County of Otter Tail Court House Fergus Falls, Minnesota 56537 Dear Mr. Kalar: After our conversation on Thursday afternoon regarding our wildlife ponds at Dead Lake I decided that I would call Jerry Neseth and see if he could appear for me and answer any questions that the planning commission might have. However, he is busy at a meeting in Hackensack that evening so he would not be able to attend. When I talked to Jerry he said he had given you copies of the ponds, etc. I am marking the general area of the two ponds on a picture of an aerial and would appreciate it if you would submit this to the planning commission. It seems to me that the whole thing is pretty self-explanatory and that they would be able to act on it one way or the other and it would not be necessary for me to make a 400 mile trip to Fergus Falls to be at the hearing, even if I wasn't going to be out of the country in Norway September 10 - 25. Jerry said he would be in his office (218-346-2050) Monday, September 13, and would probably be able to answer any questions that you might have. I am enclosing a copy of this letter and one for the planning commission. I will also send one to Jerry Neseth. The reason I would like to move this along is because the contractor is suppose to be ready to go in any time and I have to get it done this fall because my cost sharing is only good through December. The project would involve the creation of 2 wildlife ponds and 3 other wetland restoration projects. These all would be located in wetlands near the west end of Dead Lake in Otter Tail County. It is our understanding that the wildlife ponds have been designed by the U.S. Soil Conservation Service and the wetland restoration work has the support of the U.S. Fish and Wildlife Service. The general work locations are shown on the attached map. We have determined that these activities are eligible for authorization by a new Department of the Army nationwide permit. However, we recommend that the side slopes on the wildlife ponds be flattened, such as to 7 to 1, on all sides. We also recommend that wetland disturbance be minimized by the use of upland disposal, if practicable. In addition, because Section 401 Water Quality Certification for this nationwide permit has been denied by the Minnesota Pollution Control Agency (MPCA), you must obtain approval from the MPCA in order for the nationwide permit to authorize your project. You may consider your project authorized by the nationwide permit when you have received a Section 401 certification or waiver from the MPCA.
