback of 10’ for the construction of an 8’ by 12’ or a 10’ by 12’ shed 75’ from the ordinary high water
level and 5’ from the lot line. Also, requesting a variance of 62’ from the required ordinary high water level
setback of 100’ for raising an existing dwelling located 38’ from the ordinary high water level. Randall
Mann, Chair, polled the audience with no one speaking for or against the variance as requested. After
consideration and discussion, Cecil Femling made a motion, seconded by Steve Schierer and unanimously
carried, to approve a variance of 25’ from the required ordinary high water level setback of 100’ for the
construction of an 8’ by 12’ or a 10’ by 12’ shed 75’ from the ordinary high water level, 20’ from the road
right-of-way and 10’ from the side lot line and to approve a variance of 62’ from the required ordinary high
water level setback of 100’ for raising, by two rows of blocks, the existing dwelling which is located 38’ from
the ordinary high water level.
