detrimental to the resources.

because there is an area on the property where the proposal could be built that would meet requirements.

The Board of Adjustment may impose conditions in the granting of variances. A condition must be directly related to and must

It is the Board of Adjustment's Job to apply appropriate legal standards to a specific fact situation. Variances are meant to be an
infrequent remedy where an ordinance imposes a unique and substantial burden.

approve a variance to construct a 14’ x 22’ addition to the existing cabin and based on the Findings of Fact and Decision Form, which
contains the criteria reviewed and the Board’s finding has been attached to and incorporated as an official part of the minutes which
has been placed on file with the Land & Resource Management Department. Hardship/practical difficulty is the current location of the
existing cabin and the lowland which is located behind the house. The variance as approved does not directly or indirectly grant any
other variances from proposed or future development.

Mindemann opposing the proposal was read for the record as well as a letter from Gary P Miller, Star Lake Property Owner’s
Association (SLPOA) indicating that the request be denied. After consideration and discussion, Darren Newville made a motion,
second by Douglas Larson and unanimously carried to deny the variance request as no adequate hardship/practical difficulty unique to
the property has been shown that would allow for the granting of the variance as requested and based on the Findings of Fact and
Decision Form, which contains the criteria reviewed and the Board’s finding have been attached to and incorporated as an official part
of the minutes which has been placed on file with the Land & Resource Management Department. The Board of Adjustment members

Please accept this letter as a general statement of concern for a variance request being
made by Mr. Eric Hanson and Mr. Liaz Barrios on property in Dead Lake Township.
There is a hearing scheduled before the County Board of Adjustments on May 9, 2019.
The variance request lists the property with an address of 38720 Beaver Dam Road, Dent,
Minnesota 56537 (parcel number 14000070056000).
The request asks for the granting of a variance to construct a home/shop that would be
placed 51 feet from the OHWL on Star Lake vs the 200 feet of setback currently required
by ordinance for this lake zone. It also requests a variance for 15,188 sq.ft, of impervious
surface coverage vs the allowed 260 sq. ft. in this zone.
This letter of concern is being filed on behalf of the Star Lake Property Owner’s
Association (SLPOA). The association is a 501(c)3 not-for-profit organization dedicated
to working to help maintain the water quality, fishery, wildlife habitat, and orderly and
proper development of the Star Lake resource. The variance being requested is for
property that appears to be within a wetlands area very near a natural environment lake
and very close to the shore of Star Lake itself. It clearly does not meet the requirements
of the shoreland management ordinance as currently written. Therefore, we recommend
the Board of Adjustment carefully examine this request and apply the requirements of the
ordinance causing the request to be denied.

SUBJECT: Eric Hanson Variance Request - Dead Lake Twp./Section 7
Dear Mr. Westergard and Respected Members of the Otter Tail County Board of Adjustment;
I am writing this letter to respectfully request that you deny this variance request. The
exceptions being sought here border on egregious. After viewing the parcel in question, it
appears to be a small area of high ground in the middle of a wetland that is classified as
"Recreational Development" bordering a "Natural Environment" lake and is situated
immediately adjacent to a "General Development" lake - all within the Shoreline Management
Ordinance. This seems like a 'trifecta' of bad reasons to build here.
Additionally, the amount of the "ask" here seems exorbitant, i.e. asking for a variance from a
200' setback to 51' setback, and an increase of the allowable impervious surface from 260
sq.feet to 15,188 sq.feet I! This is not a reasonable request and should be dismissed out of
hand.
Our Shoreline Management Ordinance is an important tool in responsibly managing the
wonderful natural resources of this county. We often hear complaints about the ordinance, but
I think most of our citizens realize the necessity for having it. One of the complaints I often
hear, is that it's not uniformly enforced. Approving a variance like this one gives credence to
that line of reasoning.
