Depending on the outcome of this variance application my neighbor will grant me an easement as shown on the drawing on file, which will allow me to extend,; by 10’ side yard into his property. I have been given estimates of between $10,000 and $15,000 to move my cabin the 6.1’ to the east. My request is a variance to allow the easement to be calculated into the 10’ side yard calculation. The property is described as Lot 4, Block 1, Juniper Hill, Marion Lake in Dead Lake Township. Luther P. Nervig, Attorney, appeared along with the applicant at the public hearing. A letter from Virginia Grabarkewitz in support of the variance as requested was.read for the record. A letter from Marvin and Jean Donlan was read for the record. The letter noted that the applicants have not been granted an easement and that they have no plans to grant the applicants an easement. The audience was polled with no one speaking for or against the request. After discussion and consideration, motion was made by David Holmgren, second by Randall Mann and carried with Mark Steuartwoting no, to approve a variance of 6.T from the required side lot line setback of 10’ for the present location of an existing dwelling 3.9’ from the lot line at its nearest point. It was noted that the applicants have been unsuccessful in their attempts to acquire all or part of the adjacent property and that the estimates have indicated that it would be very costly to move the dwelling the additional 6.T needed to meet the required side lot line setback. Therefore, the granting, of a side lot line variance by the Board of Adjustmentisjjustifiable when considering the applicants’ attempts to obtain additional property and the prohibitive .cost to move the dwelling the additional 6. T. Hardship is the terrain of the property. Lorraine Hicks - Tabled Lorraine Hicks, Fergus Falls, MN, requested the following: as shown in the site plan drawing on file.with the County we wish to add onto the existing structure, which was built pre-ordinance in 1935. The new addition shall be no closer to the ordinary high-water level than the existing structure, or approximately, 38’, therefore, requiring a variance of 162’ from the required ordinary high water level setback of 200’. It should be noted that the applicant owns approximately 360’ of shoreline covering six lots, the plot contains a wetland and the site of the septic system leaves little choice on the placement of this request. The applicant would like to develop the wetland area into a natural habitat area and is prepared to consider making part of the shoreline into a natural frontage. The property is described as Lots 4, 5,.6, 7, 8 and 9, Fish Lake Beach, Fish Lake in Aurdal Township. Anthony Hicks appeared along with the applicant at the public hearing. The audience was polled with Clifford and Margie Ringquist speaking in favor of the applicant’s request. After discussion and consideration, motion was made by Steve Schierer, second by Cecil Femling and unanimously carried, to table, with the verbal agreement of the applicant, this public hearing.until the next scheduled meeting of the Board of Adjustment so that the applicant will have an opportunity to consider other possible alternatives for the proposed development. Thomas O’Donnell - Approved as modified. Thomas O’Donnell, Port Richey, FL, requested a variance for 12” to 0” in about 15 running feet for a garage foundation that is already installed. The existing house was at a slight angle, which caused this problem. The corner of new foundation towards the lake is over IT. The property is described as Lots 2 and 3, Klein and Adams Point, Marion Lake in Dead Lake Township. Floyd Barrett represented the applicant at the public hearing. The audience was not polled, as there was no one in attendance at the time of this variance hearing. After discussion and consideration, motion was.made by David Holmgren, second by Steve Schierer and unanimously carried, to approve a variance of 10” from the required side lot line setback of 10’for the placement of the,garage foundation 9’ 2” from .the lot line. October 2, 2000 Re: Tom and Linda O’Donnell Property, Marion Lake To Whom It May Concern: On September 25, 2000 I was requested to visit the Tom and Linda O’Donnell property located at Fire Number 118 on Marion Lake. At that time, I was requested to review options to increase their usable square footage of the property. In reviewing the existing structure, it appears that the concrete block foundation and concrete footings are inadequate to support a second story addition to the existing building. The existing concrete footings are not sized properly to support the increased weight and load bearing requirements of a second floor structure, and the concrete foundation wall and concrete footings are only located approximately 2’-0” below existing grade. State Building code requires 5’-0” frost protection on foundation construction located within this area of the state. If you have any questions or concerns, contact our office at 218-346-4505. He has explained fully the proposed addition which would be constructed on top of the current structure. Though we have yet to build on our lot, it is my understanding that we could build no closer to the lake than a line running from the nearest corner of our northern neighbor’s house to the nearest corner of the O’Donell’s house. Though 1 would have no objection to the O’Donell’s using the new line which will exist between our house and their neighbor’s house to the south, as I understand their plans, they will not build any closer to the lake than their current structure. Though I may have misunderstood or mistated our interpretation of the regulations, I would very much like to encourage the improvement to Tom’s property as he envisioned it and explained it to me. I would have no objections to their being granted a variance to allow this construction to occur. If I have misdirected this letter, please redirect it to the appropriate individual.
