THIS INDENTURE, Made this 5th day of June, 1970, between
Paul P. Barnack, also known as Paul Barnack, a single man, of the
County of Otter Tail and State of Minnesota, party of the first part,
and Stanley A. Lepak and Valerie Mary Lepak, husband and wife, of
the County of St.Louis and State of Minnesota, parties of the second
part,

WITNESSETH, That the said party of the first part, in con^-
sideration of the sum of One Dollar ($1.00) and other valuable consider
ations, to him in hand paid by the said parties of the second part, the
receipt whereof is hereby acknowledged, does hereby Grant, Bargain,
Sell, and Convey unto the said parties of the second part as joint tenants
and not as tenants in common, their assigns, the survivor of said parties,
and the heirs and assigns of the survivor. Forever, all the tract or parcel
of land lying and being in the County of Otter Tail and State of Minnesota,,

that portion thereof included in the right of way of the Minneapolis,

way right-of-way, in Government L^ot Four (4), Section Two (2), Town

as follows: 911.9 feet west of the southeast corner of and on the south
line of said Government Lot Four (4), and the intersection of the North
line of the Soo Line Railway and 30.8 feet westerly oh north line of Soo '
Line Railway; thence westerly along north line of the Soo Line Railway
51,4 feet, thence due north 355,1 feet to the shore of Marion Lake, thence
north 83 degrees 45 minutes East 50.4 feet along the shore-of Marion

Right-of-way, in Government Lot Four (4), Section Two (2), township
One Hundred Thirty-five (135), Range Forty (40), Dead Lake Township,
Otter Tail County, Minnesota, which is described as follows: 911.9 feet
west of the southeast corner of and on the south line of said Government
Lot Four (4) and the intersection of the north line of the Soo Line Railway
and 546.2 feet westerly on the north line of said Railway: Thence westerly
cilong the north line of said Railway 61,4 feet, thence due north 155 feet to

feet, thence due south 173 feet to the place of beginning. The above described
tract contains 19/100 acres more or less and of this tract, the south 33 feet
-along the railway is reserved for road purposes. Parties of the second
part are to have the privilege of using tract 33 feet wide running from
said George Kratzke lot to the main road, for road purpose.
4. A tract of land, beginning at a point on the north line- of the
Soo Line Railroad right-of-way, in Government Lot Four (4), Section Two
(2), Township One Hundred Thirty-five (136), Range Forty (40), Dead Lake

. 911 feet west of the southeast corner of and on the south line of said
Government Lot Four (4) and the intersection of the north line of the
Soo Line Railroad and 597.6 feet westerly on the north line of said
railroad; thence westerly along the north line of said railroad on the
north line of said railroad; thence westerly along the north line of
said railroad 206.6 feet; thence due north 110 feet to the shore of
Marion Lake; thence east along the shore of said lake 200 feet; thence
due south 155 feet to the place of beginning, except therefrom the south
33 feet along the railroad which is reserved for road purposes.
5. Beginning at a point on the north line of the Soo Line Rail
road right-of-way, in Government Lot Four (4), Section Two (2), Town
ship One Hundred Thirty-five (135), Range Forty (40), Dead Lake Town
ship, Otter Tail County, Minnesota, which is described as follows: 911.9
feet west of the southeast corner of and on the south line of said Govern
ment Lot Four (4) and the intersection of the north line of the Soo Line
Railroad and 804.2 feet westerly on the north line of said Railroad; thence
westerly along the north line of said Railroad fifty-two feet (52'), thence
due north 114 feet to the shore of Marion Lake, thence east along the
shore of said Mar inn Lake 53 feet, thence due south 110 feet to the point
of beginning. Of this tract the south 33 feet along the railroad is re
served for road purposes.
6. Beginning at a point on the north line of the Soo Line Rail
way right-of-way in Government Lot Four (4), of Section Two (2), Town
ship One Hundred Thirty-five (135), Range Forty (40), which is described
as follows; 911.9 feet west of the southeast corner of and on the south
line of said Government Lot Four (4), and the intersection of the north
line of the Soo Line Railway and 30. 8 feet westerly on north line of Soo Line
Railway; thence westerly along north line of the Soo Line Railway 51.4 feet to
a point which is the point of beginning, of the tract of land to be conveyed
herein; thence continuing in a northwesterly direction on and along the north
line of the Soo Line Railway right of way, a distance of 75 feet; thence due
north approximately 355.1 feet to the shore of Marion Lake, thence in a
northeasterly direction on and along the shore of Marion Lake, a distance of
75 feet; thence south to intersect the north line of the Soo Line right of way
a distance of approximately 355.1 feet to the point of beginning, and there
terminating. The above described tract adjoins cind abutts a tract of land
previously conveyed to Frank W. Anderson.

V$7This Deed requires Minnesota Deed Tax Stamps in the sum
TO HAVE AND TO HOLD THE SAME, Together with all the heredita
ments and appurtenances thereunto belonging or in anywise appertaining, to
the said parties of the second part, their assigns, the survivor of said parties,
and the heirs and assigns of the survivor, Forever, the said parties of the
second part taking as joint tenants and not as tenants in common.!
And the said Paul P. Barnack, party of the first part, for himself,
his heirs, executors and administrators do covenant with the said parties
of the second part, their assigns, the survivor of said parties, and the heirs
and assigns of the survivor, that he is well seized in fee of the lands and
premises aforesaid and has good right to sell and convey the same in manner
and form aforesaid, and that the same are free from all incumbrances.
