The Graupmanns have applied for a site permit and have been advised that it cannot be granted because they would be in violation of the impervious surface limitations. A question has arisen as to whether or not the 33 foot roadway south of their property and running along the railroad right of way is part of their property. Your office has initially taken the position that the roadway is part of the Graupmanns’ property. If the road right of way is a part of their property, since the majority of the roadway constitutes impervious surface, it significantly affects the available surface area on the remainder of their lot. Please review the descriptions of both tracts on the deed and you will note that both descriptions contain an exception for the south 33 feet along the railroad which is reserved for road purposes. I believe that the use of the word “except” means that the roadway property was not conveyed and is not owned by the Graupmanns. Title to that 33 foot wide strip remains in the original owner. If the description had been subject to a roadway on the south 33 feet, the roadway would then be part of the Graupmanns’ property, or if the description had excepted an easement for road purposes, the 33 foot strip would then be part of the Graupmanns’ property. However, neither of the foregoing occurred and the Graupmanns do not own the 33 foot roadway. Consequently, the proper interpretation of the description is that the south 33 feet along the railroad is excepted from the conveyance and did not pass to the Graupmanns. Please review and advise if your office agrees that the 33 foot roadway is not a part of the Graupmanns’ property.
