Motion Robert and Joy Gallagher - Denied Motion was made by Steve Schierer to approve the variance as requested with the condition that before either lot can be consider buildable the lots must be clean up. Meaning the abandoned mobile home and other materials must be removed. This motion died for lack of a second. After additional discussion, a motion was made Randall Mann to approve the lots as buildable lots, but only for non-dwelling structures. This motion also died for lack of a second. Allen and Margaret Mashek, Elbow Lake, MN, requested the following: “1) request a zero setback to road right-of-way for replacement dwelling. A portion of the deck will be into the road right-of-way at 14 feet. 2) Would like to add addition to existing garage, which will extend into road right-of-way not more than 6 feet. 3) The proposed new dwelling would extend over the existing east lot line. The adjoining west of lot 3 has been surveyed and we propose to split the west 14 of lot 3 and permanently attach it to lot 4. This would allow the proposed new dwelling to meet the 10-foot lot line setback. The existing cabin on the west 14 of lot 3 will be removed. At that time the survey can be finalized and recorded.” The property is described as Lot 4, Block 1 and the west half of Lot 3, Block 1, Marheine’s Camp Corliss First Addition, Clitherall Lake in Clitherall Township. Mike Foertsch appeared along with the applicants at the public hearing. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Randall Mann to approve the variance as requested with the following conditions: that written approval from the appropriate road authority for the placement of the proposed project within the road right-of-way must be received, that the proposed garage must be no larger than 24’ by 26’, that the dwelling must be constructed exactly as depicted on the applicants’ drawing and that no more than 25% of the total lot area can be covered with imperious surfaces. This motion died for the lack of a second. After additional consideration and discussion, motion was made by Steve Schierer, second by Les Estes and carried with Randall Mann and David Holmgren voting no to deny the variance as requested noting that approving the variance as requested would placed new construction within the road right-of-way and noting that the applicants’ proposed project is over development for a lot of this size. Paul R. Jr. and Janice Vincent - Approved as requested. Paul R. Jr. and Janice Vincent, Moorhead, MN, requested the following: "remove old existing deck board’s leaving rim joist’s and floor joists. Not increasing size of original deck and replacing top deck board’s with new treated lumber. Older boards were a safety hazard as this was and is the only other exit in case of an emergency. This improvement is for upper deck only.” It should be noted that the upper deck is 16’ from the ordinary high water level. The property is described as Lots 9 and 10, Lone Pine Beach, Sybil Lake in Dora Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by David Holmgren, second by Steve Schierer, and unanimously carried, to approve the variance as requested noting the need to repair and maintain the existing deck for safety reasons. Robert and Joy Gallagher - Denied Robert and Joy Gallagher, Bonners Ferry, ID, requested a variance to have substandard back lots by current ordinance standards declared buildable lots. The applicants lots met the requirement of the ordinance when the plat was developed in 1972, but due to a 1992 ordinance change the lots are now considered non- buildable substandard back lots. The property is described as Lots 1 and 3, Block 2, Juniper Hills, Marlon Lake in Dead Lake Township. Milt Paulson represented the applicants at the public hearing. Letters from Richard and Janet Howells and David L. Grinnell opposing the applicants’ request were read for the record. The audience was polled with Dale Metz speaking against the request and with Darlene Guggisberg expressing concerns with how the ordinance addresses lots platted between 1972 and 1992.
