I applied for a variance from the sldeyard setback and on April 12, 2001 my request was denied. I have attempted to purchase a small triangle parcel from my neighbor but he has refused. Depending on the outcome of this variance application my neighbor will grant me an easement as shown on the attached exhibit which will allow me to extend my 10 foot sldeyard Into his property. I have been given estimates of between $10,000.00 and $15,000.00 to move my cabin the 6.1 feet to the east. My request Is a variance to allow the easement to be calculated into the 10 foot sldeyard calculation. Darlene Kalenda, St. Francis, MN, requested a variance of approximately 100’ from the required ordinary high water level setback of 200’ for the construction of a 30’ by 48’ storage structure approximately 100’ from the ordinary high water level. The property is described as a 9.5-acre parcel in Government Lot 12, Section 18 of Parkers Prairie Township by Nelson Lake. A letter from Lloyd W. and Severty M. Paulson in support of the variance as requested was read for the record. Don Beltram appeared along with the applicant at the public hearing. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Steve Schierer, second by David Holmgren and unanimously carried, to approve a variance of approximately 100’ from the required ordinary high water level setback of 200’ for the completion of the construction of a 30’ by 48’ storage structure in it present location which is assumed to be approximately 100’ from the ordinary high water level with the condition that the existing machine shed, identified as structure “E” on the applicant’s drawing must be removed on or before June 1, 2002. Hardship is the terrain of the applicant’s property, which has water on three sides. It was noted that the variance as approved is an improvement as it does eliminate a structure, which is closer to the water than the proposed structure. Carol J. Weis - Approved as requested. Carol J. Weis, Perham, MN, requested the installation of a mound system on Martin’s Perfect Beach 250’ from Big Pine Lake, 25’ from the road right-of-away and 20’ from the lot line. A 20’ by 50’ area 6” deep will be filled with 60 yards of fill to create the 2’ separation required for a mound system. Requesting a variance of 6” from Otter Tail County’s Sanitation Code requirement of a 2’ separation between existing elevation and water table/mottling or ordinary high water level. It should be noted that the State of Minnesota requires only a T separation. The property is described as Lot 4, Block 1 Nelson’s Perfect Beach and Part of Reserve Lot A, Martin’s Perfect Beach, Big Pine Lake in Corliss Township. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by Randall Mann, second by Steve Schierer and unanimously carried, to approve a variance of 6” from the Otter Tail County’s Sanitation Code requirement of a 2’ separation between existing elevation and water table/mottling or ordinary high water level for the purpose of installing a mound system by the filing of a 20’ by 50’ area 6” deep with 60 yards of fill to create the required 2’ separation. It was noted that the granting of the variance as requested will provide the applicant with the ability to enjoy the same rights and privileges as others in the immediate area and will also provide the applicant with a reasonable use of her property. Janice E. Michels - Approved as requested. Janice E. Michels, Breckenridge, MN, requested a variance of 43’ from the required ordinary high water level setback of 100’ for a second level addition to an existing cabin 57’ from the ordinary high water level. The property is described as Lot 8, Birch Haven, South Turtle Lake in Sverdrup Township. Kevin Michels appeared along with the applicant. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by David Holmgren, second by Linda Bergerud and unanimously carried, to approve a variance of 43’ from the required ordinary high water level setback of 100’ for a second level addition to an existing cabin 57’ from the ordinary high water level. Hardship is a substandard lot of record. It was noted that the applicant’s property has been significantly impact by the current high water level. David J and Lynn M. The letter noted that the applicants have not been granted an easement and that they have no plans to grant the applicants an easement. The audience was polled with no one speaking for or against the request. Lorraine Hicks - Tabled Lorraine Hicks, Fergus Falls, MN, requested the following: as shown in the site plan drawing on file with the County we wish to add onto the existing structure, which was built pre-ordinance in 1935. The new addition shall be no closer to the ordinary high water level than the existing structure, or approximately, 38’, therefore, requiring a variance of 162’ from the required ordinary high water level setback of 200’. It should be noted that the applicant owns approximately 360’ of shoreline covering six lots, the plot contains a wetland and the site of the septic system leaves little choice on the placement of this request. The applicant would like to develop the wetland area into a natural habitat area and is prepared to consider making part of the shoreline into a natural frontage. The property is described as Lots 4, 5, 6, 7, 8 and 9, Fish Lake Beach, Fish Lake in Aurdal Township. Anthony Hicks appeared along with the applicant at the public hearing. The audience was polled with Clifford and Margie Ringquist speaking in favor of the applicant’s request. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to table, with the verbal agreement of the applicant, this public hearing until the next scheduled meeting of the Board of Adjustment so that the applicant will have an opportunity to consider other possible alternatives for the proposed development. Thomas O’Donnell - Approved as modified. Thomas O’Donnell, Port Richey, FL, requested a variance for 12” to 0” in about 15 running feet for a garage foundation that is already installed. The existing house was at a slight angle, which caused this problem. The corner of new foundation towards the lake is over IT. The property is described as Lots 2 and 3, Klein and Adams Point, Marion Lake in Dead Lake Township. Floyd Barrett represented the applicant at the public hearing. The audience was not polled, as there was no one in attendance at the time of this variance hearing. After discussion and consideration, motion was made by David Holmgren, second by Steve Schierer and unanimously carried, to approve a variance of 10” from the required side lot line setback of 10’ for the placement of the garage foundation 9’ 2” from the lot line. David & Lynn Quincer I am the owner of the adjacent Lot 5 on Marion Lake. David and Lynn Quincer and their four children are a very amiable and concerned family who have worked very hard to establish a home on Marion Lake. Because of the configuration of the lots in our area (in that some of the side property lines run at an acute angle to the road rather than at a right angle) an honest mistake was made in the placement of their home. It would indeed be a disservice to them to require that this two-story home be removed and a new foundation and necessary hook-ups done for such a small iniraction.. They have tried very hard to do all they can to rectify this problem; their home is not creating a problem for any other homes and the cost would be too prohibitive to justify this move. The Quincers are very good people and we certainly welcome them to our neighborthood. I would request that you give careful consideration to granting a variance to allow this home to remain in its present location so they can get on with the necessary settling and finishing to their property.
