It was noted that the side lot line setbacks are being maintained. Hardship is a substandard lot of record. It was noted that the granting of a variance for the second story would cause a substandard situation to become more substandard. Tillman Cornell Opsal - Denied Tillman Cornell Opsal, Safford, A2, requested a variance of approximately 1’ from the required Northwest lot line setback of 10’ and a variance of approximately 6’ from the required Northeast lot line setback of 10’ for the placement of a holding tank 9’ from the Northwest lot line and 4’ from the Northeast lot line and a variance of approximately 130’ from the required ordinary high water level setback of 150’ for the placement of a holding tank approximately 20’ from the ordinary high water level. The property is described as part of Government Lot 6, Section 32 of Everts Township by Elbow Lake. The audience was polled with Darrel Gedde, Edward Houge, Steve Morrill and Deb Zachmann speaking against the applicant’s request. A petition signed by Ellen Johnson, MarJean Martelle and Carol Thompson in support of the applicant’s request was presented to the Board for their consideration. Clem Hendrickson, Surveyor, presented a recent survey of this area for general information. After discussion and consideration, motion was made by Cecil Femling, seconded by Robert Schwartz and unanimously carried, to deny the variance as requested as the applicant’s proposed location is not an adequate area for the placement of a holding tank. Conrad Dale Rowe - Approved Conrad Dale Rowe, Richville, MN, requested a variance of approximately 3 to 5’ from the required side lot line setback of 10’ for the construction of a 24’ by 24’ garage with one 10’ by T door, one 3’ standard entrance door and a concrete approach either 8’ by 15’ or 10’ by 15' with the westerly side of the garage located approximately 5 to 7’ from the side lot line. The property is described as Lot 6, Adams Beach, Otter Tail Lake in Amor Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Craig Anderson, seconded by Randall Mann and unanimously carried, to approve a 5’ setback from the septic tank, which should line the 24’ by 24’ garage up with the west side of the existing home. It was noted that the variance from the septic tank is being granted against an unoccupied building. Todd Baribeau - Approved Todd Baribeau, St. Paul, MN, requested a variance of approximately 45’ from the required ordinary high water level setback of 150’ for the placement of a septic tank approximately 105’ from the ordinary high water level. The property is described as Lot 8, Lillis Survey Plat, Dead Lake in Dead Lake Township. The audience was polled with John Minge, Attorney, speaking to the variance application and representing the adjacent neighbors (Don and Mitzi Pederson and Mark and Barbara Steuart). Wally Senyk, County Attorney, provided general information and information concerning a recent court case for consideration by the board and for the consideration of those in attendance. After discussion and consideration, motion was made by Craig Anderson, seconded by John Everts and unanimously carried, to approve a variance of 45’ from the required ordinary high water level setback of 150’ for the placement of a septic system 105’ from the ordinary high water level and up to the road right-of-way, as approved by the township on May 17,1997, subject to the submission and review of a site evaluation plan. Charles S. MacFarlane - Denied Charles S. MacFarlane, Fridley, MN, requested a variance to place a water - oriented accessory structure 5’ from the common property line between Lots 11 and 12. The Board of Adjustment did approve, at their September 14, 1995, meeting, a water - oriented accessory structure being at least 10’ from the dwelling, at least 20’ from the ordinary high water levels, having no more than 10’ in height, having no more than 20’ in width, having no more than 260 square feet of area and having no easterly exposure to Lots 12, 13 and 14. The property is described as Lot 11, Cedar Park Club, Swan Lake in Dane Prairie Township. The audience was polled with no one speaking for or against the request. After consideration, motion was made by Robert Schwartz, seconded by Craig Anderson and unanimously carried, to deny the variance as requested and to make no modifications to the variance as approved by the Board of Adjustment on September 14, 1995. Brian Huseth - Denied Brian Huseth, Underwood, MN, requested a variance of approximately 10’ from the required top of bluff setback of 30’ for the placement of a 10’ by 20’ deck approximately 20’ from the top of the bluff. The property is described as Lot 5, Stalker View Acres, Stalker Lake in Tordenskjold Township. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made by Randall Mann, seconded by Cecil Femling and unanimously carried, to deny the variance as requested as the proposed deck would be in a very fragile area and no adequate hardship has been shown. It was noted that the development on this lot is very recent and that the location of a deck should have been considered when the dwelling was being planned. Craig Duane Nelson - Approved Craig Duane Nelson, Pelican Rapids, MN, requested a variance to subdivide a 2.5 acre parcel, for a building site, from an existing 4.6 acre parcel. The 2.5-acre parcel would not have any water frontage. The applicant would retain the balance of the parcel. The property is described as part of Government Lot 1, Section 14 of Pelican Township by Prairie Lake. The audience was polled with no one speaking for or against the request. After consideration and discussion, motion was made Craig Anderson, seconded by Cecil Femling and unanimously carried, to approve the variance as requested with the condition that the parcel containing the lake frontage will have no further subdivisions and with the condition that a registered surveyor’s drawing meeting the requirements of the ordinance must be presented at the time of conveyance. Terry Erickson - Denied Terry Erickson, Richfield, MN, requested a variance of approximately 15’ from the required road right-of-way setback of 20’ for the placement of a slab approximately 5’ from the road right-of- way. The slab is 38’ from the centerline of the road instead of the required 53’. The property is described as Lot 45, Fair Oaks, West Battle Lake in Girard Township. The audience was polled with no one speaking for or against the request. A letter from Richard Doom in favor of the applicant’s request was read for the record.
