John Ramacher - Withdrawn
John Ramacher. Maple Grove, MN, requested the following variances: 1.) minimum lot area be waived due to
lot size, 2.) ordinary high water level setback waived as bluff set back is more restrictive, 3.) a top of bluff
setback of 25' instead of the required 30' setback, 4.) a road right-of-way setback of 15' instead of the
required 20' setback, and 5.) extend the maximum landing area to 50 square feet instead of 36 square feet.
The property is described as Lots D and E. Lillis Survey Plat of Government Lot 2, Dead Lake in Dead Lake
Township. Letters opposing the granting of this variance request from the following were read for the record:
Michael Schantzen. Ernest and Rhea West and the Dead Lake Property Owners Association. The audience was
polled with James Salness expressing the concerns of the Dead Lake Property Owners Assxiation. After
consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to table
the applicant's request until the April 7th, 1994 Board of Adjustment meeting for the purpose of obtaining
additional measurements. After additional consideration the applicant has decided to withdraw his request.
Don R. Plombon - Withdrawn
Don R, Plombon, St. Cloud, MN. requested a variance of 25' from the required ordinary high water level
setback of 75' for the location of a dwelling 50' from the ordinary high water level. The property is described
as Lot 9. Block 2, Pleasure Park, Otter Tail Lake in Otter Tail Township. The applicant requested prior to the
meeting that his variance request be tabled until the April 7th, 1994 Board of Adjustment meeting. After
consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried, to table
this variance request until theApril 7th, 1994 Board of Adjustment meeting. After additional consideration
the applicant has decided to withdraw his request.

After ocditional consideration, motion was made by Craig Anderson, seconded by John Everts and carried with
Randall Mann abstaining, to approve the subdivision of the existing 2.42 acre parcel as per the plan submitted
by Mr Berry at the April 7th, 1994 Board of Adjustment meeting with the condition that a registered
surveyor's drawing will be provided at the time of recording. It should be noted that parcel three is reasonably
close to the required size for platted back lots on a general development lake. The granting of this variance
allows for the straightening of property lines and provides a reasonable use of the property.
Mary Ann Tompkins - Approved
Mary Ann Tompkins. Minnetonka. MN. requested a variance of 120' from the required ordinary high water
level s-etback of 200' and a variance of 20' from the required shore impact zone setback of 100' for the
construction of a 12' by 36' addition to an existing structure approximately 80' from the ordinary nigh water
mark. The existing building line is being maintained. The property is described as the south 30' of
Government Lot 10 and all of Government Lot 1 1. Section 31 of Candor Township on Otter Lake. The applicant
was represented at the hearing by Dale Wussow. D&W Construction. Inc, The audience was polled with no one
speaking for or against the request. After consideration, motion was made by Carl Johnson, seconded by Cecil
Femlingand unanimously carried, to table the applicant's request until the April 7th, 1994 Board of
Adjustment meeting for the purpose of determining if the granting of this variance request would hcve any
affect on the bluff impact zone or bluff setback requirements. The applicant was represented at the April 7th
hearing by Dale Wussow, D&W Construction, Inc. It has been determined that the property is not affected by a
bluff. After consideration, motion was made by Craig Anderson, seconded by Randall Mann and carried with
Cecil Femling and Carl Johnson voting no and with Randall Mann abstaining, to approve a variance of 120' from
the required ordinary high water level setback of 200' and a variance of 20' from the required shore impact
zone setback of 100' for the construction of a 12' by 36' addition to an existing structure approximately 80'
from the ordinary high water mark. The addition will be no closer to the lake than the existing structure.
Edwin A. Krause - Approved
Edwin A. Krause, Faribault. MN, requested a variance of approximately 5' from the required 20' road right-
of-way setback for the construction of a 24' by 32' structure 15' from the road right-of-way, The property
is described as Lot 3, Block 2, Pioneer Acres, Rush Lake in Rush Lake Township. The audience was polled with
no one speaking for or against the request. The applicant requested prior to the meeting that his variance
request be tabled until theApril 7th, 1994 Board of Adjustment meeting. After consideration, motion was
made by John Everts, seconded by Craig Anderson and unanimously carried, to table this variance request until
- the.April 7th, 1994 Board of Adjustment meeting. After consideration, n.ction was made by Craig Anderson,
seconded by Cecil Femling and carried with Randall Mann abstaining, to approve a variance of 5' from the
required 20' road right-of-way setback for the construction of a 24' by 32' structure 15' from the road
right-of-way. The granting of this variance allows the applicant the same rights and privileges as his
neighbors.

Robert S. Berger - No Hearing.
Robert S, Berger. St, Louis Park, MN, requested a variance to change the ordinary high water level setback
from the required 200' to 150' for Lots B, C. J, K, L, and M of a proposed metes and bounds development. The
property is described as Government Lots 1.2, 3 and part of Government Lot 4, Section 31 of Maine Township
on West Lost Lake. No hearing was held on this variance request as the request is the same as a variance
request that was acted upon by the Board of Adjustment in July of 1 992.

ordinary high water level setback of 100' and a variance of approximately 20 to 30' from the required shore
impact zone setback of 50' for additions to cabins 3, 4 and 5 of Ethel Beach Resort located approximately 20 to
30' from the ordinary high water level mark. The property is described as Lots 1,2. 3 and 4, Ethel Beach,
Ethel Lake in Girard Township. The audience was polled with no one speaking for or against the request. After
consideration, motion was made by John Everts, seconded by Craig Anderson and unanimously carried to
approve a variance of approximately 70 to 80' from the required ordinary high water level setback of 100"
and a variance of approximately 20 to 30' from the required impact zone setback of 50' for additions to cabins
3. 4, and 5 of Ethel Beach Resort located approximately 30' from the ordinary high water level mark. It
should be noted that the additions will be no closer to the lake than the existing structure and that no other
variances are required for these additions.

Donald E. and Barbara A, Halverson, Rapid City. SD, requested a variance to exceed the maximum height of a
dwelling by 9 1/2 feet. The maximum height of a dwelling is 30’. The property is described as part of
Government Lot 5, Section 21 of Everts Township on Silver Lake. The audience was not polled as there was no
one in attendance at the time of this hearing. After consideration, motion was made by Carl Johnson, seconded
by Craig Anderson, and carried with George Walter voting no and with John Everts abstaining, to allow the
applicants to exceed the maximum height requirement of 30' by 7.5' for the construction of a dwelling 37.5' in
height. The structure will be built in a low area and will not obstruct vision.
