Christopher Branchaud - Approved the variance as requested with conditions. (6:31 p.m.)
After discussion and consideration, Cecil Femling made a motion, second by Paul Larson to approve the variance as
requested. The motion failed with Michael Conlon, Randall Mann, Steve Schierer and Leona Zimmerman voting no.
After additional discussion and consideration, Michael Conlon made a motion, second by Steve Schierer and carried
with Randall Mann voting no, to approve a variance of 5’ from the required 20’ maximum height of a non dwelling
structure for the construction of an agricultural building have a height of 25’ with the condition that the existing 14’ by
70’ structure and the structure or structures located within the 20’ by 60’ area identified on the applicant’s drawing
must be removed. The Board noted that the proposed development is a significant improvement to the property, will
not obstruct view, is iake that is basically a slough and is part of an existing farm site.

The Otter Tail County Board of Adjustment met Thursday, November 30, 2005, with the following persons
in attendance:

Called to Order - Randall Mann, Chair called the meeting of the Board of Adjustment to order at
6:30 p.m.
Minutes Approved -
The Board of Adjustment approved the minutes of the November 3, 2005 Board of Adjustment meeting as
mailed.
The Board of Adjustment considered the following applications for variance:
Christopher Branchaud - Approved the variance as requested with conditions. (6:31 p.m.)
Christopher Branchaud, part of Government Lot 3, part of the Southwest Quarter Southeast Quarter and
part of the South Half Southwest Quarter, Section 4 of Dead Lake Township by Bolton Lake, requested a
variance of 5’ from the required 20’ maximum height of a non dwelling structure for the construction of an
agricultural building have a height of approximately 25'. The audience was polled with Robin Branchaud
addressing the need to be allowed to keep the 14' by 70’ mobile home. After discussion and consideration,
Cecil Femling made a motion, second by Paul Larson to approve the variance as requested. The motion
failed with Michael Conlon, Randall Mann, Steve Schierer and Leona Zimmerman voting no. After
additional discussion and consideration, Michael Conlon made a motion, second by Steve Schierer and
carried with Randall Mann voting no, to approve a variance of 5’ from the required 20’ maximum height of a
non dwelling structure for the construction of an agricultural building have a height of 25’ with the condition
that the existing 14’ by 70’ structure and the structure or structures located within the 20’ by 60’ area
identified on the applicant’s drawing must be removed. The Board noted that the proposed development is

Jeffry and Jeanie Volk - Denied. (6:47 p.m.)
Jeffry and Jeanie Volk, Lot 8 Plainview Sandy Beach, Little McDonald Lake in Edna Township, requested a
variance of 10’ from the required ordinary high water level setback of 75’ for the placement of a non
dwelling structure 65’ from the ordinary high water level and a variance of 2’ from the required septic tank
setback of 10’ for the location of an addition to an existing house 8’ from the septic tank. The audience was
polled with no one speaking for or against the variance as requested. A letter from Peter and Patricia
Fullerton and an email from Jeff and Ann Jones in support of the variance as requested were read for the
record. After discussion and consideration, Randall Mann made a motion, second by Steve Schierer and
unanimousiy carried, to deny the variance as requested as no adequate hardship unique to the property
had been shown that would allow for the granting of the variance as requested and noting the following: 1)
the variance as requested would have been denied had the request been made prior to the start of the
project because the applicants did have and could have obtained a reasonable use of there property
without the granting oHhe variance as requested and 2) health issue concerns when septic tanks are
placed less than 10’ from occupied structures.
