Nancy Austin-Bell - Approved the proposed development with conditions. (6:02 p.m.)
After consideration and discussion, Steve Schierer made a motion, second by Thomas Lee and unanimously carried, to approve a
3' variance from the required side lot line setback of 10', a 28’ variance from the required ordinary high water level setback of 75’
and a variance of 3’ from the required shore impact zone setback of 50’ for the proposed second story development as described
in the variance application dated June 1, 2009 and as depicted on the drawing submitted with the application with the condition
that impervious surface coverage must be reduced to 25% or less before a site permit for the proposed development can be
issued and with the condition that the variances as approved do not directly or indirectly grant any variances for the septic system.
It should be noted that impervious surface coverage cannot exceed 25% after the proposed development is completed.
Hardship/practical difficulty is a grossly substandard lot of record.

The Otter Tail County Board of Adjustment met Thursday, July 2, 2009, with the following persons in attendance:

Called to Order - Randall Mann Chair called the meeting of the Board of Adjustment to order at 6:00 p.m.
Minutes Approved - The Board of Adjustment approved the minutes of the June 4, 2009 meeting as mailed.
The Board of Adjustment considered the following applications for variance:
Nancy Austin-Bell - Approved the proposed development with conditions. (6:02 p.m.)
Nancy Austin-Bell, Lot 9 of the First Addition to Klein and Adams Point, Marion Lake in Dead Lake Township,
requested the following: To north lot line a variance of 3’ from 10’ setback to lot line. Shore impact zone a variance of
3’ from 50' setback. A 28’ variance from 75’ setback from lake. Impervious surface is at 28% to remain unchanged.
The proposal is in the string line. This is a second story on a portion of the existing cabin not to exceed 22’ in height.
Jeff the applicant’s husband appear with the applicant at the public hearing. The audience was polled with no one
speaking for or against the variance as requested. After consideration and discussion, Steve Schierer made a
motion, second by Thomas Lee and unanimously carried, to approve a 3’ variance from the required side lot line

John P and Susan M Donelan - Denied (6:12 p.m.)
John P and Susan M Donelan, part of Government Lot 2, Section 25 of Everts Township by West Battle Lake and an
urban/tributary creek, requested a variance to subdivide 3.2 acres from an existing 11.43 acres parcel. The minimum
size for metes and bounds parcels in the shoreland area is 5 acres. The audience was polled with Clem Hendrickson
speaking for the variance as requested. After consideration and discussion, Steve Schierer made a motion, second
by Thomas Lee and unanimously carried, to deny the variance as requested as no adequate hardship/practical
difficulty had been shown that would allow for the granting of the variance as requested as the applicants have the
ability to subdivide their property through the Planning Commission review and platting process.
Judy Seifert - Approved the ordinary high water levei variance as requested with a condition.

Judy Seifert, Lot 1 Engstrom Beach Third Addition, West McDonald Lake in Edna Township, requested a variance of
25’ from the required ordinary high water level setback of 100’ and a variance of 6’ from the required side lot line
setback of 10’ for the placement of 12’ by 12' shed 75’ from the ordinary high water level and 4' from the side lot line.
Also, asking for 9’ to 1’ variance from 10’ septic setback (shed to be 9’ to T from septic tank and drain field - depends
on preference of the Board). Tom Seifert represented the applicant at the public hearing. The audience was polled
with no one speaking for or against the variance as requested. After consideration and discussion, Michael Harris
made a motion, second by Thomas Lee and unanimously carried, to approve a variance of 25’ from the required
ordinary high water level setback of 100’ for the placement of a shed 75’ from the ordinary high water level and to
deny all other variances as requested for the proposed development with the condition that no more than 25% of the
total eligible lot area can be covered with impervious surfaces. It should be noted that the variance as approved does
not directly or indirectly grant any other variances for the proposed development.
