Tiae previous structure destroyed by fire had been built into a ’’slot” cut into v;hat appears to be an old historic ice ridge. Tne ice ridge is 30-35 ft. wide at the base and is 8-10 ft. high. According to Mr. Conn, the main portion of the structure destroyed was 24 ft. from the ordinary higii water mark. Additionally there was an 8 ft. wide deck on the lakeside there by placing tile structure 16 ft. from the ordinary high water mark. Upon examining the site, it appeared at least 3 alternatives are available as follows: 1) A new structure could be built 125 ft. from the lake, directly north, i.e. in back of the structure destroyed by fire. It would necessitate cutting out more of tlie ice ridge, for a better wide angle view of the lake, (perhaps at a 45° angle from the two lakeward comers of the new structure) . Tlie material cut by widening the ice ridge could be used to berm the house as Mr. Conn proposes to do. Additionally all exist ing utilities including the road, electric, telephone and drainfield could still be used with only minor modification. It would require a house design and location other than that preferred by Mr. Conn, and it would not fully meet the lake setback requirement. 2) The second alternative is to meet the setback requirement of 200 ft moving directly back from the old structure site. This v/ould provide a view of the lake to the v/est of the existing site and could provide a view to the south, through the "slot", v/hich could be improved by cutting more of tlie ice ridge do’.m. I believe existing utilities could be utilized with perhaps a little more effort than in the first alternative. Again material from widening of the ice ridge "slot" could be utilized in the construction of the new house. • > AN EQUAL OPPORTUNITY EMPLOYER Page 2 December 1, 1983 3. Tbe third alternative would involve building at an entirely new loca tion on the % mile of shoreline frontage available, and fully meet the 200 ft. setback requirement. This would require extensive new road building, a new sewer system and major changes in the other existing utilities. It would create the greatest financial hardship on the owner. However, it is an alternative. In our judgement it appears a reasonable compromise exists by designing a struc ture and doing some landscaping behind the destroyed structure which v;ould re sult in only minor changes for existing utilities and still approach a more reasonable setback. Although it is unfortunate the structure was lost by fire, most of the reason to rebuild on the existing site seem.s to be financial and personal preference in nature. The precedent setting nature of granting this variance as requested has implications for future development on this lake and other lakes in the county.
